S.F. 2119 Section 1. Section 85.66, Code Supplement 2009, is amended 1 by adding the following new subsection: 2 NEW SUBSECTION . 4. Notwithstanding subsection 2, when 3 the assets of the fund exceed four million dollars after 4 reimbursements to the attorney general provided for in 5 section 85.67, the workers’ compensation commissioner shall 6 be reimbursed up to one hundred fifty thousand dollars 7 annually from the fund for costs related to carrying out the 8 commissioner’s duties pursuant to section 86.13A, so long as 9 the reimbursement to the commissioner does not reduce the 10 assets of the fund to less than four million dollars. In 11 addition, any assets which remain in the fund each year in 12 excess of four million dollars after reimbursement of the 13 workers’ compensation commissioner pursuant to this subsection, 14 shall be transferred by the treasurer of state to the general 15 fund of the state. 16 EXPLANATION 17 This bill provides that when the assets of the workers’ 18 compensation second injury fund exceed $4 million, the workers’ 19 compensation commissioner shall be reimbursed up to $150,000 20 each year from the fund for costs related to carrying out 21 the commissioner’s duties to monitor the rate of compliance 22 of employers and insurers in commencing weekly workers’ 23 compensation benefit payments, so long as this payment to the 24 commissioner does not reduce the assets of the fund to less 25 than $4 million. In addition, any assets which remain in the 26 fund in excess of $4 million each year after this reimbursement 27 to the commissioner must be transferred by the treasurer of 28 state to the general fund of the state. 29 -1- LSB 5577XS (3) 83 av/nh 1/ 1
