1.
Section
103A.8A,
Code
Supplement
2009,
is

amended
to
read
as
follows:

103A.8A
Energy
conservation
requirements.
3
The
state
building
code
commissioner
shall
adopt
as
a
part
of
4
the
state
building
code
a
requirement
that
new
single-family
5
or
two-family
residential
construction
shall
comply
with
6
energy
conservation
requirements.
The
requirements
adopted
by
7
the
commissioner
shall
be
based
upon
a
nationally
recognized
8
standard
or
code
for
energy
conservation.
The
requirements
9
shall
only
apply
to
single-family
or
two-family
residential
10
construction
commenced
after
the
adoption
of
the
requirements.
11
Notwithstanding
any
other
provision
of
this
chapter
to
the
12
contrary,
the
energy
conservation
requirements
adopted
by
13
the
commissioner
and
approved
by
the
council
shall
apply
to
14
new
single-family
or
two-family
residential
construction
15
commenced
on
or
after
July
1,
2008,
and
to
all
single-family
16
or
two-family
residential
construction
commenced
on
or
after
17
July
1,
2010,
and
shall
supersede
and
replace
any
minimum
18
requirements
for
energy
conservation
adopted
or
enacted
by
a
19
governmental
subdivision
prior
to
that
date
applicable
to
such
20
construction.
The
state
building
code
commissioner
may
provide
21
training
to
builders,
contractors,
building
officials,
persons
22
who
may
in
the
course
of
their
employment
be
responsible
23
for
interpreting
or
enforcing
adopted
energy
conservation
24
requirements,
and
other
interested
persons
on
the
adopted
25
energy
conservation
requirements.

Sec.
2.
Section
103A.10,
subsection
5,
Code
2009,
is
amended
27
to
read
as
follows:

Notwithstanding
any
other
provision
of
this
chapter
to
29
the
contrary,
the
energy
conservation
requirements
adopted
by
30
the
commissioner
and
approved
by
the
council
shall
apply
to
all
31
new
construction
commenced
on
or
after
July
1,
2008,
subject

to
the
provisions
relating
to
single-family
and
two-family
33
residential
construction
contained
in
section
103A.8A,
and
34
shall
supersede
and
replace
any
minimum
requirements
for
energy

EXPLANATION
3
This
bill
relates
to
energy
conservation
requirements
4
contained
within
the
state
building
code.
Code
chapter
5
103A
requires
new
single-family
or
two-family
residential
6
construction
commenced
on
or
after
July
1,
2008,
to
comply
7
with
energy
conservation
requirements
adopted
by
the
state
8
building
code
commissioner.
“New
construction”,
as
defined
in
9
the
Code
chapter,
is
expressly
made
inapplicable
to
building
10
renovations
and
repairs.

The
bill
amends
Code
section
103A.8A
to
provide
that
all
12
single-family
or
two-family
residential
construction
on
or
13
after
July
1,
2010,
shall
comply
with
the
energy
conservation
14
requirements,
extending
the
requirements
to
existing
residence
15
renovations
and
repairs.
The
bill
makes
conforming
changes
16
consistent
with
this
modification.
17
The
bill
additionally
expands
the
list
of
individuals
18
specifically
mentioned
in
Code
section
103A.8A
for
whom
19
the
commissioner
may
provide
training
on
the
adopted
energy
20
conservation
requirements
to
include
building
officials
21
and
persons
who
may
in
the
course
of
their
employment
be
22
responsible
for
interpreting
or
enforcing
the
requirements.
