S.F. 2211 Section 1. Section 8A.362, subsection 8, Code Supplement 1 2009, is amended to read as follows: 2 8. The director shall require that a sign be placed on 3 each state-owned motor vehicle in a conspicuous place which 4 indicates its ownership by the state. This requirement 5 shall not apply to motor vehicles requested to be exempt by 6 the director or by the commissioner of public safety. All 7 state-owned motor vehicles shall display a registration 8 plates plate bearing the word “official” except motor vehicles 9 requested to be furnished with an ordinary plates plate by the 10 director or by the commissioner of public safety pursuant to 11 section 321.19. The director shall keep an accurate record of 12 the registration plates used on all state-owned motor vehicles. 13 Sec. 2. Section 321.18, subsection 7, Code Supplement 2009, 14 is amended to read as follows: 15 7. Any school bus in this state used exclusively for 16 the transportation of pupils to and from school or a school 17 function or for the purposes provided in section 285.1, 18 subsection 1, and section 285.10, subsection 9, or used 19 exclusively for the transportation of children enrolled in a 20 federal head start program. Upon application the department 21 shall, without charge, issue a registration certificate and 22 registration plates plate . The plates plate shall be attached 23 to the front and rear of each bus exempt from registration 24 under this subsection. 25 Sec. 3. Section 321.19, subsection 1, Code 2009, is amended 26 to read as follows: 27 1. a. All vehicles owned or leased for a period of sixty 28 days or more by the government and used in the transaction of 29 official business by the representatives of foreign governments 30 or by officers, boards, or departments of the government of the 31 United States, and by the state, counties, municipalities and 32 other political subdivisions of the state including vehicles 33 used by an urban transit company operated by a municipality or 34 a regional transit system, and self-propelling vehicles used 35 -1- LSB 5537XS (9) 83 dea/nh 1/ 52
S.F. 2211 neither for the conveyance of persons for hire, pleasure, or 1 business nor for the transportation of freight other than those 2 used by an urban transit company operated by a municipality or 3 a regional transit system, all fire trucks, providing they are 4 not owned and operated for a pecuniary profit, and authorized 5 emergency vehicles used only in disaster relief owned and 6 operated by an organization not operated for pecuniary profit, 7 are exempted from the payment of the registration fees imposed 8 by this chapter, except as provided for urban transit companies 9 in subsection 2, but are not exempt from the penalties provided 10 in this chapter. 11 b. The department shall furnish, on application, free of 12 charge, distinguishing plates for vehicles thus exempted, 13 which plates except plates on state patrol vehicles shall bear 14 the word “official” and the department shall keep a separate 15 record. Registration plates issued for state patrol vehicles, 16 except unmarked patrol vehicles, shall bear two red stars 17 on a yellow background, one before and one following the 18 registration number on the plate, which registration number 19 shall be the officer’s badge number. Registration plates 20 issued for county sheriff’s patrol vehicles shall display 21 one seven-pointed gold star followed by the letter “S” and 22 the call number of the vehicle. However, the director of 23 the department of administrative services or the director of 24 transportation may order the issuance of a regular registration 25 plates plate for any exempted vehicle used by peace officers 26 in the enforcement of the law, persons enforcing chapter 124 27 and other laws relating to controlled substances, persons in 28 the department of justice, the alcoholic beverages division 29 of the department of commerce, disease investigators of the 30 Iowa department of public health, the department of inspections 31 and appeals, and the department of revenue, who are regularly 32 assigned to conduct investigations which cannot reasonably 33 be conducted with a vehicle displaying an “official” state 34 registration plates plate , persons in the Iowa lottery 35 -2- LSB 5537XS (9) 83 dea/nh 2/ 52
S.F. 2211 authority whose regularly assigned duties relating to security 1 or the carrying of lottery tickets cannot reasonably be 2 conducted with a vehicle displaying an “official” registration 3 plates plate , persons in the department of economic development 4 who are regularly assigned duties relating to existing 5 industry expansion or business attraction, and mental health 6 professionals or health care professionals who provide off-site 7 or in-home medical or mental health services to clients of 8 publicly funded programs. For purposes of sale of exempted 9 vehicles, the exempted governmental body, upon the sale of 10 the exempted vehicle, may issue for in-transit purposes a 11 pasteboard card bearing the words “Vehicle in Transit”, the 12 name of the official body from which the vehicle was purchased, 13 together with the date of the purchase plainly marked in at 14 least one-inch letters, and other information required by the 15 department. The in-transit card is valid for use only within 16 forty-eight hours after the purchase date as indicated on the 17 bill of sale which shall be carried by the driver. 18 Sec. 4. Section 321.20B, subsection 4, paragraph a, 19 subparagraph (3), unnumbered paragraph 1, Code 2009, is amended 20 to read as follows: 21 Issue a citation and remove the motor vehicle’s license 22 plates plate and registration receipt. 23 Sec. 5. Section 321.20B, subsection 4, paragraph a, 24 subparagraph (3), subparagraph division (a), Code 2009, is 25 amended to read as follows: 26 (a) Upon removing the license plates plate and registration 27 receipt, the peace officer shall deliver the plates plate for 28 destruction, as appropriate, and forward the registration 29 receipt and evidence of the violation, as determined by the 30 department, to the county treasurer of the county in which the 31 motor vehicle is registered. 32 Sec. 6. Section 321.20B, subsection 4, paragraph a, 33 subparagraph (4), subparagraph division (a), Code 2009, is 34 amended to read as follows: 35 -3- LSB 5537XS (9) 83 dea/nh 3/ 52
S.F. 2211 (a) Issue a citation, remove the motor vehicle’s license 1 plates plate and registration receipt, and impound the motor 2 vehicle. The peace officer shall deliver the plates plate for 3 destruction, as appropriate, and forward the registration 4 receipt and evidence of the violation, as determined by the 5 department, to the county treasurer of the county in which the 6 motor vehicle is registered. 7 Sec. 7. Section 321.20B, subsection 4, paragraph b, 8 subparagraph (1), subparagraph divisions (a) and (b), Code 9 2009, are amended to read as follows: 10 (a) If the person was cited pursuant to paragraph “a” , 11 subparagraph (3), the owner or driver shall provide a copy of 12 the receipt to the county treasurer of the county in which the 13 motor vehicle is registered and the owner shall be assessed a 14 fifteen dollar administrative fee by the county treasurer who 15 shall issue a new license plates plate and registration to the 16 person after payment of the fee. 17 (b) If the person was cited pursuant to paragraph “a” , 18 subparagraph (4), the owner or driver, after the owner 19 provides proof of financial liability coverage to the clerk 20 of court, may claim the motor vehicle after such person pays 21 any applicable fine and the costs of towing and storage for 22 the motor vehicle, and the owner or driver provides a copy 23 of the receipt and the owner pays to the county treasurer of 24 the county in which the motor vehicle is registered a fifteen 25 dollar administrative fee, and the county treasurer shall issue 26 a new license plates plate and registration to the person. 27 Sec. 8. Section 321.20B, subsection 4, paragraph b, 28 subparagraph (2), subparagraph divisions (a) and (b), Code 29 2009, are amended to read as follows: 30 (a) Sign an admission of violation on the citation and 31 remit to the clerk of court a scheduled fine as provided in 32 section 805.8A, subsection 14, paragraph “f” , for a violation of 33 subsection 1. Upon payment of the fine to the clerk of court of 34 the county where the citation was issued, payment of a fifteen 35 -4- LSB 5537XS (9) 83 dea/nh 4/ 52
S.F. 2211 dollar administrative fee to the county treasurer of the 1 county in which the motor vehicle is registered, and providing 2 proof of payment of any applicable fine and proof of financial 3 liability coverages to the county treasurer of the county in 4 which the motor vehicle is registered, the treasurer shall 5 issue a new license plates plate and registration to the owner. 6 (b) Request an appearance before the court on the matter. 7 If the matter goes before the court, and the owner or driver 8 is found guilty of a violation of subsection 1, the court 9 may impose a fine as provided in section 805.8A, subsection 10 14, paragraph “f” , for a violation of subsection 1, or the 11 court may order the person to perform unpaid community service 12 instead of the fine. Upon the payment of the fine or the 13 entry of the order for unpaid community service, the person 14 shall provide proof of payment or entry of such order and the 15 county treasurer of the county in which the motor vehicle 16 is registered shall issue a new license plates plate and 17 registration to the owner upon the owner providing proof of 18 financial liability coverage and paying a fifteen dollar 19 administrative fee to the county treasurer. 20 Sec. 9. Section 321.22, subsection 1, Code Supplement 2009, 21 is amended to read as follows: 22 1. An urban transit company or system having a franchise 23 to operate in any city and any regional transit system may 24 make application to the department, upon forms furnished by 25 the department, for a certificate containing a distinguishing 26 number and for one or more pairs of registration plates to be 27 attached to the front and rear of buses owned or operated by 28 the transit company or system. 29 Sec. 10. Section 321.23, subsection 3, Code Supplement 30 2009, is amended to read as follows: 31 3. In the event an applicant for registration of a foreign 32 vehicle for which a certificate of title has been issued is 33 able to furnish evidence of being the registered owner of the 34 vehicle to the county treasurer of the owner’s residence, 35 -5- LSB 5537XS (9) 83 dea/nh 5/ 52
S.F. 2211 although unable to surrender such certificate of title, 1 the county treasurer may issue a registration receipt and 2 plates plate upon receipt of the required annual registration 3 fee and the fee for new registration but shall not issue a 4 certificate of title thereto for the vehicle . Upon surrender 5 of the certificate of title from the foreign state, the 6 county treasurer shall issue a certificate of title to the 7 owner , of the vehicle or other person entitled thereto, 8 of such vehicle to the certificate of title as provided in 9 this chapter. The owner of a vehicle registered under this 10 subsection shall not be required to obtain a certificate of 11 title in this state and may transfer ownership of the vehicle 12 to a motor vehicle dealer licensed under chapter 322 if, at the 13 time of the transfer, the certificate of title is held by a 14 secured party and the dealer has forwarded to the secured party 15 the sum necessary to discharge the security interest pursuant 16 to section 321.48, subsection 1. 17 Sec. 11. Section 321.25, unnumbered paragraph 1, Code 2009, 18 is amended to read as follows: 19 A vehicle may be operated upon the highways of this state 20 without a registration plates plate for a period of forty-five 21 days after the date of delivery of the vehicle to the purchaser 22 from a dealer if a card bearing the words “registration applied 23 for” is attached on the rear of the vehicle. The card shall 24 have plainly stamped or stenciled the registration number of 25 the dealer from whom the vehicle was purchased and the date 26 of delivery of the vehicle. In addition, a dealer licensed 27 to sell new motor vehicles may attach the card to a new motor 28 vehicle delivered by the dealer to the purchaser even if the 29 vehicle was purchased from an out-of-state dealer and the card 30 shall bear the registration number of the dealer that delivered 31 the vehicle. A dealer shall not issue a card to a person 32 known to the dealer to be in possession of a registration 33 plates plate which may be attached to the vehicle. A dealer 34 shall not issue a card unless an application for registration 35 -6- LSB 5537XS (9) 83 dea/nh 6/ 52
