NEW SECTION . 29A.14A Use of government 1 facilities. 2 Notwithstanding any provision of law to the contrary, the 3 state or any political subdivision of the state, shall permit 4 the rental of facilities under its control, for a fee not 5 in excess of any expenses incurred by the state or political 6 subdivision, for designated military events. For purposes 7 of this section, “designated military event” means an event, 8 authorized by the adjutant general, for national guard family 9 readiness groups or for returning veterans for a period of up 10 to one year from the date of return from active duty. 11 Sec. 2. NEW SECTION . 144.13B Waiver of fees —— military 12 service. 13 Notwithstanding any provision of this chapter to the 14 contrary, the certified copy fees for a birth certificate or 15 death certificate of a service member, as defined in section 16 29A.90, who died while on active duty shall be waived for a 17 period of one year from the date of death for a family member 18 of the deceased service member. 19 Sec. 3. Section 144C.6, Code 2009, is amended by adding the 20 following new subsection: 21 NEW SUBSECTION . 4. A declaration for disposition of remains 22 made by a service member, as defined in section 29A.90, on 23 forms provided and authorized by the department of defense 24 for service members for this purpose shall constitute a valid 25 declaration of designee for purposes of this chapter. 26 Sec. 4. Section 321A.33, Code 2009, is amended to read as 27 follows: 28 321A.33 Exceptions. 29 This chapter does not apply to any motor vehicle owned by 30 the United States, this state, or any political subdivision of 31 this state or to any operator, except for section 321A.4, while 32 on official duty operating such motor vehicle. This chapter 33 does not apply, except for sections 321A.4 and 321A.26, to any 34 motor vehicle which is subject to section 325A.6. In addition, 35 -1- LSB 5554XS (4) 83 ec/nh 1/ 3
S.F. 2183 this chapter does not apply to any motor vehicle owned by a 1 service member deployed for military service, both as defined 2 in section 29A.90, for the period of the military service. 3 Sec. 5. Section 476.20, subsection 3, Code 2009, is amended 4 by adding the following new unnumbered paragraph: 5 NEW UNNUMBERED PARGRAPH . The rules established by the 6 board shall provide that a public utility furnishing gas or 7 electricity shall not disconnect service to a residence in 8 which the head of household is a service member deployed for 9 military service, as defined in section 29A.90, for a period 10 of sixty days or until the public utility has made a good faith 11 effort to contact the service member, whichever is later. 12 Sec. 6. NEW SECTION . 483A.24A License refunds —— military 13 service. 14 Notwithstanding any provision of this chapter to the 15 contrary, a service member deployed for military service, 16 both as defined in section 29A.90, shall receive a refund of 17 that portion of any license fee paid by the service member 18 representing the service member’s period of military service. 19 EXPLANATION 20 This bill concerns veterans and military service, adding 21 Code provisions relating to fees, use of state facilities, 22 public utilities, disposition of remains, and motor vehicle 23 financial responsibility. 24 New Code section 29A.14A requires the state, or a political 25 subdivision of the state, to allow the use of facilities under 26 its control for certain designated military events for not 27 more than the cost of expenses. The Code section defines 28 a designated military event as an event, authorized by the 29 adjutant general, for national guard family readiness groups or 30 for returning veterans for a period of up to one year from the 31 date of return from active duty. 32 New Code section 144.13B waives the fees for a birth or death 33 certificate of a service member who dies while on active duty 34 for a period of one year from the date of death for a family 35 -2- LSB 5554XS (4) 83 ec/nh 2/ 3
S.F. 2183 member of the deceased service member. 1 Code section 144C.6, concerning a declaration of a designee 2 for disposition of remains, is amended to provide that a 3 declaration for disposition of remains made by a service member 4 on forms provided and authorized by the department of defense 5 for service members for this purpose shall constitute a valid 6 declaration of designee. 7 Code section 321A.33, concerning exceptions from the 8 state’s financial responsibility law, is amended to provide an 9 additional exception for any motor vehicle owned by a service 10 member deployed for military service for the period of the 11 military service. 12 Code section 476.20, relating to the disconnection of 13 utilities, is amended to provide that a public utility 14 furnishing gas or electricity shall not disconnect service 15 to a residence in which the head of household is a service 16 member deployed for military service for a period of sixty days 17 or until the public utility has made a good faith effort to 18 contact the service member, whichever is later. 19 New Code section 483A.24A provides that a service member 20 deployed for military service shall receive a refund of that 21 portion of any fishing or hunting license fee paid by the 22 service member representing the service member’s period of 23 military service. 24 -3- LSB 5554XS (4) 83 ec/nh 3/ 3
