S.F. 2134 Section 1. Section 613.15, Code 2009, is amended by striking 1 the section and inserting in lieu thereof the following: 2 613.15 Injury to or death of spouse or parent. 3 1. A spouse or child of a person may recover for the expense 4 and actual loss of support, services, companionship, and 5 society resulting from injury to or death of the person. 6 2. In the case of an injury to or death of a person under 7 subsection 1 who is or was primarily engaged as a homemaker, 8 the calculation of damages recoverable shall include but not 9 be limited to the fair market value of replacement services 10 for child care, housekeeping, cleaning, transportation, food 11 preparation, shopping, laundry, and any other homemaking 12 services lost. 13 EXPLANATION 14 This bill relates to civil damages recoverable for injury to 15 or death of a person. 16 The bill provides that a spouse or child of a person may 17 recover for the expense and actual loss of support, services, 18 companionship, and society resulting from injury to or death 19 of the person. 20 The bill provides that, in the case of an injury to or 21 death of a person under the bill who is or was primarily 22 engaged as a homemaker, the calculation of damages recoverable 23 shall include but not be limited to the fair market value of 24 replacement services for child care, housekeeping, cleaning, 25 transportation, food preparation, shopping, laundry, and any 26 other homemaking services lost. 27 -1- LSB 5780XS (6) 83 rh/rj 1/ 1