S.F. 2211 and certificate of title has been made by the purchaser and a 1 receipt issued to the purchaser of the vehicle showing the fee 2 paid by the person making the application. Dealers’ records 3 shall indicate the agency to which the fee is sent and the date 4 the fee is sent. The dealer shall forward the application by 5 the purchaser to the county treasurer or state office within 6 thirty calendar days from the date of delivery of the vehicle. 7 However, if the vehicle is subject to a security interest 8 and has been offered for sale pursuant to section 321.48, 9 subsection 1, the dealer shall forward the application by the 10 purchaser to the county treasurer or state office within thirty 11 calendar days from the date of the delivery of the vehicle to 12 the purchaser. 13 Sec. 12. Section 321.26, subsection 2, Code 2009, is amended 14 to read as follows: 15 2. The county treasurer may adjust the renewal or expiration 16 date of vehicles when deemed necessary to equalize the number 17 of vehicles registered in each twelve-month period or for 18 the administrative efficiency of the county treasurer’s 19 office. The adjustment shall be accomplished by delivery 20 of a written notice to the vehicle owner of the adjustment 21 and allowance of a credit for the remaining months of the 22 unused portion of the annual registration fee, rounded to the 23 nearest whole dollar, which amount shall be deducted from 24 the annual registration fee due at the time of registration. 25 Upon receipt of the notification the owner shall, within 26 thirty days, surrender the registration card and registration 27 plates plate to the county treasurer of the county where 28 the vehicle is registered, except that the registration 29 plates plate shall not be surrendered if validation stickers 30 or other emblems are used to designate the month and year 31 of expiration of registration. Upon payment of the annual 32 registration fee, less the credit allowed for the remaining 33 months of the unused portion of the annual registration fee, 34 the county treasurer shall issue a new registration card and 35 -7- LSB 5537XS (9) 83 dea/nh 7/ 52
S.F. 2211 registration plates plate , validation stickers sticker , or 1 emblems emblem which indicate indicates the month and year of 2 expiration of registration. 3 Sec. 13. Section 321.34, Code 2009, is amended to read as 4 follows: 5 321.34 Plates Plate or validation sticker furnished —— 6 retained by owner —— special plates. 7 1. Plates Plate issued. The county treasurer upon receiving 8 application, accompanied by proper fee, for registration of a 9 vehicle shall issue to the owner one registration plate for 10 a motorcycle, motorized bicycle, truck tractor, trailer, or 11 semitrailer and two registration plates for every other motor 12 vehicle . The registration plates plate , including a special 13 registration plates plate , shall be assigned to the owner of a 14 vehicle. When the owner of a registered vehicle transfers or 15 assigns ownership of the vehicle to another person, the owner 16 shall remove the registration plates plate from the vehicle. 17 The owner shall forward the plates plate to the county 18 treasurer where the vehicle is registered or the owner may have 19 the plates plate assigned to another vehicle within thirty days 20 after transfer, upon payment of the fees required by law. The 21 owner shall immediately affix a registration plates 22 plate retained by the owner to another vehicle owned or 23 acquired by the owner, providing the owner complies with 24 section 321.46. The department shall adopt rules providing for 25 the assignment of a registration plates plate to the transferee 26 of a vehicle for which a credit is allowed under section 27 321.46, subsection 6. 28 2. Validation stickers. 29 a. In lieu of issuing a new registration plates 30 plate each registration year for a vehicle renewing 31 registration, the department may reassign the registration 32 plates plate previously issued to the vehicle and may adopt 33 and prescribe an annual validation sticker indicating payment 34 of annual registration fees. The department shall issue one 35 -8- LSB 5537XS (9) 83 dea/nh 8/ 52
S.F. 2211 validation sticker for each set of registration plates. The 1 sticker shall specify the month and year of expiration of the 2 registration plates plate . The sticker shall be displayed 3 only on the rear registration plate, except that the sticker 4 shall be displayed on the front registration plate of a truck 5 tractor. 6 b. The state department of transportation shall adopt rules 7 to provide for the placement of the motor vehicle registration 8 validation sticker. 9 3. Radio operators plates plate . The owner of an 10 automobile, motorcycle, trailer, or motor truck who holds an 11 amateur radio license issued by the federal communications 12 commission may, upon written application to the county 13 treasurer accompanied by a fee of five dollars, order 14 a special registration plates plate bearing the call letters 15 authorized the radio station covered by the person’s amateur 16 radio license. When received by the county treasurer, 17 such the special registration plates plate shall be 18 issued to the applicant in exchange for the registration 19 plates plate previously issued to the person. Not more than 20 one set of special registration plates plate may be issued to 21 an applicant. Said The fee shall be in addition to and not 22 in lieu of the fee for a regular registration plates plate . 23 Special A special registration plates plate must be surrendered 24 upon expiration of the owner’s amateur radio license and 25 the owner shall thereupon then be entitled to the owner’s 26 regular registration plates plate . The county treasurer shall 27 validate a special plates plate in the same manner as a regular 28 registration plates plate , upon payment of five dollars in 29 addition to the regular annual registration fee. 30 4. Multiyear plates plate . In lieu of issuing an annual 31 registration plates plate for trailers, semitrailers, motor 32 trucks, and truck tractors, the department may issue a 33 multiyear registration plate for a three-year period or a 34 permanent registration plate for trailers and semitrailers 35 -9- LSB 5537XS (9) 83 dea/nh 9/ 52
S.F. 2211 licensed under chapter 326, and a permanent registration 1 plate for motor trucks and truck tractors licensed under 2 chapter 326, upon payment of the appropriate registration fee. 3 Payment of fees for trailers and semitrailers for a permanent 4 registration plate shall, at the option of the registrant, 5 be made at five-year intervals or on an annual basis. Fees 6 from three-year and five-year payments shall not be reduced or 7 prorated. Payment of fees for motor trucks and truck tractors 8 shall be made on an annual basis. 9 5. Personalized registration plates plate . 10 a. Upon application and the payment of a fee of twenty-five 11 dollars, the director may issue to the owner of a motor 12 vehicle registered in this state or a trailer or travel 13 trailer registered in this state, a personalized registration 14 plates plate marked with up to seven initials, letters, 15 or combination of numerals and letters requested by the 16 owner. However, a personalized registration plates plate for 17 motorcycles and motorized bicycles shall be marked with no 18 more than six initials, letters, or combinations of numerals 19 and letters. Upon receipt of the personalized registration 20 plates plate , the applicant shall surrender the regular 21 registration plates plate to the county treasurer. The fee for 22 issuance of the personalized registration plates plate shall be 23 in addition to the regular annual registration fee. 24 b. The county treasurer shall validate a personalized 25 registration plates plate in the same manner as a regular 26 registration plates are plate is validated under this section 27 at an annual fee of five dollars in addition to the regular 28 annual registration fee. A person renewing a personalized 29 registration plate within one month following the time 30 requirements under section 321.40 may renew the personalized 31 plate without paying the additional registration fee under 32 paragraph “a” but shall pay the five-dollar fee in addition to 33 the regular annual registration fee and any penalties subject 34 to regular registration plate holders for late renewal. 35 -10- LSB 5537XS (9) 83 dea/nh 10/ 52
S.F. 2211 c. The fees collected by the director under this subsection 1 shall be paid to the treasurer of state and credited by the 2 treasurer of state as provided in section 321.145. 3 6. Sample vehicle registration plates plate . Vehicle A 4 vehicle registration plates plate displaying the general design 5 of a regular registration plates plate , with the word “sample” 6 displayed on the plate, may be furnished to any person upon 7 payment of a fee of three dollars, except that such plates may 8 be furnished to governmental agencies without cost. Sample A 9 sample registration plates plate shall not be attached to a 10 vehicle moved on the highways of this state. 11 7. Collegiate plates plate . 12 a. Upon application and payment of the proper fees, the 13 director may issue to the owner of a motor vehicle subject 14 to registration under section 321.109, subsection 1, motor 15 truck, motor home, multipurpose vehicle, trailer over two 16 thousand pounds, or travel trailer registered in this state, 17 a collegiate registration plates plate created pursuant to 18 this subsection. Upon receipt of the collegiate registration 19 plates plate , the applicant shall surrender the regular 20 registration plates plate to the county treasurer. 21 b. Collegiate A collegiate registration plates plate shall 22 be designed for each of the three state universities. The 23 collegiate registration plates shall be designated as follows: 24 (1) The letters “ISU” followed by a four-digit number all 25 in cardinal on a gold background for Iowa state university of 26 science and technology. 27 (2) The letters “UNI” followed by a four-digit number all 28 in purple on a gold background for the university of northern 29 Iowa. 30 (3) The letters “UI” followed by a four-digit number all in 31 black on a gold background for the state university of Iowa. 32 (4) In lieu of the letter-number designation provided under 33 subparagraphs (1) through (3), the collegiate registration 34 plates may be designated in the manner provided for 35 -11- LSB 5537XS (9) 83 dea/nh 11/ 52
S.F. 2211 personalized registration plates under subsection 5, paragraph 1 “a” , in the colors designated for the respective universities 2 under subparagraphs (1) through (3). 3 c. (1) The fees for a collegiate registration plate are as 4 follows: 5 (a) A registration fee of twenty-five dollars. 6 (b) A special collegiate registration fee of twenty-five 7 dollars. 8 (2) These fees are in addition to the regular annual 9 registration fee. The fees collected by the director under 10 this subsection shall be paid monthly to the treasurer of 11 state and deposited in the road use tax fund. The treasurer 12 of state shall credit monthly from the statutory allocations 13 fund created under section 321.145, subsection 2, to Iowa 14 state university of science and technology, the university of 15 northern Iowa, and the state university of Iowa respectively, 16 the amount of the special collegiate registration fees 17 collected in the previous month for collegiate registration 18 plates designed for the university. The moneys credited are 19 appropriated to the respective universities to be used for 20 scholarships for students attending the universities. 21 d. The county treasurer shall validate a collegiate 22 registration plates plate in the same manner as a regular 23 registration plates are plate is validated under this section 24 at an annual fee of five dollars in addition to the regular 25 annual registration fee. 26 e. A collegiate registration plate shall not be issued 27 if its combination of alphanumeric characters are identical 28 to those contained on a current personalized registration 29 plate issued under subsection 5. However, the owner of 30 a motor vehicle who has a personalized registration plate 31 issued for the motor vehicle may, after proper application 32 and payment of fees, be issued a collegiate registration 33 plate containing the same alphanumeric characters as those 34 on the personalized plate. S.F. 2211 registration plates plate , the owner shall surrender the 1 personalized registration plates plate to the county treasurer. 2 7A. Collegiate plates —— Private four-year colleges and 3 universities. 4 a. Upon application by a private four-year college or 5 university located in this state and payment of the initial 6 set-up costs for establishing the collegiate plate, the 7 department, in consultation with the college or university, may 8 design a special collegiate registration plate displaying the 9 colors associated with the college or university. 10 b. Upon application and payment of the proper fees, the 11 director may issue to the owner of a motor vehicle subject 12 to registration under section 321.109, subsection 1, motor 13 truck, motor home, multipurpose vehicle, trailer over two 14 thousand pounds, or travel trailer registered in this state, 15 a collegiate registration plates plate created pursuant to 16 this subsection. The fee for the issuance of a collegiate 17 registration plates plate is twenty-five dollars, which fee 18 is in addition to the regular annual registration fee for the 19 vehicle. An applicant may obtain a personalized collegiate 20 registration plate upon payment of the additional fee for a 21 personalized plate as provided in subsection 5 in addition to 22 the collegiate plate fee and the regular registration fee. 23 The county treasurer shall validate a collegiate registration 24 plates plate issued under this subsection in the same manner 25 as a regular registration plates plate , upon payment of five 26 dollars in addition to the regular annual registration fee. 27 Upon receipt of the collegiate registration plates plate , 28 the applicant shall surrender the regular registration 29 plates plate to the county treasurer. 30 c. A personalized collegiate registration plate shall 31 not be issued if its combination of alphanumeric characters 32 are identical to those contained on a current personalized 33 registration plate issued under subsection 5. However, the 34 owner of a motor vehicle who has a personalized registration 35 -13- LSB 5537XS (9) 83 dea/nh 13/ 52
