assistance

personal
needs
allowance

of
living

.

The
personal
needs
allowance
under
the
medical
assistance
5
program,
which
may
be
retained
by
a
person
who
is
a
resident
6
of
a
nursing
facility,
an
intermediate
care
facility
for
7
persons
with
mental
retardation,
or
an
intermediate
care
8
facility
for
persons
with
mental
illness,
as
defined
in
9
section
135C.1,
or
a
person
who
is
a
resident
of
a
psychiatric
10
medical
institution
for
children
as
defined
in
section
135H.1,
11
shall
be
fifty
dollars
per
month.
Beginning
January
1,
2011,
12
the
personal
needs
allowance
for
such
residents
shall
be
13
increased
annually,
on
January
1,
by
the
same
percentage
as
14
the
most
recent
cost
of
living
adjustment
announced
by
the
15
United
States
social
security
administration
for
the
purpose
16
of
determining
social
security
benefits.
A
resident
who
has
17
income
of
less
than
fifty
dollars
the
amount
specified
by
this
18
section
per
month
shall
receive
a
supplement
from
the
state
in
19
the
amount
necessary
to
receive
a
personal
needs
allowance
of
20
fifty
dollars
the
amount
specified
per
month,
if
funding
is
21
specifically
appropriated
for
this
purpose.

EXPLANATION
23
This
bill,
beginning
January
1,
2011,
provides
for
a
cost
of
24
living
increase,
annually,
on
January
1,
in
the
personal
needs
25
allowance
under
the
medical
assistance
program
which
may
be
26
retained
by
a
resident
of
a
nursing
facility,
an
intermediate
27
care
facility
for
persons
with
mental
retardation,
or
an
28
intermediate
care
facility
for
persons
with
mental
illness,
29
or
who
is
a
resident
of
a
psychiatric
medical
institution
for
30
children.
The
personal
needs
allowance,
currently
$50,
is
to
31
be
increased
by
the
same
percentage
as
the
most
recent
cost
32
of
living
adjustment
announced
by
the
United
States
social
33
security
administration
for
the
purpose
of
determining
social
34
security
benefits.
