the

the
all-terrain
vehicle.

is
amended
by
adding

the
following
new
subsection:

.
2A.
The
motor
vehicle
laws
and
penalties
11
applicable
to
operators
of
motor
vehicles
pursuant
to
this
12
chapter
apply
to
a
person
operating
an
all-terrain
vehicle
on
a
13
public
highway
to
the
extent
practically
applicable.

EXPLANATION
15
This
bill
eases
restrictions
on
the
operation
of
all-terrain
16
vehicles
on
public
highways.
Currently,
an
all-terrain
vehicle
17
may
not
be
operated
on
a
highway
except
for
agricultural
18
purposes
during
daylight
hours;
for
land
surveying
by
a
19
licensed
engineer
or
land
surveyor;
by
an
employee
of
a
20
political
subdivision
or
public
utility
for
construction
or
21
maintenance
purposes;
by
an
employee
or
agent
of
a
public
22
agency
for
the
provision
of
emergency
services
or
rescue;
23
or
for
the
purpose
of
mowing,
installing
trail
signs,
24
or
performing
maintenance
on
a
designated
snowmobile
or
25
all-terrain
vehicle
trail.

The
bill
allows
a
person
to
operate
an
all-terrain
vehicle
27
between
sunrise
and
sunset
on
a
highway
within
a
city
with
28
a
population
of
6,000
or
less
or
on
a
secondary
road
not
29
more
than
four
miles
from
the
residence
of
the
owner
of
the
30
all-terrain
vehicle.

The
bill
specifies
that
a
person
operating
an
all-terrain
32
vehicle
on
a
public
highway
is
subject
to
the
motor
vehicle
33
laws
and
penalties
applicable
to
operators
of
motor
vehicles,
34
to
the
extent
those
laws
and
penalties
are
applicable.

Pursuant
to
current
law,
a
violation
of
provisions
specific
1
to
the
use
of
all-terrain
vehicles
on
a
highway
is
a
simple
2
misdemeanor
punishable
by
a
scheduled
fine
of
$50.
