S.F. 2133 Section 1. Section 513C.3, subsection 15, Code 2009, is 1 amended to read as follows: 2 15. a. “Qualifying existing coverage” or “qualifying 3 previous coverage” means benefits or coverage provided under any 4 of the following: 5 a. (1) Any group health insurance that provides benefits 6 similar to or exceeding benefits provided under the standard 7 health benefit plan , provided that such policy has been in 8 effect for a period of at least one year . 9 b. (2) An individual health insurance benefit plan, 10 including coverage provided under a health maintenance 11 organization contract, a hospital or medical service plan 12 contract, or a fraternal benefit society contract, that 13 provides benefits similar to or exceeding the benefits provided 14 under the standard health benefit plan , provided that such 15 policy has been in effect for a period of at least one year . 16 c. (3) An organized delivery system that provides 17 benefits similar to or exceeding the benefits provided under 18 the standard health benefit plan , provided that the benefits 19 provided by the organized delivery system have been in effect 20 for a period of at least one year . 21 b. For purposes of this subsection, an association policy 22 under chapter 514E is not considered “qualifying existing 23 coverage” or “qualifying previous coverage”. 24 EXPLANATION 25 This bill expands what constitutes “qualifying existing 26 coverage” or “qualifying previous coverage” in Code chapter 27 513C by removing a requirement that such coverage must have 28 been in effect for a period of at least one year to meet the 29 definition of qualifying coverage. Code section 514A.3B 30 requires an insurer which accepts an individual for coverage 31 under an individual policy or contract of accident and health 32 insurance to waive any preexisting condition exclusion or 33 limitation period requirement of the policy or contract for 34 the period of time the individual was previously covered by 35 -1- LSB 5256XS (3) 83 av/nh 1/ 2