S.F. 2211 plate issued for the motor vehicle may, after proper 1 application and payment of fees, be issued a collegiate 2 registration plate containing the same alphanumeric characters 3 as those on the personalized plate. Upon receipt of the 4 collegiate registration plates plate , the owner shall surrender 5 the personalized registration plates plate to the county 6 treasurer. 7 8. Medal of honor plates plate . 8 a. The owner of a motor vehicle subject to registration 9 under section 321.109, subsection 1, motorcycle, trailer, 10 or motor truck who has been awarded the medal of honor may, 11 upon written application to the department, order a special 12 registration plates plate which shall be red, white, and blue 13 in color and shall bear an emblem of the medal of honor and 14 an identifying number. Each applicant applying for a special 15 registration plates plate under this subsection may order only 16 one set of registration plates plate under this subsection. 17 The application is subject to approval by the department and 18 the special registration plates plate shall be issued at no 19 charge to the applicant in exchange for the registration 20 plates plate previously issued to the person. A person who 21 is issued a special plates plate under this subsection is 22 exempt from payment of any annual registration fee for the 23 motor vehicle bearing the special plates plate . The department 24 shall validate the special plates plate in the same manner as 25 a regular registration plates are plate is validated under this 26 section. The department shall not issue a special registration 27 plates plate until service organizations in the state have 28 furnished the department either the special dies or the cost of 29 the special dies necessary for the manufacture of the special 30 registration plate. 31 b. The surviving spouse of a person who was issued a special 32 plates plate under this subsection may continue to use the 33 special plates plate subject to registration of the special 34 plates plate in the surviving spouse’s name. S.F. 2211 spouse remarries, the surviving spouse shall return the special 1 plates plate to the department and the department shall issue 2 a regular registration plates plate to the surviving spouse. 3 8A. Ex-prisoner of war special plates plate . 4 a. The owner of a motor vehicle subject to registration 5 under section 321.109, subsection 1, motorcycle, trailer, or 6 motor truck who was a prisoner of war during a time of military 7 conflict may, upon written application to the department, 8 order only one set of special registration plates plate with 9 an ex-prisoner of war processed emblem. The emblem shall be 10 designed by the department in cooperation with the adjutant 11 general and shall signify that the owner was a prisoner of war 12 as described in this subsection. The application is subject to 13 approval by the department, in consultation with the adjutant 14 general. The special plates plate shall be issued at no charge 15 and are is subject to an annual registration fee of fifteen 16 dollars. The county treasurer shall validate the special 17 plates plate in the same manner as a regular registration 18 plates are plate is validated under this section. 19 b. The surviving spouse of a person who was issued a special 20 plates plate under this subsection may continue to use or apply 21 for and use the special plates plate subject to registration 22 of the special plates plate in the surviving spouse’s name and 23 upon payment of the annual registration fee. If the surviving 24 spouse remarries, the surviving spouse shall return the special 25 plates plate to the department and the department shall issue 26 a regular registration plates plate to the surviving spouse. 27 9. Leased vehicles. Registration plates A registration 28 plate under this section, including a disabled veteran 29 plates plate specified in section 321.105, may be issued to 30 the lessee of a motor vehicle if the lessee provides evidence 31 of a lease for a period of more than sixty days and if the 32 lessee complies with the requirements, under this section, for 33 issuance of the specific registration plates plate . 34 10. Fire fighter plates plate . 35 -15- LSB 5537XS (9) 83 dea/nh 15/ 52

An owner referred to in subsection 12 who is a current 1 or retired member of a paid or volunteer fire department may, 2 upon written application to the department, order a special 3 registration plates plate , designed by the department in 4 cooperation with representatives designated by the Iowa fire 5 fighters’ associations, which signify signifies that the 6 applicant is a current or retired member of a paid or volunteer 7 fire department. 8 b. The application shall be approved by the department 9 in consultation with representatives designated by the Iowa 10 fire fighters’ associations, and the special registration 11 plates plate shall be issued to the applicant in exchange 12 for the registration plates plate previously issued to the 13 person. The fee for the special plates plate is twenty-five 14 dollars which shall be paid in addition to the regular annual 15 registration fee. The department shall validate the special 16 plates plate in the same manner as a regular registration 17 plates are plate is validated under this section at the regular 18 annual registration fee. 19 c. The special fees collected by the director under this 20 subsection shall be paid monthly to the treasurer of state and 21 deposited in the road use tax fund. The treasurer of state 22 shall transfer monthly from the statutory allocations fund 23 created under section 321.145, subsection 2, to the Paul Ryan 24 memorial fire fighter safety training fund created pursuant to 25 section 100B.12 the amount of the special fees collected in the 26 previous month for the fire fighter plates. 27 d. For purposes of this subsection, a person is considered 28 to be retired if the person is recognized by the chief of the 29 fire department where the individual served, and on record, 30 as officially retired from the fire department. Special A 31 special registration plates plate with a fire fighter emblem 32 shall be surrendered, as provided in subsection 12, in exchange 33 for a regular registration plates plate upon termination of 34 the motor vehicle owner’s membership in the paid or volunteer 35 -16- LSB 5537XS (9) 83 dea/nh 16/ 52
S.F. 2211 fire department, unless the person is a retired member in good 1 standing. 2 10A. Emergency medical services plates plate . 3 a. The owner of a motor vehicle referred to in subsection 4 12 who is a current member of a paid or volunteer emergency 5 medical services agency may, upon written application to 6 the department, order a special registration plates plate , 7 designed by the department in cooperation with representatives 8 designated by the Iowa emergency medical services association, 9 which plates signify plate signifies that the applicant is 10 a current member of a paid or volunteer emergency medical 11 services agency. The application shall be approved by the 12 department, in consultation with representatives designated 13 by the Iowa emergency medical services association, 14 and the special registration plates plate shall be 15 issued to the applicant in exchange for the registration 16 plates plate previously issued to the person. The fee for 17 the special plates plate is twenty-five dollars which is 18 in addition to the regular annual registration fee. The 19 department shall validate the special plates plate in the same 20 manner as a regular registration plates are plate is validated 21 under this section at the regular annual registration fee. 22 b. The special fees collected by the director under this 23 subsection shall be paid monthly to the treasurer of state and 24 deposited in the road use tax fund. The treasurer of state 25 shall transfer monthly from the statutory allocations fund 26 created under section 321.145, subsection 2, to the emergency 27 medical services fund created in section 135.25 the amount of 28 the special fees collected in the previous month for issuance 29 of emergency medical services plates. 30 11. Natural resources plates plate . 31 a. Upon application and payment of the proper fees, the 32 director may issue a natural resources plates plate to the 33 owner of a motor vehicle subject to registration under section 34 321.109, subsection 1, motor truck, motor home, multipurpose 35 -17- LSB 5537XS (9) 83 dea/nh 17/ 52
S.F. 2211 vehicle, motorcycle, trailer, or travel trailer. 1 b. Natural resources plates shall be designed by the 2 department in cooperation with the department of natural 3 resources which design shall include on the plate the name of 4 the county where the vehicle is registered. 5 c. (1) The special natural resources fee for 6 a letter-number designated natural resources plates plate is 7 forty-five dollars. The fee for a personalized natural 8 resources plates plate is forty-five dollars which shall be 9 paid in addition to the special natural resources fee of 10 forty-five dollars. The fees collected by the director under 11 this subsection shall be paid monthly to the treasurer of 12 state and deposited in the road use tax fund. The treasurer 13 of state shall credit monthly from the statutory allocations 14 fund created under section 321.145, subsection 2, to the Iowa 15 resources enhancement and protection fund created pursuant to 16 section 455A.18, the amount of the special natural resources 17 fees collected in the previous month for the natural resources 18 plates. 19 (2) From the moneys credited to the Iowa resources 20 enhancement and protection fund under subparagraph (1), ten 21 dollars of the fee collected for each natural resources plate 22 issued, and fifteen dollars from each renewal fee, shall be 23 allocated to the department of natural resources wildlife 24 bureau to be used for nongame wildlife programs. 25 d. Upon receipt of the special registration plates plate , 26 the applicant shall surrender the current registration 27 plates plate to the county treasurer. The county treasurer 28 shall validate the special registration plates plate in 29 the same manner as a regular registration plates are plate 30 is validated under this section. The annual special natural 31 resources fee for a letter-number designated plates plate is 32 twenty-five dollars which shall be paid in addition to 33 the regular annual registration fee. The annual fee for 34 a personalized natural resources plates plate is five dollars 35 -18- LSB 5537XS (9) 83 dea/nh 18/ 52
S.F. 2211 which shall be paid in addition to the annual special natural 1 resources fee and the regular annual registration fee. The 2 annual special natural resources fee shall be credited as 3 provided under paragraph “c” . 4 11A. Love our kids plates plate . 5 a. Upon application and payment of the proper fees, the 6 director may issue a “love our kids” plates plate to the owner 7 of a motor vehicle subject to registration under section 8 321.109, subsection 1, motor truck, motor home, multipurpose 9 vehicle, motorcycle, trailer, or travel trailer. 10 b. Love The love our kids plates plate shall be designed 11 by the department in cooperation with the Iowa department of 12 public health. 13 c. The special fee for a letter-number designated love 14 our kids plates plate is thirty-five dollars. The fee for 15 a personalized love our kids plates plate is twenty-five 16 dollars, which shall be paid in addition to the special love 17 our kids fee of thirty-five dollars. The fees collected by the 18 director under this subsection shall be paid monthly to the 19 treasurer of state and deposited in the road use tax fund. The 20 treasurer of state shall transfer monthly from the statutory 21 allocations fund created under section 321.145, subsection 22 2, to the Iowa department of public health the amount of the 23 special fees collected in the previous month for the love our 24 kids plates. Notwithstanding section 8.33, moneys transferred 25 under this subsection shall not revert to the general fund of 26 the state. 27 d. Upon receipt of the special registration plates plate , 28 the applicant shall surrender the current registration 29 plates plate to the county treasurer. The county treasurer 30 shall validate the special registration plates plate in 31 the same manner as a regular registration plates are plate 32 is validated under this section. The annual special love 33 our kids fee for a letter-number designated plates plate is 34 ten dollars, which shall be paid in addition to the regular 35 -19- LSB 5537XS (9) 83 dea/nh 19/ 52

