S.F. 2023 Section 1. Section 403.16, unnumbered paragraph 1, Code 1 2009, is amended to read as follows: 2 No public official or employee of a municipality, or board 3 or commission thereof, who has been vested by a municipality 4 with urban renewal project powers under section 403.14, and 5 no commissioner or employee of an urban renewal agency, which 6 has been vested by a municipality with urban renewal project 7 powers under section 403.14, shall voluntarily acquire any 8 personal interest, as hereinafter defined, whether direct or 9 indirect, in any urban renewal project, or in any property 10 included or planned to be included in any urban renewal project 11 of such municipality, or in any contract or proposed contract 12 in connection with such urban renewal project. Where such 13 acquisition is not voluntary, the interest acquired shall 14 be immediately disclosed in writing to the local governing 15 body, and such disclosure shall be entered upon the minutes 16 of the governing body. If any such official, commissioner or 17 employee presently owns or controls, or has owned or controlled 18 within the preceding two years, any interest, as hereinafter 19 defined, whether direct or indirect, in any property which 20 the official, commissioner or employee knows is included 21 or planned to be included in an urban renewal project, the 22 official, commissioner or employee shall immediately disclose 23 this fact in writing to the local governing body, and such 24 disclosure shall be entered upon the minutes of the governing 25 body; and any such official, commissioner or employee shall 26 not participate in any action by the municipality, or board 27 or commission thereof, or urban renewal agency affecting such 28 property, as the terms of such proscription are hereinafter 29 defined. For the purposes of this section the following 30 definitions and standards of construction shall apply: 31 EXPLANATION 32 Current Code section 403.16 provides that no public official 33 or employee of a municipality, or board or commission of a 34 municipality, and no commissioner or employee of an urban 35 -1- LSB 5591XS (2) 83 md/nh 1/ 2

S.F. 2023 renewal agency, which has been vested by a municipality with 1 urban renewal project powers, shall voluntarily acquire any 2 direct or indirect personal interest in any urban renewal 3 project, including any property or contract in connection with 4 such urban renewal project. This bill specifies that only 5 those public officials and employees of a municipality who have 6 been vested by a municipality with urban renewal project powers 7 are restricted from acquiring a personal interest in connection 8 with an urban renewal project. 9 -2- LSB 5591XS (2) 83 md/nh 2/ 2
