S.F. 2018 Section 1. Section 384.24, subsection 3, Code Supplement 1 2009, is amended by adding the following new paragraph: 2 NEW PARAGRAPH . y. The acquisition, construction, 3 reconstruction, enlargement, improvement, and equipping of a 4 facility that is intended to be or that is currently being 5 used for two or more of the purposes listed in subsection 4, 6 paragraph “c” , and the acquisition of real estate therefor, if 7 the city has a population of five thousand or less. 8 Sec. 2. Section 384.24, subsection 4, paragraph c, Code 9 Supplement 2009, is amended to read as follows: 10 c. The Except as otherwise provided in subsection 3 , 11 paragraph “y” , the acquisition, construction, reconstruction, 12 enlargement, improvement, and equipping of city halls, jails, 13 police stations, fire stations, garages, libraries, ambulance 14 service facilities, and hospitals, including buildings to be 15 used for any combination of the foregoing purposes, and the 16 acquisition of real estate therefor. 17 EXPLANATION 18 This bill amends the definition of “essential corporate 19 purpose” to include the acquisition, construction, 20 reconstruction, enlargement, improvement, and equipping of a 21 facility that is intended to be or that is currently being 22 used for two or more specified purposes, and the acquisition 23 of real estate therefor, if the city has a population of 5,000 24 or less. The specified purposes include city halls, police 25 stations, fire stations, garages, libraries, ambulance service 26 facilities, and hospitals. A city council may approve the 27 issuance of general obligation bonds to carry out an essential 28 corporate purpose without approval by voters at an election. 29 The bill also amends the definition of “general corporate 30 purpose” to include ambulance service facilities. 31 -1- LSB 5125XS (10) 83 md/sc 1/ 1
