S.F. 2274 Section 1. Section 260C.14, subsection 14, paragraph b, 1 subparagraph (2), subparagraph division (b), Code Supplement 2 2009, is amended to read as follows: 3 (b) “Qualified military person” means a person on active 4 duty in the military service of the United States who is 5 stationed in this state or at the Rock Island arsenal. If 6 the qualified military person is transferred, deployed, or 7 restationed while the person’s spouse or child is enrolled in 8 the community college, the spouse or child shall continue to be 9 classified as a resident until the close of the fiscal year in 10 which the spouse or child is enrolled. 11 Sec. 2. Section 260C.14, subsection 14, paragraph b, 12 subparagraph (2), subparagraph division (c), subparagraph 13 subdivision (ii), Code Supplement 2009, is amended to read as 14 follows: 15 (ii) Is domiciled Has resided in this state at least one 16 year or sufficient time to have filed an Iowa tax return in the 17 preceding twelve months . 18 Sec. 3. Section 260C.14, subsection 20, unnumbered 19 paragraph 1, Code Supplement 2009, is amended to read as 20 follows: 21 Adopt a policy to offer not less than the following options 22 to a student who is a member , or the spouse of a member if 23 the member has a dependent child as defined in subsection 14, 24 paragraph “b” , subparagraph (2), subparagraph division (a), of 25 the Iowa national guard or reserve forces of the United States 26 and who is ordered to state military service or federal service 27 or duty: 28 Sec. 4. Section 262.9, subsection 17, paragraph b, 29 subparagraph (2), subparagraph division (b), Code Supplement 30 2009, is amended to read as follows: 31 (b) “Qualified military person” means a person on active 32 duty in the military service of the United States who is 33 stationed in this state or at the Rock Island arsenal. Section 262.9, subsection 17, paragraph b, 6 subparagraph (2), subparagraph division (c), subparagraph 7 subdivision (ii), Code Supplement 2009, is amended to read as 8 follows: 9 (ii) Is domiciled Has resided in this state at least one 10 year or sufficient time to have filed an Iowa tax return in the 11 preceding twelve months . 12 Sec. 6. Section 262.9, subsection 30, unnumbered paragraph 13 1, Code Supplement 2009, is amended to read as follows: 14 Direct the institutions of higher education under its 15 control to adopt a policy to offer not less than the following 16 options to a student who is a member , or the spouse of a member 17 if the member has a dependent child as defined in subsection 18 17, paragraph “b” , subparagraph (2), subparagraph division 19 (a), of the Iowa national guard or reserve forces of the United 20 States and who is ordered to state military service or federal 21 service or duty: 22 Sec. 7. Section 272.8, Code 2009, is amended to read as 23 follows: 24 272.8 License to applicants from other states or countries. 25 1. The board may issue a license to an applicant from 26 another state or country if the applicant files evidence of the 27 possession of the required or equivalent requirements with the 28 board. If the applicant is the spouse of a military person who 29 is on duty or in active state duty as defined in section 29A.1, 30 subsections 9 and 11, the board shall assign a consultant to 31 be the single point of contact for the applicant regarding 32 nontraditional licensure. 33 2. The executive director of the board may, subject to board 34 approval, enter into reciprocity agreements with another state 35 -2- LSB 5248SV (3) 83 kh/sc 2/ 5
S.F. 2274 or country for the licensing of practitioners on an equitable 1 basis of mutual exchange, when the action is in conformity with 2 law. 3 3. Practitioner preparation and professional development 4 programs offered in this state by out-of-state institutions 5 must be approved by the board in order to fulfill requirements 6 for licensure or renewal of a license by an applicant. 7 Sec. 8. NATIONAL SECURITY EDUCATION PROGRAM WORKING 8 GROUP. The department of education, in collaboration with the 9 state board of regents, shall convene a working group that 10 includes but is not limited to representatives of the business 11 community of this state, to explore the possibility of securing 12 the cooperation and assistance of the United States department 13 of defense, the national defense university, and the national 14 security education board to participate in the federal national 15 security education program and establish a foreign language 16 road map, flagship program, and timeline in this state for K-16 17 and graduate-level students. The working group also shall 18 study the feasibility, including but not limited to the costs, 19 of establishing the road map, program, and timeline, and shall 20 submit a report of its findings and recommendations to the 21 general assembly by January 15, 2011. 22 Sec. 9. DEPARTMENT OF VETERANS AFFAIRS —— VETERANS AND 23 DEPENDENT CHILDREN POSTSECONDARY UNDERGRADUATE EDUCATION 24 BENEFITS STUDY. The department of veterans affairs shall 25 conduct a study, in collaboration with the state board of 26 regents and the department of education and other postsecondary 27 stakeholders as determined by the department of veterans 28 affairs, of the need to provide greater postsecondary 29 undergraduate education benefits for veterans and their 30 dependents, including but not limited to dependent children of 31 service-connected disabled veterans. The study shall include 32 a review of current federal education benefits for veterans 33 and their dependents, cost and participation estimates, and a 34 review of educational benefits currently provided to veterans 35 -3- LSB 5248SV (3) 83 kh/sc 3/ 5
S.F. 2274 and their dependents by other states throughout the country. 1 The department of veterans affairs shall submit its findings 2 and recommendations in a report to the general assembly by 3 December 31, 2010. 4 EXPLANATION 5 This bill provides education-related benefits for military 6 persons and veterans, and certain registration, tuition, and 7 fee options for postsecondary students who are spouses of 8 guard members or reservists ordered to service. The bill also 9 directs the department of education to work with the state 10 board of regents to convene a working group to explore the 11 possibility of participating in a federal program whose goal is 12 to build a broad pool of internationally competent individuals 13 who are available for recruitment into the federal national 14 security community, and directs the department of veterans 15 affairs to conduct a study of the need to provide greater 16 undergraduate benefits for veterans and their dependents. 17 The bill provides for in-state tuition for military 18 personnel stationed in Iowa and for veterans who have resided 19 in Iowa at least one year or sufficient time to have filed an 20 Iowa tax return in the preceding twelve months. 21 The bill directs the boards of directors of community 22 colleges and the state board of regents to provide students 23 who are spouses of members of the Iowa national guard or the 24 reserve forces of the United States, who are ordered to state 25 military service or federal service or duty, with the same 26 options currently offered to the members, which are to withdraw 27 and receive a full refund of tuition and mandatory fees or to 28 make arrangements for some or all course grades or incompletes, 29 with refunds only paid for courses for which arrangements could 30 not be made for grades or incompletes. 31 The bill directs the board of educational examiners to 32 assign a consultant to be the single point of contact for an 33 applicant who is licensed by another state or country and who 34 is the spouse of a military person who is on duty or in active 35 -4- LSB 5248SV (3) 83 kh/sc 4/ 5
