S.F. 2217 Section 1. Section 99B.17, Code 2009, is amended to read as 1 follows: 2 99B.17 Gambling on credit unlawful —— exception . 3 1. A person who tenders and a person who receives any 4 promise, agreement, note, bill, bond, contract, mortgage or 5 other security, or any negotiable instrument, as consideration 6 for any wager or bet, whether or not lawfully conducted or 7 engaged in pursuant to this chapter, commits a misdemeanor. 8 However, a participant in a bingo occasion or in a contest 9 lawful under section 99B.11 may make payment by personal check 10 for any entry or participation fee assessed by the sponsor of 11 the bingo occasion or contest. 12 2. a. A participant in a raffle conducted by an eligible 13 qualified organization may purchase raffle tickets by personal 14 check, money order, bank check, cashier’s check, electronic 15 check, credit card, or debit card for one raffle conducted by 16 the eligible qualified organization during a calendar year. 17 The department shall adopt rules setting minimum standards 18 concerning the purchase of raffle tickets as authorized 19 by this section for the protection of personal information 20 consistent with payment card industry compliance regulations. 21 For purposes of this subsection, an “eligible qualified 22 organization” is a qualified organization that has conducted 23 a raffle pursuant to section 99B.7 during the previous eight 24 consecutive calendar years in which the net proceeds are 25 distributed to a museum. 26 b. The department shall adopt rules setting minimum 27 standards concerning the purchase of raffle tickets as 28 authorized by this subsection for the protection of personal 29 information consistent with payment card industry regulations. 30 EXPLANATION 31 This bill authorizes a participant in a raffle conducted 32 by an eligible qualified organization to purchase raffle 33 tickets by check, money order, credit card, or debit card for 34 one raffle per calendar year. S.F. 2217 qualified organization as a qualified organization that has 1 conducted a raffle during the previous eight consecutive 2 calendar years in which the net proceeds are distributed to a 3 museum. Current law makes it a misdemeanor to gamble or wager 4 on credit.