The annual fee for a personalized 1 love our kids plates plate is five dollars, which shall be paid 2 in addition to the annual special love our kids fee and the 3 regular annual registration fee. The annual love our kids fee 4 shall be credited as provided under paragraph “c” . 5 11B. Motorcycle rider education plates plate . 6 a. Upon application and payment of the proper fees, 7 the director may issue a “motorcycle rider education” 8 plates plate to the owner of a motor vehicle subject to 9 registration under section 321.109, subsection 1, motor truck, 10 motor home, multipurpose vehicle, motorcycle, trailer, or 11 travel trailer. 12 b. Motorcycle The motorcycle rider education plates 13 plate shall be designed by the department. 14 c. The special fee for a letter-number designated motorcycle 15 rider education plates plate is thirty-five dollars. The fee 16 for a personalized motorcycle rider education plates plate is 17 twenty-five dollars, which shall be paid in addition to the 18 special motorcycle rider education fee of thirty-five dollars. 19 The fees collected by the director under this subsection shall 20 be paid monthly to the treasurer of state and deposited in 21 the road use tax fund. The treasurer of state shall transfer 22 monthly from the statutory allocations fund created under 23 section 321.145, subsection 2, to the department for use in 24 accordance with section 321.180B, subsection 6, the amount 25 of the special fees collected in the previous month for the 26 motorcycle rider education plates. 27 d. Upon receipt of the special registration plates plate , 28 the applicant shall surrender the current registration 29 plates plate to the county treasurer. The county treasurer 30 shall validate the special registration plates plate in 31 the same manner as a regular registration plates are plate 32 is validated under this section. The annual special 33 motorcycle rider education fee for a letter-number designated 34 plates plate is ten dollars, which shall be paid in addition 35 -20- LSB 5537XS (9) 83 dea/nh 20/ 52

The annual fee for 1 a personalized motorcycle rider education plates plate is 2 five dollars, which shall be paid in addition to the annual 3 special motorcycle rider education fee and the regular annual 4 registration fee. The annual motorcycle rider education fee 5 shall be credited as provided under paragraph “c” . 6 12. Special registration plates —— general provisions. 7 a. The owner of a motor vehicle subject to registration 8 pursuant to section 321.109, subsection 1, motor truck, motor 9 home, multipurpose vehicle, motorcycle, trailer, or travel 10 trailer may, upon written application to the department, order 11 a special registration plates plate with a distinguishing 12 processed emblem as authorized by this section or as approved 13 by the department. The fee for the issuance of a special 14 registration plates plate is twenty-five dollars for each 15 vehicle, unless otherwise provided by this section, which 16 fee is in addition to the regular annual registration fee. 17 The county treasurer shall validate a special registration 18 plates plate with a distinguishing processed emblem in the same 19 manner as a regular registration plates plate , upon payment of 20 five dollars in addition to the regular annual registration 21 fee. 22 b. Upon receipt of a special registration plate with a 23 distinguishing processed emblem as authorized by this section 24 or as approved by the department, the applicant shall surrender 25 the regular registration plates plate to the county treasurer. 26 An applicant no longer eligible for a special registration 27 plate shall surrender the special vehicle registration 28 plates plate to the county treasurer for issuance of a regular 29 registration plates plate . 30 c. An applicant may, upon payment of the additional fee 31 for a personalized plate as provided in subsection 5, obtain 32 a personalized special registration plate with a processed 33 emblem. Personalized plates authorized by this section with 34 the a processed emblem shall be limited to no more than five 35 -21- LSB 5537XS (9) 83 dea/nh 21/ 52
S.F. 2211 initials, letters, or combinations of numerals and letters. 1 d. A special registration plate issued for a motorcycle 2 or motorized bicycle under this section shall be designated 3 in the manner provided for a personalized registration 4 plates plate under subsection 5, paragraph “a” . 5 12A. Special registration plates —— armed forces services. 6 a. An owner of a vehicle referred to in subsection 7 12 who applies for any type of special registration 8 plates plate associated with service in the United States armed 9 forces shall be issued one set of the special registration 10 plates plate at no charge, but shall be subject to the annual 11 registration fee of fifteen dollars, if the owner is eligible 12 for, but has relinquished to the department or the county 13 treasurer or has not been issued, an ex-prisoner of war or 14 legion of merit special registration plates plate under this 15 section. 16 b. An owner of a vehicle referred to in subsection 17 12 who applies for any type of special registration 18 plates plate associated with service in the United States armed 19 forces shall be issued one set of the special registration 20 plates plate at no charge and subject to no annual registration 21 fee if the owner is eligible for, but has relinquished to the 22 department or the county treasurer or has not been issued, 23 a medal of honor registration plates plate under subsection 8 24 or a disabled veteran registration plates plate under section 25 321.105. 26 c. The owner shall provide the appropriate information 27 regarding the owner’s eligibility for any of the special 28 registration plates described in paragraph “a” or “b” , and 29 regarding the owner’s eligibility for the special registration 30 plates plate for which the owner has applied, as required by 31 the department. 32 d. The surviving spouse of a person who was issued a special 33 plates plate under this subsection may continue to use the 34 special plates plate subject to registration of the special 35 -22- LSB 5537XS (9) 83 dea/nh 22/ 52
S.F. 2211 plates plate in the surviving spouse’s name and upon payment 1 of the same annual registration fee, if applicable. If the 2 surviving spouse remarries, the surviving spouse shall return 3 the special plates plate to the department and the department 4 shall issue a regular registration plates plate to the 5 surviving spouse. 6 13. New special registration plates —— department review. 7 a. Any person may submit a request to the department to 8 recommend a new special registration plate with a processed 9 emblem. The request shall provide a proposed design for the 10 processed emblem, the purpose of the special registration plate 11 with the processed emblem, any eligibility requirements for 12 purchase or receipt of the special registration plate with the 13 processed emblem, and evidence there is sufficient interest 14 in the special registration plate with the processed emblem 15 to pay implementation costs. The department shall consider 16 the request and make a recommendation based upon criteria 17 established by the department which shall include consideration 18 of the information included in the request, the number of 19 special registration plates with processed emblems currently 20 authorized, and any other relevant factors. 21 b. If a request for a proposed special registration plate 22 with a processed emblem meets the criteria established by 23 the department, the department shall, in consultation with 24 the persons seeking the special registration plate with 25 the processed emblem, approve a recommended design for the 26 processed emblem, and propose eligibility requirements for the 27 special registration plate with the processed emblem. 28 c. The department shall adopt rules pursuant to chapter 17A 29 regarding the approval and issuance of special registration 30 plates. 31 d. A state agency may submit a request to the department 32 recommending a special registration plate. The alternate fee 33 for a letter-number designated plates plate is thirty-five 34 dollars with a ten dollar ten-dollar annual special renewal 35 -23- LSB 5537XS (9) 83 dea/nh 23/ 52

The fee for a personalized plates plate is twenty-five 1 dollars which is in addition to the alternative fee of 2 thirty-five dollars with an annual personalized plate renewal 3 fee of five dollars which is in addition to the special renewal 4 fee of ten dollars. The alternate fees are in addition to the 5 regular annual registration fee. The alternate fees collected 6 under this paragraph shall be paid monthly to the treasurer of 7 state and deposited in the road use tax fund. The treasurer 8 of state shall credit monthly from the statutory allocations 9 fund created under section 321.145, subsection 2, the amount of 10 the alternate fees collected in the previous month to the state 11 agency that recommended the special registration plate. 12 14. Persons with disabilities special plates plate . An owner 13 referred to in subsection 12 or an owner of a trailer used to 14 transport a wheelchair who is a person with a disability, or 15 who is the parent or guardian of a child who resides with the 16 parent or guardian owner and who is a person with a disability, 17 as defined in section 321L.1, may, upon written application to 18 the department, order a special registration plates plate with 19 a persons with disabilities processed emblem designed by the 20 department bearing the international symbol of accessibility. 21 The A special registration plates plate with a persons with 22 disabilities processed emblem shall only be issued if the 23 application is accompanied with a statement from a physician 24 licensed under chapter 148 or 149, a physician assistant 25 licensed under chapter 148C, an advanced registered nurse 26 practitioner licensed under chapter 152, or a chiropractor 27 licensed under chapter 151, written on the physician’s, 28 physician assistant’s, nurse practitioner’s, or chiropractor’s 29 stationery, stating the nature of the applicant’s or the 30 applicant’s child’s disability and such additional information 31 as required by rules adopted by the department, including proof 32 of residency of a child who is a person with a disability. If 33 the application is approved by the department, the a special 34 registration plates plate with a persons with disabilities 35 -24- LSB 5537XS (9) 83 dea/nh 24/ 52
S.F. 2211 processed emblem shall be issued to the applicant. There shall 1 be no fee in addition to the regular annual registration fee 2 for the a special registration plates plate with a persons with 3 disabilities processed emblem. The authorization for a special 4 registration plates plate with a persons with disabilities 5 processed emblem shall not be renewed without unless the 6 applicant furnishing furnishes evidence to the department 7 that the owner of the vehicle or the owner’s child is still 8 a person with a disability as defined in section 321L.1. An 9 owner who has a child who is a person with a disability shall 10 provide satisfactory evidence to the department that the child 11 with a disability continues to reside with the owner. The 12 registration plates plate with a persons with disabilities 13 processed emblem shall be surrendered in exchange for a regular 14 registration plates plate as provided in subsection 12 when the 15 owner of the vehicle or the owner’s child no longer qualifies 16 as a person with a disability as defined in section 321L.1 or 17 when the owner’s child who is a person with a disability no 18 longer resides with the owner. 19 15. Legion of merit special plates plate . 20 a. The owner of a motor vehicle subject to registration 21 under section 321.109, subsection 1, motorcycle, trailer, or 22 motor truck who has been awarded the legion of merit shall 23 be issued one set of special registration plates plate with 24 a legion of merit processed emblem, upon written application 25 to the department and presentation of satisfactory proof 26 of the award of the legion of merit as established by the 27 Congress of the United States. The emblem shall be designed 28 by the department in cooperation with the adjutant general and 29 shall signify that the owner was awarded the legion of merit. 30 The application is subject to approval by the department, 31 in consultation with the adjutant general. The special 32 plates plate shall be issued at no charge and are is subject 33 to an annual registration fee of fifteen dollars. The county 34 treasurer shall validate the special plates plate in the same 35 -25- LSB 5537XS (9) 83 dea/nh 25/ 52
S.F. 2211 manner as a regular registration plates are plate is validated 1 under this section. 2 b. The surviving spouse of a person who was issued a special 3 plates plate under this subsection may continue to use or apply 4 for and use the special plates plate subject to registration 5 of the special plates plate in the surviving spouse’s name and 6 upon payment of the annual registration fee. If the surviving 7 spouse remarries, the surviving spouse shall return the special 8 plates plate to the department and the department shall issue 9 a regular registration plates plate to the surviving spouse. 10 16. National guard special plates plate . 11 a. An owner referred to in subsection 12 who is a 12 member of the national guard, as defined in chapter 29A, 13 may, upon written application to the department, order 14 a special registration plates plate with a national guard 15 processed emblem with the emblem designed by the department in 16 cooperation with the adjutant general which emblem signifies 17 that the applicant is a member of the national guard. The 18 application shall be approved by the department in consultation 19 with the adjutant general. The special plate fees collected 20 by the director under subsection 12, paragraphs “a” and “c” , 21 from the issuance and annual validation of letter-number 22 designated and personalized national guard plates shall be paid 23 monthly to the treasurer of state and deposited in the road 24 use tax fund. The treasurer of state shall transfer monthly 25 from the statutory allocations fund created under section 26 321.145, subsection 2, to the veterans license fee fund created 27 in section 35A.11 the amount of the special fees collected 28 under subsection 12, paragraph “a” , in the previous month 29 for national guard plates. Special A special registration 30 plates plate with a national guard processed emblem shall be 31 surrendered, as provided in subsection 12, in exchange for 32 a regular registration plates plate upon termination of the 33 owner’s membership in the active national guard. 34 b. The surviving spouse of a person who was issued a special 35 -26- LSB 5537XS (9) 83 dea/nh 26/ 52
