1.
Section
136.1,
Code
2009,
is
amended
to
read
as
1
follows:

136.1
Composition
of
board.
3
The
state
board
of
health
shall
consist
of
the
following
4
members:
Five
Two
members
learned
in
health-related
5
disciplines,
three
members
who
have
direct
experience
with
6
public
health,
two
members
who
have
direct
experience
with
7
substance
abuse
treatment
or
prevention,
and
four
members
8
representing
the
general
public.
At
least
one
of
such
members
9
shall
be
licensed
in
the
practice
of
medicine
and
surgery
or
10
osteopathic
medicine
and
surgery
under
chapter
148.
11
The
director
of
public
health
shall
serve
as
secretary
of
the
12
board.
13
Sec.
2.
Section
136.3,
Code
2009,
is
amended
by
striking
the
14
section
and
inserting
in
lieu
thereof
the
following:
15
136.3
Duties.
16
The
state
board
of
health
shall
provide
a
forum
for
the
17
development
of
public
health
policy
in
the
state
of
Iowa
and
18
shall
have
the
following
powers
and
duties:
19
1.
Consider
and
study
legislation
and
administration
20
concerning
public
health.
21
2.
Advise
the
department
on
any
issue
related
to
the
22
promotion
and
protection
of
the
health
of
Iowans
including
but
23
not
limited
to:
24
a.
Prevention
of
epidemics
and
the
spread
of
disease,
25
including
communicable
and
infectious
diseases
such
as
zoonotic
26
diseases,
quarantine
and
isolation,
sexually
transmitted
27
diseases,
and
antitoxins
and
vaccines.
28
b.
Protection
against
environmental
hazards.
29
c.
Prevention
of
injuries.
30
d.
Promotion
of
healthy
behaviors.
31
e.
Preparing
for,
responding
to,
and
recovering
from
public
32
health
emergencies
and
disasters.
33
3.
Establish
policies
governing
the
performance
of
the
34
department
in
the
discharge
of
any
duties
imposed
on
it
by
law.

Provide
guidance
to
the
director
in
the
discharge
of
the

director’s
duties.

Adopt
and
implement
the
Iowa
public
health
standards.

the
department
complies
with
Iowa
Code,

administrative
rules,
and
the
Iowa
public
health
standards.

For
this
purpose
the
board
shall
have
access
at
any
time
to
all

documents
and
records
of
the
department.

7.
Assure
that
the
department
prepares
and
distributes
an
8
annual
report.

8.
Advise
or
make
recommendations
to
the
director
of
public
10
health,
governor,
and
general
assembly
relative
to
public
11
health
and
advocate
for
state
and
local
public
health
to
comply
12
with
the
Iowa
public
health
standards.

9.
Offer
consultation
to
the
governor
in
the
appointment
of
14
the
director
of
the
department.
15
10.
Adopt,
promulgate,
amend,
and
repeal
rules
and
16
regulations
consistent
with
law
for
the
protection
of
the
17
public
health
and
prevention
of
substance
abuse,
and
for
18
the
guidance
of
the
department.
All
rules
adopted
by
the
19
department
are
subject
to
approval
by
the
board.
20
11.
Act
by
committee,
or
by
a
majority
of
the
board.
21
12.
Keep
minutes
of
the
transactions
of
each
session,
22
regular
or
special,
which
shall
be
public
records
and
filed
23
with
the
department.
24
13.
Perform
those
duties
authorized
pursuant
to
chapter
25
125.
The
board
may
appoint
a
substance
abuse
program
committee
26
to
approve
or
deny
applications
for
licensure
received
from
27
substance
abuse
programs
pursuant
to
chapter
125
and
to
perform
28
any
other
function
authorized
by
chapter
125
and
delegated
to
29
the
committee.

14.
Perform
those
duties
authorized
pursuant
to
sections
31
135.156,
135.159,
and
135.161,
and
other
provisions
of
law.

board
shall
meet
on
the
second
Wednesday
in
July
and
on
1
the
second
Wednesday
of
every
second
month
thereafter
at
least

six
times
per
year
and
at
such
other
times
as
may
be
deemed
3
necessary
by
the
president
chairperson
of
the
board
or
the
4
director
of
the
department
.
The
president
department
shall
5
give
each
board
member
adequate
notice
of
all
special
meetings.

A
majority
of
the
members
of
the
board
shall
constitute
a
7
quorum.

136.7,

is
amended
to
read
as

136.8,
Code

amended
to

Supplies.

The
department
shall
furnish
the
board
of
health
with
all

articles
and
supplies
required
for
the
public
use
and
necessary
22
to
enable
the
board
to
perform
the
duties
imposed
upon
it
by
23
law.
Such
articles
and
supplies
shall
be
obtained
by
the
24
department
in
the
same
manner
in
which
the
regular
supplies
for
25
the
department
are
obtained
and
the
same
shall
be
considered
26
and
accounted
for
as
if
obtained
for
the
use
of
the
department.

EXPLANATION
28
This
bill
rewrites
provisions
in
Code
chapter
136,
relating
29
to
the
organization
and
duties
of
the
state
board
of
health.
30
The
revision
remains
very
similar
to
the
current
statute.
31
The
bill
revises
the
membership
of
the
board
itself.
Under
32
current
law,
the
board
consists
of
five
members
learned
33
in
health-related
disciplines,
two
members
who
have
direct
34
experience
with
substance
abuse
treatment
or
prevention,
and

four
members
representing
the
general
public.
Under
the
bill,
1
board
makeup
consists
of
two
members
learned
in
health-related
2
disciplines,
three
members
who
have
direct
experience
with

public
health,
two
members
who
have
direct
experience
with
4
substance
abuse
treatment
or
prevention,
and
four
members
5
representing
the
general
public.
At
least
one
member
must
be
a
6
physician.

The
bill
amends
Code
section
136.3,
relating
to
the
duties
8
of
the
board,
by
reorganizing
the
Code
section
and
updating
9
language.
The
bill
eliminates
some
specific
duties
and
sets
10
the
board
duties
in
general
terms.
Many
of
the
specific
duties
11
are
now
encompassed
in
the
board
duty
to
"[a]dopt
and
implement
12
the
Iowa
public
health
standards”.
13
The
bill
revises
Code
section
136.5
to
provide
general
14
guidelines
for
the
number
of
meetings
the
board
shall
hold
15
annually
rather
than
specific
meeting
dates
and
directs
the
16
department,
rather
than
the
president
of
the
board,
to
give
17
notice
of
meetings.
The
bill
also
amends
Code
section
136.7
to
18
provide
that
the
board
shall
elect
a
chairperson
rather
than
a
19
president.
