S.F. 2022 Section 1. Section 105.2, subsection 1, Code Supplement 1 2009, is amended to read as follows: 2 1. “Apprentice” means any person, other than a helper, 3 journeyperson, or master, who, as a principal occupation, 4 is engaged in working as an employee of a plumbing, HVAC, 5 refrigeration, or hydronic systems contractor under the 6 supervision of either a master or a journeyperson and is 7 progressing toward completion of an apprenticeship training 8 program registered by the office of apprenticeship of the 9 United States department of labor while learning and assisting 10 in the design, installation, and repair of plumbing, HVAC, 11 refrigeration, or hydronic systems, as applicable. 12 Sec. 2. Section 105.9, subsection 1, Code Supplement 2009, 13 is amended to read as follows: 14 1. The board shall set the fees for the examination of all 15 applicants, by rule, which fees shall be based upon the cost 16 of administering the examinations. However, the fee for an 17 apprentice examination shall be set at seventy-five dollars. 18 Sec. 3. Section 105.18, subsection 2, paragraph a, 19 subparagraph (3), Code Supplement 2009, is amended to read as 20 follows: 21 (3) Be enrolled in an applicable apprentice program which is 22 registered with the United States department of labor office 23 of apprenticeship . 24 Sec. 4. Section 105.18, subsection 2, paragraph b, 25 subparagraph (1), subparagraph division (c), Code Supplement 26 2009, is amended to read as follows: 27 (c) Provide the board with evidence of having completed 28 at least four years of practical experience as an apprentice. 29 Commencing January 1, 2010, the four years of practical 30 experience required by this subparagraph division must be an 31 apprenticeship training program registered by the United States 32 department of labor office of apprenticeship. 33 Sec. 5. Section 105.18, subsection 2, paragraph b, 1 subparagraph (1), Code Supplement 2009, is amended by adding 2 -1- LSB 5478SS (4) 83 jr/sc 1/ 2
S.F. 2022 the following new subparagraph division: 3 NEW SUBPARAGRAPH DIVISION . (d) In lieu of subparagraph 4 division (c), provide the board with evidence of having passed 5 the state apprentice examination in the applicable discipline 6 and of having completed at least two years of practical 7 experience as an apprentice. 8 Sec. 6. Section 105.20, subsection 6, Code Supplement 2009, 9 is amended by striking the subsection and inserting in lieu 10 thereof the following: 11 6. The board shall not establish continuing education 12 requirements as a condition to license renewal, notwithstanding 13 the provisions of section 272C.2. 14 Sec. 7. Section 272C.2, subsection 1, Code Supplement 2009, 15 is amended to read as follows: 16 1. Each Except as otherwise provided by law, each licensing 17 board shall require and issue rules for continuing education 18 requirements as a condition to license renewal. 19 EXPLANATION 20 This bill makes changes relating to training and licensure 21 under Code chapter 105, the Iowa Plumber, Mechanical 22 Professional, and Contractor Licensing Act. 23 Currently, an apprentice working on the installation and 24 repair of plumbing, HVAC, refrigeration, or hydronic systems 25 must be enrolled in an applicable apprentice program that is 26 registered with the United States department of labor’s office 27 of apprenticeship. This bill eliminates the requirement that 28 the program be registered with the federal government. 29 The bill also allows an apprentice seeking a journeyperson 30 license to test out of the four-year apprenticeship after 31 completing two years. The bill sets the fee for this 32 examination at $75. 33 The bill eliminates the requirement that licensees under 34 Code chapter 105 meet any continuing education requirements as 35 a condition of licensure renewal. 1 -2- LSB 5478SS (4) 83 jr/sc 2/ 2
