S.F. 2105 Section 1. Section 260C.14, subsection 14, paragraph b, 1 subparagraph (2), subparagraph division (b), Code Supplement 2 2009, is amended to read as follows: 3 (b) “Qualified military person” means a person on active 4 duty in the military service of the United States who is 5 stationed in this state or at the Rock Island arsenal. If 6 the qualified military person is transferred, deployed, or 7 restationed while the person’s spouse or child is enrolled in 8 the community college, the spouse or child shall continue to be 9 classified as a resident until the close of the fiscal year in 10 which the spouse or child is enrolled. 11 Sec. 2. Section 260C.14, subsection 14, paragraph b, 12 subparagraph (2), subparagraph division (c), subparagraph 13 subdivision (ii), Code Supplement 2009, is amended to read as 14 follows: 15 (ii) Is domiciled Has resided in this state. 16 Sec. 3. Section 260C.14, subsection 14, Code Supplement 17 2009, is amended by adding the following new paragraph: 18 NEW PARAGRAPH . c. Adopt rules to waive the tuition and 19 mandatory fees for a person who enrolls as a student and whose 20 spouse, after September 11, 2001, was killed while on duty or 21 in state active duty, as defined in section 29A.1, subsections 22 9 and 11, in the line of duty, or died as a result of injuries 23 received or as a result of illness or disease contracted while 24 on duty or in active state duty. 25 Sec. 4. Section 260C.14, subsection 20, unnumbered 26 paragraph 1, Code Supplement 2009, is amended to read as 27 follows: 28 Adopt a policy to offer not less than the following options 29 to a student who is a member , or the spouse of a member if 30 the member has a dependent child as defined in subsection 14, 31 paragraph “b” , subparagraph (2), subparagraph division (a), of 32 the Iowa national guard or reserve forces of the United States 33 and who is ordered to state military service or federal service 34 or duty: 35 -1- LSB 5248XS (9) 83 kh/sc 1/ 5

Section 262.9, subsection 17, paragraph b, 13 subparagraph (2), subparagraph division (c), subparagraph 14 subdivision (ii), Code Supplement 2009, is amended to read as 15 follows: 16 (ii) Is domiciled Has resided in this state. 17 Sec. 7. Section 262.9, subsection 17, Code Supplement 2009, 18 is amended by adding the following new paragraph: 19 NEW PARAGRAPH . c. Adopt rules to waive the tuition and 20 mandatory fees for a person who enrolls as an undergraduate 21 student and whose spouse, after September 11, 2001, was killed 22 while on duty or in state active duty, as defined in section 23 29A.1, subsections 9 and 11, in the line of duty, or died as 24 a result of injuries received or as a result of illness or 25 disease contracted while on duty or in active state duty. 26 Sec. 8. Section 262.9, subsection 30, unnumbered paragraph 27 1, Code Supplement 2009, is amended to read as follows: 28 Direct the institutions of higher education under its 29 control to adopt a policy to offer not less than the following 30 options to a student who is a member , or the spouse of a member 31 if the member has a dependent child as defined in subsection 32 17, paragraph “b” , subparagraph (2), subparagraph division 33 (a), of the Iowa national guard or reserve forces of the United 34 States and who is ordered to state military service or federal 35 -2- LSB 5248XS (9) 83 kh/sc 2/ 5
S.F. 2105 service or duty: 1 Sec. 9. Section 272.8, Code 2009, is amended to read as 2 follows: 3 272.8 License to applicants from other states or countries. 4 1. The board may issue a license to an applicant from 5 another state or country if the applicant files evidence of the 6 possession of the required or equivalent requirements with the 7 board. If the applicant is the spouse of a military person who 8 is on duty or in active state duty as defined in section 29A.1, 9 subsections 9 and 11, the board shall assign a consultant to 10 be the single point of contact for the applicant regarding 11 nontraditional licensure. 12 2. The executive director of the board may, subject to 13 board approval, enter into reciprocity agreements with another 14 state or country for the licensing of practitioners on an 15 equitable basis of mutual exchange, when the action is in 16 conformity with law. 17 3. Practitioner preparation and professional development 18 programs offered in this state by out-of-state institutions 19 must be approved by the board in order to fulfill requirements 20 for licensure or renewal of a license by an applicant. 21 Sec. 10. NATIONAL SECURITY EDUCATION PROGRAM WORKING 22 GROUP. The department of education, in collaboration with the 23 state board of regents, shall convene a working group that 24 includes but is not limited to representatives of the business 25 community of this state, to explore the possibility of securing 26 the cooperation and assistance of the United States department 27 of defense, the national defense university, and the national 28 security education board to participate in the federal national 29 security education program and establish a foreign language 30 road map, flagship program, and timeline in this state for K-16 31 and graduate-level students. The working group also shall 32 study the feasibility, including but not limited to the costs, 33 of establishing the road map, program, and timeline, and shall 34 submit a report of its findings and recommendations to the 35 -3- LSB 5248XS (9) 83 kh/sc 3/ 5
S.F. 2105 general assembly by January 15, 2011. 1 EXPLANATION 2 This bill provides education-related benefits for military 3 persons and veterans, and their spouses, and directs the 4 department of education to work with the state board of regents 5 to convene a working group to explore the possibility of 6 participating in a federal program whose goal is to build a 7 broad pool of internationally competent individuals who are 8 available for recruitment into the federal national security 9 community. 10 The bill provides for in-state tuition for military 11 personnel stationed in Iowa and for veterans who have resided 12 in Iowa; provides for a tuition and mandatory fee waiver at 13 community colleges and regents universities for the spouses 14 of military personnel killed while on duty or in state active 15 duty, in the line of duty, or who died as a result of injuries 16 received or as a result of illness or disease contracted while 17 on duty or in active state duty. 18 The bill also directs the boards of directors of community 19 colleges and the state board of regents to provide the spouses 20 of members of the Iowa national guard or the reserve forces of 21 the United States who are ordered to state military service or 22 federal service or duty with the same options currently offered 23 to the members, which are to withdraw and receive a full refund 24 of tuition and mandatory fees or to make arrangements for some 25 or all course grades or incompletes, with refunds only paid for 26 courses for which arrangements could not be made for grades or 27 incompletes. 28 The bill directs the board of educational examiners to 29 assign a consultant to be the single point of contact for an 30 applicant who is licensed by another state or country and who 31 is the spouse of a military person who is on duty or in active 32 state duty. 33 The bill directs the department of education, in 34 collaboration with the state board of regents, to convene a 35 -4- LSB 5248XS (9) 83 kh/sc 4/ 5
