S.F. 2144 Section 1. Section 252B.7A, Code 2009, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 1A. Disability compensation received by a 3 party from the United States department of veterans’ affairs 4 for service-related injuries shall not be considered income 5 for the purposes of determining a parent’s income under this 6 section. 7 Sec. 2. Section 598.11, Code 2009, is amended by adding the 8 following new subsection: 9 NEW SUBSECTION . 4. The court shall not consider disability 10 compensation received by a party from the United States 11 department of veterans’ affairs for service-related injuries 12 in determining the amount of temporary support awarded under 13 this section. 14 Sec. 3. Section 598.13, Code 2009, is amended by adding the 15 following new subsection: 16 NEW SUBSECTION . 3. Disability compensation received by a 17 party from the United States department of veterans’ affairs 18 for service-related injuries shall not be considered income or 19 property for the purposes of disclosing the financial status 20 of such party. 21 Sec. 4. Section 598.21, Code Supplement 2009, is amended by 22 adding the following new subsection: 23 NEW SUBSECTION . 6A. Veterans’ disability 24 compensation. Disability compensation received by a party 25 from the United States department of veterans’ affairs for 26 service-related injuries shall not be considered property for 27 the purposes of this section. 28 Sec. 5. Section 598.21A, Code 2009, is amended by adding the 29 following new subsection: 30 NEW SUBSECTION . 3. Veterans’ disability 31 compensation. S.F. 2144 Sec. 6. Section 598.21B, subsection 2, paragraph b, Code 1 Supplement 2009, is amended by adding the following new 2 subparagraph: 3 NEW SUBPARAGRAPH . (4) For purposes of calculating a support 4 obligation under this section, disability compensation received 5 by a party from the United States department of veterans’ 6 affairs for service-related injuries shall not be considered 7 income. 8 Sec. 7. Section 598.21C, Code Supplement 2009, is amended by 9 adding the following new subsection: 10 NEW SUBSECTION . 1A. Veterans’ disability 11 compensation. Changes in the amount of disability compensation 12 received by a party from the United States department of 13 veterans’ affairs for service-related injuries shall not be 14 considered a substantial change in circumstances for the 15 purposes of this section. 16 Sec. 8. Section 627.6, subsection 8, paragraph b, Code 2009, 17 is amended to read as follows: 18 b. A veteran’s benefit including disability compensation 19 received by the debtor from the United States department of 20 veterans’ affairs for service-related injuries . 21 Sec. 9. NEW SECTION . 627.14 Veterans’ disability 22 compensation. 23 Any disability compensation received by a person from 24 the United States department of veterans’ affairs for 25 service-related injuries is exempt from garnishment, 26 attachment, execution, and assignment of income, except for 27 the purposes of enforcing child, spousal, or medical support 28 obligations. 29 EXPLANATION 30 This bill excludes from the claims of creditors and the 31 calculation of property disposition and support obligations 32 under dissolution of marriage and child support determinations, 33 disability compensation received by a party from the United 34 States department of veterans’ affairs for service-related 35 -2- LSB 6034XS (1) 83 rh/nh 2/ 3

United States department of veterans’ affairs 1 disability compensation, in general, is a benefit paid to a 2 veteran due to injuries or diseases that were incurred in or 3 aggravated by military service. 4 The bill also excludes such disability compensation from 5 garnishment, attachment, execution, and assignment of income, 6 except for the purposes of enforcing child, spousal, or medical 7 support obligations. 8 -3- LSB 6034XS (1) 83 rh/nh 3/ 3
