S.F. 2277 Section 1. Section 329.9, Code 2009, is amended to read as 1 follows: 2 329.9 Procedure for adopting zoning regulations —— zoning 3 commission. 4 In adopting, amending, and repealing airport zoning 5 regulations under this chapter the governing body of a city 6 shall follow the procedure in sections 414.4 , 414.4A, and 414.6 7 and the board of supervisors of a county shall follow the 8 procedure in sections 335.6 , 335.6A, and 335.8. The commission 9 so appointed shall be known as the airport zoning commission. 10 The airport zoning commission shall consist of two members 11 from each municipality selected by the governing body and one 12 additional member to act as chairperson and to be selected by a 13 majority vote of the members selected by the municipality. The 14 terms of the members of the airport zoning commission shall be 15 for six years excepting that when the board is first created, 16 one of the members appointed by each municipality shall be 17 appointed for a term of two years and one for a term of four 18 years. Members may be removed for cause by the appointing 19 authority upon written charges after public hearing. Vacancies 20 shall be filled for the unexpired term of any member whose 21 office becomes vacant in the same manner in which the member 22 was selected. 23 Sec. 2. NEW SECTION . 335.6A Required notice to Camp Dodge. 24 1. Prior to the adoption or amendment of an ordinance, 25 regulation, or restriction that affects property located within 26 one-half mile of the real property comprising Camp Dodge or 27 prior to any action relating to the granting of a variance from 28 an ordinance, regulation, or restriction that affects property 29 located within one-half mile of the real property comprising 30 Camp Dodge, the county shall provide notice to the adjutant 31 general of the state. 32 2. Notice required under this section shall include all 33 information required to be provided in a notice under section 34 335.6 and any other information that is relevant to the 35 -1- LSB 5194XS (13) 83 md/sc 1/ 2

S.F. 2277 operation or security of Camp Dodge. 1 3. Notice required under this section shall be provided 2 within the time period required by section 331.305. 3 4. Notice required under this section shall be in addition 4 to any notice required under section 335.6. 5 Sec. 3. NEW SECTION . 414.4A Required notice to Camp Dodge. 6 1. Prior to the adoption or amendment of an ordinance, 7 regulation, or restriction that affects property located within 8 one-half mile of the real property comprising Camp Dodge or 9 prior to any action relating to the granting of a variance from 10 an ordinance, regulation, or restriction that affects property 11 located within one-half mile of the real property comprising 12 Camp Dodge, the city shall provide notice to the adjutant 13 general of the state. 14 2. Notice required under this section shall include all 15 information required to be provided in a notice under section 16 414.4 and any other information that is relevant to the 17 operation or security of Camp Dodge. 18 3. Notice required under this section shall be provided 19 within the time period required by section 362.3. 20 4. Notice required under this section shall be in addition 21 to any notice required under section 414.4. 22 EXPLANATION 23 This bill requires a city or county, as applicable, prior 24 to the adoption of, amendment of, or variance from, a zoning 25 ordinance, regulation, or restriction that affects property 26 located within one-half mile of the real property comprising 27 Camp Dodge, to provide notice to the adjutant general of the 28 state. The notice is required to include the same information 29 required to be published in other public notices related to 30 zoning and include any other information that is relevant to 31 the operation or security of Camp Dodge.