S.F. 2211 plates plate under this subsection may continue to use or apply 1 for and use the special plates plate subject to registration 2 of the special plates plate in the surviving spouse’s name 3 and upon payment of the annual five-dollar special plate fee 4 and the regular annual registration fee for the vehicle. If 5 the surviving spouse remarries, the surviving spouse shall 6 return the special plates plate to the department and the 7 department shall issue a regular registration plates plate to 8 the surviving spouse. 9 17. Pearl Harbor special plates plate . 10 a. An owner referred to in subsection 12 who was at Pearl 11 Harbor, Hawaii, as a member of the armed services of the United 12 States on December 7, 1941, may, upon written application to 13 the department, order a special registration plates plate with 14 a Pearl Harbor processed emblem. The emblem shall be designed 15 by the department in consultation with service organizations. 16 The application is subject to approval by the department. The 17 special plate fees collected by the director under subsection 18 12, paragraphs “a” and “c” , from the issuance and annual 19 validation of letter-number designated and personalized Pearl 20 Harbor plates shall be paid monthly to the treasurer of state 21 and deposited in the road use tax fund. The treasurer of state 22 shall transfer monthly from the statutory allocations fund 23 created under section 321.145, subsection 2, to the veterans 24 license fee fund created in section 35A.11 the amount of the 25 special fees collected under subsection 12, paragraph “a” , in 26 the previous month for Pearl Harbor plates. 27 b. The surviving spouse of a person who was issued a special 28 plates plate under this subsection may continue to use or apply 29 for and use the special plates plate subject to registration 30 of the special plates plate in the surviving spouse’s name 31 and upon payment of the annual five-dollar special plate fee 32 and the regular annual registration fee for the vehicle. If 33 the surviving spouse remarries, the surviving spouse shall 34 return the special plates plate to the department and the 35 -27- LSB 5537XS (9) 83 dea/nh 27/ 52
S.F. 2211 department shall issue a regular registration plates plate to 1 the surviving spouse. 2 18. Purple heart special plates plate . 3 a. An owner referred to in subsection 12 who was awarded 4 a purple heart medal by the United States government for 5 wounds received in military or naval combat against an armed 6 enemy of the United States may, upon written application to 7 the department and presentation of satisfactory proof of the 8 award of the purple heart medal, order a special registration 9 plates plate with a purple heart processed emblem. The design 10 of the emblem shall include a representation of a purple heart 11 medal and ribbon. The application is subject to approval by 12 the department in consultation with the adjutant general. The 13 special plate fees collected by the director under subsection 14 12, paragraphs “a” and “c” , from the issuance and annual 15 validation of letter-number designated and personalized purple 16 heart plates shall be paid monthly to the treasurer of state 17 and deposited in the road use tax fund. The treasurer of state 18 shall transfer monthly from the statutory allocations fund 19 created under section 321.145, subsection 2, to the veterans 20 license fee fund created in section 35A.11 the amount of the 21 special fees collected under subsection 12, paragraph “a” , in 22 the previous month for purple heart plates. 23 b. The surviving spouse of a person who was issued 24 a special plates plate under this subsection may continue to 25 use or apply for and use the special plates plate subject 26 to registration of the special plates plate in the surviving 27 spouse’s name and upon payment of the annual five-dollar 28 special plate fee and the regular annual registration fee for 29 the vehicle. If the surviving spouse remarries, the surviving 30 spouse shall return the special plates plate to the department 31 and the department shall issue a regular registration 32 plates plate to the surviving spouse. 33 19. United States armed forces retired special plates plate . 34 a. An owner referred to in subsection 12 who is a retired 35 -28- LSB 5537XS (9) 83 dea/nh 28/ 52
S.F. 2211 member of the United States armed forces may, upon written 1 application to the department and upon presentation of 2 satisfactory proof of membership, order a special registration 3 plates plate with a United States armed forces retired 4 processed emblem. The emblem shall be designed by the 5 department in consultation with service organizations. The 6 application is subject to approval by the department. For 7 purposes of this subsection, a person is considered to be 8 retired if the person is recognized by the United States armed 9 forces as retired from the United States armed forces. The 10 special plate fees collected by the director under subsection 11 12, paragraphs “a” and “c” , from the issuance and annual 12 validation of letter-number designated and personalized armed 13 forces retired plates shall be paid monthly to the treasurer 14 of state and deposited in the road use tax fund. The treasurer 15 of state shall transfer monthly from the statutory allocations 16 fund created under section 321.145, subsection 2, to the 17 veterans license fee fund created in section 35A.11 the amount 18 of the special fees collected under subsection 12, paragraph 19 “a” , in the previous month for armed forces retired plates. 20 b. The surviving spouse of a person who was issued a special 21 plates plate under this subsection may continue to use or apply 22 for and use the special plates plate subject to registration 23 of the special plates plate in the surviving spouse’s name 24 and upon payment of the annual five-dollar special plate fee 25 and the regular annual registration fee for the vehicle. If 26 the surviving spouse remarries, the surviving spouse shall 27 return the special plates plate to the department and the 28 department shall issue a regular registration plates plate to 29 the surviving spouse. 30 20. Silver or bronze star plates plate . 31 a. An owner referred to in subsection 12 who was awarded a 32 silver or a bronze star by the United States government, may, 33 upon written application to the department and presentation of 34 satisfactory proof of the award of the silver or bronze star, 35 -29- LSB 5537XS (9) 83 dea/nh 29/ 52
S.F. 2211 order a special registration plates plate with a silver or 1 bronze star processed emblem. The emblem shall be designed by 2 the department in consultation with the adjutant general. The 3 special plate fees collected by the director under subsection 4 12, paragraphs “a” and “c” , from the issuance and annual 5 validation of letter-number designated and personalized silver 6 star and bronze star plates shall be paid monthly to the 7 treasurer of state and deposited in the road use tax fund. The 8 treasurer of state shall transfer monthly from the statutory 9 allocations fund created under section 321.145, subsection 2, 10 to the veterans license fee fund created in section 35A.11 11 the amount of the special fees collected under subsection 12, 12 paragraph “a” , in the previous month for silver star and bronze 13 star plates. 14 b. The surviving spouse of a person who was issued a special 15 plates plate under this subsection may continue to use or apply 16 for and use the special plates plate subject to registration 17 of the special plates plate in the surviving spouse’s name 18 and upon payment of the annual five-dollar special plate fee 19 and the regular annual registration fee for the vehicle. If 20 the surviving spouse remarries, the surviving spouse shall 21 return the special plates plate to the department and the 22 department shall issue a regular registration plates plate to 23 the surviving spouse. 24 20A. Distinguished service, navy, or air force cross 25 plates plate . 26 a. An owner referred to in subsection 12 who was 27 awarded a distinguished service cross, a navy cross, or an 28 air force cross by the United States government may, upon 29 written application to the department and presentation of 30 satisfactory proof of the award, order a special registration 31 plates plate with a distinguished service cross, navy cross, or 32 air force cross processed emblem. The emblem shall be designed 33 by the department in consultation with the adjutant general. 34 The special plate fees collected by the director under 35 -30- LSB 5537XS (9) 83 dea/nh 30/ 52
S.F. 2211 subsection 12, paragraphs “a” and “c” , from the issuance and 1 annual validation of letter-number designated and personalized 2 distinguished service cross, navy cross, and air force cross 3 plates shall be paid monthly to the treasurer of state and 4 deposited in the road use tax fund. The treasurer of state 5 shall transfer monthly from the statutory allocations fund 6 created under section 321.145, subsection 2, to the veterans 7 license fee fund created in section 35A.11 the amount of the 8 special fees collected under subsection 12, paragraph “a” , in 9 the previous month for distinguished service cross, navy cross, 10 and air force cross plates. 11 b. The surviving spouse of a person who was issued a special 12 plates plate under this subsection may continue to use or apply 13 for and use the special plates plate subject to registration 14 of the special plates plate in the surviving spouse’s name 15 and upon payment of the annual five-dollar special plate fee 16 and the regular annual registration fee for the vehicle. If 17 the surviving spouse remarries, the surviving spouse shall 18 return the special plates plate to the department and the 19 department shall issue a regular registration plates plate to 20 the surviving spouse. 21 20B. Soldier’s, navy and marine corps, or airman’s medal 22 plates plate . 23 a. An owner referred to in subsection 12 who was awarded 24 a soldier’s medal, a navy and marine corps medal, or an 25 airman’s medal by the United States government may, upon 26 written application to the department and presentation of 27 satisfactory proof of the award, order a special registration 28 plates plate with a soldier’s medal, navy and marine corps 29 medal, or airman’s medal processed emblem. The emblem 30 shall be designed by the department in consultation with the 31 adjutant general. The special plate fees collected by the 32 director under subsection 12, paragraphs “a” and “c” , from the 33 issuance and annual validation of letter-number designated and 34 personalized soldier’s medal, navy and marine corps medal, and 35 -31- LSB 5537XS (9) 83 dea/nh 31/ 52
S.F. 2211 airman’s medal plates shall be paid monthly to the treasurer 1 of state and deposited in the road use tax fund. The treasurer 2 of state shall transfer monthly from the statutory allocations 3 fund created under section 321.145, subsection 2, to the 4 veterans license fee fund created in section 35A.11 the amount 5 of the special fees collected under subsection 12, paragraph 6 “a” , in the previous month for soldier’s medal, navy and marine 7 corps medal, and airman’s medal plates. 8 b. The surviving spouse of a person who was issued a special 9 plates plate under this subsection may continue to use or apply 10 for and use the special plates plate subject to registration 11 of the special plates plate in the surviving spouse’s name 12 and upon payment of the annual five-dollar special plate fee 13 and the regular annual registration fee for the vehicle. If 14 the surviving spouse remarries, the surviving spouse shall 15 return the special plates plate to the department and the 16 department shall issue a regular registration plates plate to 17 the surviving spouse. 18 21. Iowa heritage special plates plate . 19 a. An owner referred to in subsection 12 may, upon written 20 application to the department, order a special registration 21 plates plate with an Iowa heritage emblem. The emblem shall 22 contain a picture of the American gothic house and the words 23 “Iowa Heritage” and shall be designed by the department in 24 consultation with the state historical society of Iowa. 25 b. The special Iowa heritage fee for a letter-number 26 designated plates plate is thirty-five dollars. The 27 special fee for a personalized Iowa heritage plates plate is 28 twenty-five dollars which shall be paid in addition to the 29 special fee of thirty-five dollars. The annual special Iowa 30 heritage fee is ten dollars for a letter-number designated 31 registration plates plate and is fifteen dollars for 32 a personalized registration plates plate which shall be paid in 33 addition to the regular annual registration fee. 34 c. The special fees collected by the director under this 35 -32- LSB 5537XS (9) 83 dea/nh 32/ 52
