S.F. 2273 Section 1. ELECTRONIC VEHICLE REGISTRATION AND TITLING —— 1 INTENT. It is the intent of the general assembly to establish 2 a uniform statewide system to allow electronic transactions 3 for the initial registration and titling of motor vehicles, 4 including electronic applications, electronic issuance of 5 titles, electronic registration, electronic transfer of funds, 6 electronic perfection of liens, and issuance of secure and 7 individually identifiable temporary registration cards, by 8 January 1, 2012. 9 Sec. 2. ELECTRONIC VEHICLE REGISTRATION AND TITLING 10 —— IMPLEMENTATION STUDY. 11 1. The department of transportation shall conduct a study 12 of how to implement a uniform statewide system to allow 13 electronic transactions for the registration and titling of 14 motor vehicles. 15 2. The study shall include participation by representatives 16 from the consumer protection division of the office of the 17 attorney general, the department of public safety, the 18 department of revenue, the Iowa state county treasurers 19 association, the Iowa automobile dealers association, the Iowa 20 independent automobile dealers association, and any other 21 persons designated by the department of transportation. 22 3. The study shall include but not be limited to an 23 examination of all of the following: 24 a. The development of a cost-effective, efficient, secure, 25 and user-friendly uniform statewide system to allow electronic 26 applications for motor vehicle registrations and titles, 27 electronic perfection of liens on motor vehicle titles, 28 issuance of secure and individually identifiable temporary 29 registration cards, and electronic transfer of necessary funds 30 for those purposes. 31 b. The estimated costs and benefits to the department of 32 transportation of implementing a uniform statewide system to 33 allow electronic transactions for the registration and titling 34 of motor vehicles. 35 -1- LSB 5701SV (1) 83 dea/nh 1/ 3

The estimated costs and benefits to the county treasurers 1 of implementing a uniform statewide system to allow electronic 2 transactions for the registration and titling of motor 3 vehicles. 4 d. The estimated costs and benefits to motor vehicle dealers 5 licensed under chapter 322 of implementing a uniform statewide 6 system to allow electronic transactions for the registration 7 and titling of motor vehicles. 8 e. The estimated costs and benefits to consumers of 9 implementing a uniform statewide system to allow electronic 10 transactions for the registration and titling of motor 11 vehicles. 12 f. The estimated costs and benefits of enhancing current 13 computer systems maintained by the department of transportation 14 and county treasurers as compared to the estimated costs and 15 benefits of using a vendor to assist in the implementation 16 and administration of a uniform statewide system to allow 17 electronic transactions for the registration and titling of 18 motor vehicles. 19 g. Procedures and best practices utilized by other states 20 that allow electronic transactions for the registration and 21 titling of motor vehicles. 22 h. Information regarding the impact of an electronic filing 23 system on access to private information and other security 24 concerns. 25 i. Whether any statutes or administrative rules should be 26 amended or repealed to implement a uniform statewide system to 27 allow electronic transactions for the registration and titling 28 of motor vehicles. 29 j. Any other issues that the department of transportation 30 or other persons involved in the study identify related 31 to implementation of a uniform statewide system to allow 32 electronic transactions for the registration and titling of 33 motor vehicles. 34 4. S.F. 2273 2010, issue a report to the general assembly containing the 1 results of the study required by this section. 2 Sec. 3. EFFECTIVE UPON ENACTMENT. This Act, being deemed of 3 immediate importance, takes effect upon enactment. 4 EXPLANATION 5 This bill expresses the general assembly’s intent to 6 establish a uniform statewide system to allow electronic 7 transactions for the initial registration and titling of motor 8 vehicles by January 1, 2012. 9 The department of transportation is required to conduct 10 a study concerning implementation of the uniform statewide 11 system, with participants from the consumer protection 12 division of the attorney general’s office, the department 13 of public safety, the department of revenue, the Iowa state 14 county treasurers association, the Iowa automobile dealers 15 association, and the Iowa independent automobile dealers 16 association. 17 The bill takes effect upon enactment.