S.F. 2211 subsection shall be paid monthly to the treasurer of state 1 and deposited in the road use tax fund. The treasurer of 2 state shall credit monthly from the statutory allocations 3 fund created under section 321.145, subsection 2, to the Iowa 4 heritage fund created under section 303.9A the amount of the 5 special fees collected in the previous month for the Iowa 6 heritage plates. 7 22. Education plates plate . 8 a. An owner referred to in subsection 12, upon written 9 application to the department, may order a special registration 10 plates plate with an education emblem. The education emblem 11 shall be designed by the department in cooperation with the 12 department of education. 13 b. The special school transportation fee for a letter-number 14 designated education plates plate is thirty-five dollars. The 15 fee for a personalized education plates plate is twenty-five 16 dollars, which shall be paid in addition to the special school 17 transportation fee of thirty-five dollars. The annual special 18 school transportation fee is ten dollars for a letter-number 19 designated registration plates plate and is fifteen dollars for 20 a personalized registration plates plate which shall be paid 21 in addition to the regular annual registration fee. The fees 22 collected by the director under this subsection shall be paid 23 monthly to the treasurer of state and deposited in the road 24 use tax fund. The treasurer of state shall transfer monthly 25 from the statutory allocations fund created under section 26 321.145, subsection 2, to the school budget review committee 27 in accordance with section 257.31, subsection 17, the amount 28 of the special school transportation fees collected in the 29 previous month for the education plates. 30 23. Breast cancer awareness plates plate . 31 a. Upon application and payment of the proper fees, the 32 director may issue a breast cancer awareness plates plate to an 33 owner of a motor vehicle referred to in subsection 12. 34 b. Breast The breast cancer awareness plates plate shall 35 -33- LSB 5537XS (9) 83 dea/nh 33/ 52
S.F. 2211 contain an image of a pink ribbon and shall be designed by the 1 department in consultation with the Susan G. Komen foundation. 2 c. The special fee for a letter-number designated breast 3 cancer awareness plates plate is thirty-five dollars. The fee 4 for a personalized breast cancer awareness plates plate is 5 twenty-five dollars, which shall be paid in addition to the 6 special breast cancer awareness fee of thirty-five dollars. 7 The fees collected by the director under this subsection shall 8 be paid monthly to the treasurer of state and deposited in 9 the road use tax fund. The treasurer of state shall transfer 10 monthly from the statutory allocations fund created under 11 section 321.145, subsection 2, to the Iowa department of public 12 health the amount of the special fees collected in the previous 13 month for the breast cancer awareness plates and such funds 14 are appropriated to the Iowa department of public health. The 15 Iowa department of public health shall distribute one hundred 16 percent of the funds received monthly in the form of grants to 17 support breast cancer screenings for both men and women who 18 meet eligibility requirements like those established by the 19 Susan G. Komen foundation. In the awarding of grants, the Iowa 20 department of public health shall give first consideration 21 to affiliates of the Susan G. Komen foundation and similar 22 nonprofit organizations providing for breast cancer screenings 23 at no cost in Iowa. Notwithstanding section 8.33, moneys 24 transferred under this subsection shall not revert to the 25 general fund of the state. 26 d. Upon receipt of the special registration plates plate , 27 the applicant shall surrender the current registration 28 plates plate to the county treasurer. The county treasurer 29 shall validate the special registration plates plate in 30 the same manner as a regular registration plates are plate 31 is validated under this section. The annual special 32 breast cancer awareness fee for a letter-number designated 33 plates plate is ten dollars, which shall be paid in addition to 34 the regular annual registration fee. The annual special fee 35 -34- LSB 5537XS (9) 83 dea/nh 34/ 52
S.F. 2211 for a personalized breast cancer awareness plates plate is five 1 dollars, which shall be paid in addition to the annual special 2 breast cancer awareness fee and the regular annual registration 3 fee. The annual special breast cancer awareness fee shall be 4 credited and transferred as provided under paragraph “c” . 5 24. Gold star plates plate . 6 a. An owner referred to in subsection 12 who is the 7 surviving spouse, parent, child, or sibling of a deceased 8 member of the United States armed forces who died while serving 9 on active duty during a time of military conflict or who died 10 as a result of such service may order a special registration 11 plates plate bearing a gold star emblem upon written 12 application to the department accompanied by satisfactory 13 supporting documentation as determined by the department. 14 The gold star emblem shall be designed by the department in 15 cooperation with the commission of veterans affairs. The 16 special plate fees collected by the director under subsection 17 12, paragraphs “a” and “c” , from the issuance and annual 18 validation of letter-number designated and personalized gold 19 star plates shall be paid monthly to the treasurer of state and 20 deposited in the road use tax fund. The treasurer of state 21 shall transfer monthly from the statutory allocations fund 22 created under section 321.145, subsection 2, to the veterans 23 license fee fund created in section 35A.11 the amount of the 24 special fees collected under subsection 12, paragraph “a” , in 25 the previous month for gold star plates. 26 Sec. 14. Section 321.37, Code 2009, is amended to read as 27 follows: 28 321.37 Display of plates registration plate . 29 1. Registration plates A registration plate issued for a 30 motor vehicle other than a motorcycle, motorized bicycle or 31 a truck tractor shall be attached to the rear of the motor 32 vehicle , one in the front and the other in the rear . The 33 registration plate issued for a motorcycle or other vehicle 34 required to be registered hereunder shall be attached to the 35 -35- LSB 5537XS (9) 83 dea/nh 35/ 52
S.F. 2211 rear of the vehicle. The registration plate issued for a truck 1 tractor shall be attached to the front of the truck tractor. 2 The special plate issued to a dealer shall be attached on the 3 rear of the vehicle when operated on the highways of this 4 state. 5 2. Registration plates issued for a motor vehicle which 6 is model year 1948 or older, and reconstructed or specially 7 constructed vehicles built to resemble a model year 1948 8 vehicle or older, other than a truck registered for more than 9 five tons, motorcycle, or truck tractor, may display one 10 registration plate on the rear of the vehicle if the other 11 registration plate issued to the vehicle is carried in the 12 vehicle at all times when the vehicle is operated on a public 13 highway. 14 3. 2. It is unlawful for the owner of a vehicle to place 15 any frame around or over the registration plate which does not 16 permit full view of all numerals and letters printed on the 17 registration plate. 18 Sec. 15. Section 321.38, Code 2009, is amended to read as 19 follows: 20 321.38 Plates, method Method of attaching plates —— 21 imitations imitation plates prohibited. 22 Every A registration plate shall at all times be securely 23 fastened in a horizontal position to the vehicle for which 24 it is issued so as to prevent the plate from swinging and 25 at a height of not less than twelve inches from the ground, 26 measuring from the bottom of the plate, in a place and position 27 to be clearly visible and shall be maintained free from 28 foreign materials and in a condition to be clearly legible. An 29 imitation plate or plates a plate imitating or purporting to 30 imitate the official registration plate of any other state or 31 territory of the United States or of any foreign government 32 shall not be fastened to the vehicle. 33 Sec. 16. Section 321.41, subsection 3, Code 2009, is amended 34 to read as follows: 35 -36- LSB 5537XS (9) 83 dea/nh 36/ 52

A person who has registered a vehicle in a county, 1 other than the county designated on the vehicle registration 2 plate, may apply to the county treasurer where the vehicle is 3 registered for a new registration plates plate upon payment 4 of a fee of five dollars and the return of the former county 5 registration plates plate . 6 Sec. 17. Section 321.42, subsection 1, Code 2009, is amended 7 to read as follows: 8 1. If a registration card , or plate , or pair of plates is 9 lost or becomes illegible, the owner shall immediately apply 10 for replacement. The fee for a replacement registration 11 card is three dollars. The fee for a replacement plate or 12 pair of plates other than a replacement of a special plate 13 issued pursuant to section 321.60 is five dollars. The 14 fee for replacement of a special plate issued pursuant to 15 section 321.60 is forty dollars. When the owner has furnished 16 information required by the department and paid the proper fee, 17 a duplicate, substitute, or new registration card , or plate , 18 or pair of plates may be issued. The county treasurer or the 19 department may waive the fee for a replacement plate if the 20 plate is lost during a documented accident. 21 Sec. 18. Section 321.46, subsection 7, Code 2009, is amended 22 to read as follows: 23 7. If a motor vehicle is leased and the lessee purchases 24 the vehicle upon termination of the lease, the lessor shall, 25 upon claim by the lessee with the lessor within thirty days of 26 the purchase, assign the annual registration fee credit and 27 registration plates plate for the leased motor vehicle to the 28 lessee. Credit shall be applied as provided in subsection 3. 29 Sec. 19. Section 321.47, subsection 3, Code 2009, is amended 30 to read as follows: 31 3. Whenever ownership of a vehicle is transferred under the 32 provisions of this section the registration plates plate shall 33 be removed and forwarded to the county treasurer of the county 34 where the vehicle is registered or to the department if the 35 -37- LSB 5537XS (9) 83 dea/nh 37/ 52
S.F. 2211 vehicle is owned by a nonresident. Upon transfer the vehicle 1 shall not be operated upon the highways of this state until the 2 person entitled to possession of the vehicle applies for and 3 obtains registration for the vehicle. 4 Sec. 20. Section 321.52, subsection 1, Code Supplement 5 2009, is amended to read as follows: 6 1. When a vehicle is sold outside the state for purposes 7 other than for junk, the owner, dealer , or otherwise, shall 8 detach the registration plates plate and registration card and 9 shall indicate on the registration card the name and address 10 of the foreign purchaser or transferee over the person’s 11 signature. Unless the registration plates are plate is legally 12 attached to another vehicle, the owner shall surrender 13 the registration plates plate and registration card to the 14 county treasurer, who shall cancel the records, destroy the 15 registration plates plate , and forward the registration card 16 to the department. The department shall make a notation on 17 the records of the out-of-state sale and, after a reasonable 18 period, may destroy the files for that particular vehicle. 19 The department is not authorized to make a refund of annual 20 registration fees on a vehicle sold out of state unless it 21 receives the registration card completed as provided in this 22 section. 23 Sec. 21. Section 321.52, subsection 3, paragraphs a and b, 24 Code Supplement 2009, are amended to read as follows: 25 a. When a vehicle for which a certificate of title is issued 26 is junked or dismantled by the owner, the owner shall detach 27 the registration plates plate and surrender the plates plate to 28 the county treasurer, unless the plates are plate is properly 29 assigned to another vehicle. The owner shall also surrender 30 the certificate of title to the county treasurer. 31 b. Upon the surrender of the certificate of title and 32 application for junking certificate, the county treasurer shall 33 issue to the person, without fee, a junking certificate, which 34 shall authorize the holder to possess, transport, or transfer 35 -38- LSB 5537XS (9) 83 dea/nh 38/ 52
S.F. 2211 ownership of the junked vehicle by endorsement of the junking 1 certificate. The county treasurer shall hold the surrendered 2 certificate of title, registration receipt, application for 3 junking certificate, and, if applicable, the registration 4 plates plate for a period of fourteen days following the 5 issuance of a junking certificate under this subsection. 6 Sec. 22. Section 321.57, subsection 3, Code 2009, is amended 7 to read as follows: 8 3. Also , a transporter may operate or move any vehicle 9 of like type upon the highways solely for the purpose of 10 delivery upon likewise displaying thereon on the vehicle a like 11 plates plate issued to the transporter as provided in these 12 sections. 13 Sec. 23. Section 321.89, subsection 1, paragraph a, 14 subparagraph (1), Code Supplement 2009, is amended to read as 15 follows: 16 (1) A vehicle that has been left unattended on public 17 property for more than twenty-four hours and lacks a current 18 registration plates plate or two or more wheels or other parts 19 which renders the vehicle totally inoperable. 20 Sec. 24. Section 321.96, Code 2009, is amended to read as 21 follows: 22 321.96 Prohibited plates —— certificates. 23 A person shall not display or cause or permit to be 24 displayed, or have in the person’s possession, a vehicle 25 identification number or component part number except as 26 provided in this chapter, or a canceled, revoked, altered, 27 or fictitious registration number plates plate , registration 28 receipt, or certificate of title, as the same are respectively 29 provided for in this chapter. 30 Sec. 25. Section 321.98, Code 2009, is amended to read as 31 follows: 32 321.98 Operation without registration. 33 A person shall not operate, and an owner shall not knowingly 34 permit to be operated upon any highway any vehicle required to 35 -39- LSB 5537XS (9) 83 dea/nh 39/ 52
S.F. 2211 be registered and titled hereunder under this chapter unless 1 there shall be is attached thereto to the vehicle and displayed 2 thereon on the vehicle when and as required by this chapter a 3 valid registration card and registration plate or plates issued 4 therefor for the vehicle for the current registration year and 5 unless a certificate of title has been issued for such vehicle 6 except as otherwise expressly permitted in this chapter. Any 7 violation of this section is a simple misdemeanor punishable 8 as a scheduled violation under section 805.8A, subsection 2, 9 paragraph “b” . 10 Sec. 26. Section 321.101A, Code 2009, is amended to read as 11 follows: 12 321.101A Revocation of registration by county treasurer. 13 The county treasurer may revoke the registration and 14 registration plates plate of a vehicle if the annual 15 registration fee or the fee for new registration is paid by 16 check, electronic payment, or credit card and the check, 17 electronic payment, or credit card is not honored by the 18 payer’s financial institution or credit card company, upon 19 reasonable notice and demand. The owner of the vehicle or 20 person in possession of the registration and registration 21 plates plate for the vehicle shall immediately return the 22 revoked registration and registration plates plate to the 23 appropriate county treasurer’s office. 24 Sec. 27. Section 321.103, Code 2009, is amended to read as 25 follows: 26 321.103 Owner to return evidences of registration and title. 27 Whenever If the department as authorized hereunder under 28 this chapter cancels, suspends, or revokes the registration 29 of a vehicle, or certificate of title, or registration 30 card, or registration plate or plates , or any nonresident 31 or other permit or the registration of any dealer, the 32 owner or person in possession of the same shall immediately 33 return the evidences of registration, certificate of title, 34 or plates plate so canceled, suspended, or revoked to the 35 -40- LSB 5537XS (9) 83 dea/nh 40/ 52
S.F. 2211 department. 1 Sec. 28. Section 321.104, subsection 3, Code 2009, is 2 amended to read as follows: 3 3. To fail to surrender a certificate of title, registration 4 card, or registration plates plate upon cancellation, 5 suspension, or revocation of the certificate or registration by 6 the department and notice as prescribed in this chapter. 7 Sec. 29. Section 321.105, subsections 2 and 5, Code 2009, 8 are amended to read as follows: 9 2. The annual registration fee shall be paid to the county 10 treasurer at the same time the application is made for the 11 registration or reregistration of the motor vehicle or trailer. 12 An owner may, when applying for registration or reregistration 13 of a motor vehicle or trailer, request that the plates plate be 14 mailed to the owner’s post office address. The owner’s request 15 shall be accompanied by a mailing fee as determined annually by 16 the director in consultation with the Iowa county treasurers 17 association. 18 5. Seriously disabled veterans who have been provided with 19 an automobile or other vehicle by the United States government 20 under the provisions of § 1901 1903, Title 38 of the United 21 States Code, 38 U.S.C. § 1901 et seq. (1970), shall be exempt 22 from payment of the registration fee provided in this chapter 23 for that vehicle, and shall be provided, without fee, with one 24 set of regular registration plates plate or one set of any type 25 of special registration plates plate associated with service in 26 the United States armed forces for which the disabled veteran 27 qualifies under section 321.34. The disabled veteran, to be 28 able to claim the benefit, must be a resident of the state 29 of Iowa. In lieu of the set of regular or special military 30 registration plates plate available without fee, the disabled 31 veteran may obtain a set of nonmilitary special registration 32 plates plate or personalized plates plate issued under section 33 321.34 by paying the additional fees associated with those 34 plates that plate . 35 -41- LSB 5537XS (9) 83 dea/nh 41/ 52
S.F. 2211 Sec. 30. Section 321.109, subsection 1, paragraph a, Code 1 2009, is amended to read as follows: 2 a. The annual fee for all motor vehicles including 3 vehicles designated by manufacturers as station wagons, 4 1993 and subsequent model year multipurpose vehicles, 5 and 2010 and subsequent model year motor trucks with an 6 unladen weight of ten thousand pounds or less, except motor 7 trucks registered under section 321.122, business-trade 8 trucks, special trucks, motor homes, ambulances, hearses, 9 motorcycles, motorized bicycles, and 1992 and older model year 10 multipurpose vehicles, shall be equal to one percent of the 11 value as fixed by the department plus forty cents for each 12 one hundred pounds or fraction thereof of weight of vehicle, 13 as fixed by the department. The weight of a motor vehicle, 14 fixed by the department for registration purposes, shall 15 include the weight of a battery, heater, bumpers, spare tire, 16 and wheel. Provided, however, that for any A nonresident 17 who purchases a new vehicle purchased in this state by a 18 nonresident for removal to the nonresident’s state of residence 19 the purchaser may make application to the county treasurer 20 in the county of purchase for a transit plate for which a 21 fee of ten dollars shall be paid. And provided, however, 22 that for any A nonresident who purchases a used vehicle 23 held by a registered dealer and not currently registered 24 in this state , or for any a vehicle held by an individual 25 and currently registered in this state , when purchased in 26 this state by a nonresident for removal to the nonresident’s 27 state of residence , the purchaser may make application to 28 the county treasurer in the county of purchase for a transit 29 plate for which a fee of three dollars shall be paid. The 30 county treasurer shall issue a nontransferable certificate of 31 registration for which no a refund shall not be allowed ; , and 32 the transit plates plate shall be void thirty days after 33 issuance. Such purchaser may apply for a certificate of title 34 by surrendering the manufacturer’s or importer’s certificate 35 -42- LSB 5537XS (9) 83 dea/nh 42/ 52
S.F. 2211 or certificate of title, duly assigned as provided in this 1 chapter. In this event, the treasurer in the county of 2 purchase shall, when satisfied with the genuineness and 3 regularity of the application, and upon payment of a fee of 4 twenty dollars, issue a certificate of title in the name and 5 address of the nonresident purchaser delivering the title 6 to the owner. If there is a security interest noted on the 7 title, the county treasurer shall mail to the secured party an 8 acknowledgment of the notation of the security interest. The 9 county treasurer shall not release a security interest that 10 has been noted on a title issued to a nonresident purchaser 11 as provided in this paragraph. The application requirements 12 of section 321.20 apply to a title issued as provided in this 13 subsection, except that a natural person who applies for a 14 certificate of title shall provide either the person’s social 15 security number, passport number, or driver’s license number, 16 whether the license was issued by this state, another state, or 17 another country. The provisions of this subsection relating to 18 multipurpose vehicles are effective for all 1993 and subsequent 19 model years. The annual registration fee for multipurpose 20 vehicles that are 1992 model years and older shall be in 21 accordance with section 321.124. 22 Sec. 31. Section 321.115, subsection 1, paragraph c, Code 23 2009, is amended to read as follows: 24 c. The owner of a motor vehicle registered under this 25 subsection may display an authentic Iowa registration plate 26 or set of plates from the model year of the motor vehicle, 27 furnished by the person and approved by the department, in lieu 28 of the current and valid Iowa registration plates plate issued 29 for the vehicle, provided that the current and valid Iowa 30 registration plates plate and the registration card issued for 31 the vehicle are simultaneously carried within the vehicle and 32 are available for inspection to any peace officer upon the 33 officer’s request. 34 Sec. 32. Section 321.115A, subsection 1, Code Supplement 35 -43- LSB 5537XS (9) 83 dea/nh 43/ 52
S.F. 2211 2009, is amended to read as follows: 1 1. A motor vehicle may be registered as a replica vehicle 2 or street rod upon payment of the fee provided for in section 3 321.109, 321.113, 321.122, or 321.124. The owner of a vehicle 4 registered under this section may display a registration 5 plate or set of plates from or representing the model year 6 of the motor vehicle or the model year of the motor vehicle 7 the registered vehicle is designed to resemble, furnished by 8 the person and approved by the department, in lieu of the 9 current and valid Iowa registration plates plate issued for the 10 vehicle, provided that the current and valid Iowa registration 11 plates plate and the registration card issued for the vehicle 12 are simultaneously carried within the vehicle and are available 13 for inspection to any peace officer upon the officer’s request. 14 Sec. 33. Section 321.120, subsection 3, Code 2009, is 15 amended to read as follows: 16 3. Upon approval of the application and payment of the 17 proper fees, the county treasurer shall issue a registration 18 plates plate for the vehicle which distinguish the vehicle as 19 a business-trade truck. 20 Sec. 34. Section 321.126, subsections 1, 3, 4, and 8, Code 21 2009, are amended to read as follows: 22 1. If the vehicle is destroyed by fire or accident, or 23 junked and its identity as a vehicle entirely eliminated, the 24 owner in whose name the vehicle was registered at the time of 25 destruction or dismantling shall return the plates plate to the 26 department and within thirty days thereafter make a statement 27 of such destruction or dismantling and make claim for refund. 28 With reference to the destruction or dismantling of a vehicle, 29 no a refund shall not be allowed unless a junking certificate 30 has been issued, as provided in section 321.52. 31 3. If the vehicle is placed in storage by the owner upon 32 the owner’s entry into the military service of the United 33 States, the owner shall return the plates plate to the county 34 treasurer or the department and make a statement regarding the 35 -44- LSB 5537XS (9) 83 dea/nh 44/ 52
S.F. 2211 storage and military service and make a claim for a refund. 1 Whenever the owner of a vehicle so placed in storage desires to 2 again register the vehicle, the county treasurer or department 3 shall compute and collect the fees for registration for the 4 registration year commencing in the month the vehicle is 5 removed from storage. 6 4. If the vehicle is registered by the county treasurer 7 during the current registration year and the owner or lessee 8 registers the vehicle for proportional registration under 9 chapter 326, the owner of the registered vehicle shall 10 surrender the registration plates plate to the county treasurer 11 and may file a claim for refund. In lieu of a refund, a credit 12 for the annual registration fees paid to the county treasurer 13 may be applied by the department to the owner or lessee’s 14 proportional registration fees upon the surrender of the county 15 plates plate and registration. 16 8. If the owner of the vehicle moves out of state, the 17 owner may make a claim for a refund by returning the Iowa 18 registration plates plate , along with evidence of the vehicle’s 19 registration in another jurisdiction, to the county treasurer 20 of the county in which the vehicle was registered within 21 six months of the out-of-state registration. For purposes 22 of section 321.127, the unexpired months remaining in the 23 registration year shall be calculated on the basis of the 24 effective date of the out-of-state registration. However, for 25 the purpose of timely issuance of the refund, the claim for 26 a refund under this subsection is considered to be filed on 27 the date the registration documents are received by the county 28 treasurer. 29 Sec. 35. Section 321.134, subsection 1, Code 2009, is 30 amended to read as follows: 31 1. On the first day of the second month following the 32 beginning of each registration year a penalty of five percent 33 of the annual registration fee shall be added to the annual 34 registration fees not paid by that date and an additional 35 -45- LSB 5537XS (9) 83 dea/nh 45/ 52
S.F. 2211 penalty of five percent shall be added the first day of each 1 succeeding month, until the fee is paid. A penalty shall 2 not be less than five dollars. If the owner of a vehicle 3 surrenders the registration plates plate for a vehicle prior 4 to the plates becoming before the plate is delinquent, to 5 the county treasurer of the county where the vehicle is 6 registered, or to the department if the vehicle is registered 7 under chapter 326, the owner may register the vehicle any 8 time thereafter upon payment of the annual registration fee 9 for the registration year without penalty. The penalty on 10 vehicles registered under chapter 326 shall accrue February 1 11 of each year. To avoid a penalty or an additional penalty in 12 the case of a delinquent registration, if the last calendar 13 day of a month falls on Saturday, Sunday, or a holiday, the 14 payment deadline is extended to include the first business day 15 of the following month. For payments made through a county 16 treasurer’s authorized website only, if the last day of the 17 month falls on a Saturday, Sunday, or a holiday, the electronic 18 payment must be initiated by midnight on the first business 19 day of the next month. All other electronic payments must be 20 initiated by midnight on the last day of the month preceding 21 the delinquent date. 22 Sec. 36. Section 321.166, subsections 1, 2, 4, 6, 8, and 10, 23 Code Supplement 2009, are amended to read as follows: 24 1. a. Registration plates shall be of metal and of a size 25 not to exceed six inches by twelve inches, except that the size 26 of plates issued for use on motorized bicycles, motorcycles, 27 motorcycle trailers, and trailers with an empty weight of two 28 thousand pounds or less shall be established by the department. 29 b. Trailers A trailer with an empty weights weight of two 30 thousand pounds or less may, upon request, be licensed with 31 a regular-sized license plates registration plate . 32 2. Every registration plate or pair of plates shall 33 display a registration plate number which shall consist 34 of alphabetical or numerical characters or a combination 35 -46- LSB 5537XS (9) 83 dea/nh 46/ 52
S.F. 2211 thereof of characters and the name of this state, which may be 1 abbreviated. Every registration plate issued by the county 2 treasurer shall display the name of the county, including any 3 plate issued pursuant to section 321.34, except Pearl Harbor 4 and purple heart registration plates issued prior to January 1, 5 1997; registration plates issued pursuant to section 321.34, 6 subsection 13, paragraph “d” ; and collegiate, fire fighter, and 7 medal of honor registration plates. Special truck registration 8 plates shall display the word “special” . The department may 9 adopt rules to implement this subsection. 10 4. The registration plate number, except on motorized 11 bicycle bicycles , motorcycle motorcycles , motorcycle 12 trailer trailers , and trailers with an empty weight of two 13 thousand pounds or less shall be of sufficient size to be 14 readable from a distance of one hundred feet during daylight. 15 6. Registration plates A registration plate issued to a 16 disabled veteran under the provisions of section 321.105 shall 17 display the alphabetical characters “DV” which shall precede 18 the registration plate number. The plates plate may also 19 display a persons with disabilities parking sticker if issued 20 to the disabled veteran by the department under section 321L.2. 21 8. The owner of a trailer with an empty weight of 22 two thousand pounds or less shall receive a registration 23 plates plate for the trailer smaller than plates regularly 24 issued for automobiles pursuant to rules adopted by the 25 department in accordance with this section unless the owner 26 requests a regular-sized plates plate . 27 10. If the department reissues a new registration plate 28 design for a special registration plate under section 321.34, 29 all persons who have purchased or obtained the special 30 registration plates plate shall not be required to pay the 31 issuance fee. 32 Sec. 37. Section 321.385A, unnumbered paragraph 2, Code 33 2009, is amended to read as follows: 34 A citation issued for failure to have rear lamps as required 35 -47- LSB 5537XS (9) 83 dea/nh 47/ 52
S.F. 2211 under section 321.387 or a rear registration plate light as 1 required under section 321.388 shall first provide for a 2 seventy-two hour period within which the person charged with 3 the violation shall replace or repair the lamps or light. If 4 the person complies with the directive to replace or repair the 5 lamps or light within the allotted time period, the citation 6 shall be expunged. If the person fails to comply within the 7 allotted time period, the citation shall be processed in the 8 same manner as other citations. 9 Sec. 38. Section 321.388, Code 2009, is amended to read as 10 follows: 11 321.388 Illuminating plates. 12 Either the rear lamp or a separate lamp shall be so 13 constructed and placed as to illuminate with a white light the 14 rear registration plate and render it clearly legible from a 15 distance of fifty feet to the rear. When the rear registration 16 plate is illuminated by an electric lamp other than the 17 required rear lamp, the two lamps shall be turned on or off 18 only by the same control switch at all times when headlamps are 19 lighted. 20 Sec. 39. Section 321E.10, unnumbered paragraph 1, Code 21 2009, is amended to read as follows: 22 The department or local authorities may upon application 23 issue annual trip permits for the movement of truck trailers 24 manufactured or assembled in this state that exceed the maximum 25 length specified in section 321.457 and the maximum width 26 specified in section 321.454. Movement of the The truck 27 trailers shall be moved solely for the purpose of delivery or 28 transfer from the point of manufacture or assembly to another 29 point of manufacture or assembly within the state or to a 30 point outside the state, shall be moved only on roadways of 31 twenty-four feet or more in width or on four-lane highways, 32 shall be moved on the most direct route necessary for such 33 movement, and shall display the special plates plate designated 34 in section 321.57. A vehicle or combination of two or more vehicles 2 inclusive of front and rear bumpers, including towing units, 3 involved in the movement of truck trailers shall not exceed an 4 overall width of ten feet. Vehicles or combinations shall be 5 distinctly marked on both the front and rear of the unit in a 6 manner the director of transportation designates to indicate 7 that the vehicles or combinations are being moved for delivery 8 or transfer purposes only. 9 Sec. 40. Section 321J.4B, subsection 5, paragraph f, Code 10 2009, is amended to read as follows: 11 f. (1) If the vehicle subject to the court order is not in 12 the custody of a law enforcement agency, the person or agency 13 designated in the order as the person or agency responsible for 14 executing the order shall, upon receipt of the order, promptly 15 locate the vehicle specified in the order, seize the motor 16 vehicle and the license plates registration plate , and send or 17 deliver the vehicle’s license plates registration plate to the 18 department. 19 (2) If the vehicle is located at a place other than 20 the place at which the court order is to be carried out, 21 the person or agency responsible for executing the order 22 shall arrange for the vehicle to be moved to the place of 23 impoundment or immobilization. When the vehicle is found, is 24 impounded or immobilized, and is at the place of impoundment or 25 immobilization, the person or agency responsible for executing 26 the order shall notify the clerk of the date on which the order 27 was executed. The clerk shall notify the department of the 28 date on which the order was executed. 29 Sec. 41. Section 321J.4B, subsection 7, Code 2009, is 30 amended to read as follows: 31 7. a. Upon receipt of a notice of conviction of the 32 defendant for a violation of subsection 2, the impounding 33 authority shall seize the motor vehicle’s license 34 plates registration plate and registration, and shall send or 35 -49- LSB 5537XS (9) 83 dea/nh 49/ 52
S.F. 2211 deliver them to the department. 1 b. The department shall destroy license plates a 2 registration plate received under this section and shall not 3 authorize the release of the vehicle or the issuance of a new 4 license plates registration plate for the vehicle until the 5 period of impoundment or immobilization has expired , and the 6 fee and costs assessed under subsection 10 have been paid. The 7 fee for issuance of a new license plates registration plate and 8 certificates certificate of registration shall be the same as 9 for the replacement of a lost, mutilated, or destroyed license 10 plates registration plate and certificates certificate of 11 registration. 12 Sec. 42. Section 321L.2, subsection 1, paragraph a, 13 subparagraphs (1) and (2), Code Supplement 2009, are amended 14 to read as follows: 15 (1) Persons with disabilities registration plates. An 16 applicant may order a persons with disabilities registration 17 plates plate pursuant to section 321.34. An applicant may 18 order a persons with disabilities registration plate for a 19 trailer used to transport a wheelchair pursuant to section 20 321.34 in addition to a persons with disabilities registration 21 plates plate ordered by the applicant for a motor vehicle used 22 to tow such a trailer pursuant to section 321.34. 23 (2) Persons with disabilities parking sticker. An 24 applicant who owns a motor vehicle for which the applicant 25 has been issued a registration plates plate under section 26 321.34 or a registration plates plate as a seriously disabled 27 veteran under section 321.105 may apply to the department for a 28 persons with disabilities parking sticker to be affixed to the 29 plates plate . The persons with disabilities parking stickers 30 shall bear the international symbol of accessibility. 31 Sec. 43. Section 321L.2, subsection 5, Code Supplement 32 2009, is amended to read as follows: 33 5. A seriously disabled veteran who has been provided 34 with an automobile or other vehicle by the United States 35 -50- LSB 5537XS (9) 83 dea/nh 50/ 52
S.F. 2211 government under the provisions of 38 U.S.C. § 1901 et seq. 1 (1970) is not required to apply for a persons with disabilities 2 parking permit under this section unless the veteran has been 3 issued a special registration plates plate or personalized 4 plates plate for the vehicle. The regular registration 5 plates plate issued for the disabled veteran’s vehicle without 6 fee pursuant to section 321.105 entitle entitles the disabled 7 veteran to all of the rights and privileges associated with 8 persons with disabilities parking permits under this chapter. 9 Sec. 44. Section 321L.2A, subsection 1, paragraph e, Code 10 2009, is amended to read as follows: 11 e. The person carries in the motor vehicle a copy of 12 the statement from a physician, physician’s assistant, 13 advanced registered nurse practitioner, or chiropractor 14 which accompanied the person’s application for a persons with 15 disabilities registration plates plate under section 321.34 or 16 other persons with disabilities parking permit under section 17 321L.2 and which indicates the person is permanently unable to 18 walk. The person shall show the copy of the statement to any 19 peace officer upon request. 20 Sec. 45. Section 326.17, Code 2009, is amended to read as 21 follows: 22 326.17 Iowa base plates. 23 Resident fleet owners shall be required to list Iowa as the 24 base state for all commercial vehicles which qualify under the 25 term “base state” as defined in this chapter, and Iowa base 26 plates shall be displayed on all such commercial vehicles. 27 Nonresident fleet owners subject to proportional registration 28 shall display an Iowa base plates if the plate on a commercial 29 vehicle qualifies as an Iowa based vehicle as defined in this 30 chapter. 31 Sec. 46. CODE EDITOR DIRECTIVE. The Code editor may make 32 any change the Code editor deems necessary to any Code section 33 that refers to the issuance of two rather than one vehicle 34 registration plate when there appears to be no doubt as to the 35 -51- LSB 5537XS (9) 83 dea/nh 51/ 52
S.F. 2211 proper method of making the correction. 1 Sec. 47. TRANSITION PROVISIONS. 2 The transition from the use of motor vehicle registration 3 plates on both the front and rear of certain vehicles to the 4 use of such plates on only the rear of certain vehicles, as 5 directed by this Act, shall be accomplished in stages. A 6 person applying for a new or replacement registration plate 7 on or after July 1, 2010, shall receive only one registration 8 plate. Otherwise, the transition shall not be accomplished 9 until a new series of registration plates is issued to replace 10 a current series. The department of transportation shall adopt 11 rules to implement the transition. 12 EXPLANATION 13 This bill amends Code section 321.37, relating to the 14 display of motor vehicle registration plates, to provide 15 that only one registration plate shall be issued for a motor 16 vehicle. The registration plate is to be attached to the rear 17 of the motor vehicle, except that the registration plate for 18 a truck tractor is to be attached to the front of the truck 19 tractor. Currently, two registration plates are issued for 20 a motor vehicle other than a motorcycle, motorized bicycle, 21 or truck tractor, to be attached to the front and rear of the 22 vehicle. 23 The bill also makes numerous corresponding Code language 24 changes, makes some Code language changes to enhance 25 readability, and provides for the transition from the use of 26 two registration plates to the use of one registration plate. 27 -52- LSB 5537XS (9) 83 dea/nh 52/ 52
