REALIZED COST SAVINGS —— PRIVATE BUILDINGS. During 8 the fiscal year beginning July 1, 2010, the department of 9 natural resources shall realize cost savings to every extent 10 legally possible by complying with executive order number 11 20 issued December 16, 2009, and as described in the Iowa 12 efficiency review report submitted by the public works limited 13 liability corporation, by providing staff office space for the 14 department in the Wallace building, and relinquishing any space 15 in a private building subject to an expired lease. 16 Sec. 6. REALIZED COST SAVINGS —— VOLUNTEER AND INTERN 17 PROGRAMS AT STATE PARKS. During the fiscal year beginning July 18 1, 2010, the department of natural resources shall realize cost 19 savings to every extent possible by complying with executive 20 order number 20 issued December 16, 2009, and as described in 21 the Iowa efficiency review report submitted by the public works 22 limited liability corporation, by increasing the number of 23 volunteer and intern programs at state parks. 24 Sec. 7. STATE FISH AND GAME PROTECTION FUND —— DIVISION OF 25 FISH AND WILDLIFE. 26 1. a. The department shall not expend more moneys from the 8 state fish and game protection fund than provided in this 9 section, unless the expenditure derives from contributions made 10 by a private entity, or a grant or moneys received from the 11 federal government, and is approved by the natural resource 12 commission. The department of natural resources shall promptly 13 notify the legislative services agency and the chairpersons and 14 ranking members of the joint appropriations subcommittee on 15 agriculture and natural resources concerning the commission’s 16 approval. 17 Sec. 8. Notwithstanding any contrary provision of 16 state law, for the fiscal year beginning July 1, 2010, and 17 ending June 30, 2011, the department of natural resources may 18 use additional moneys available to the department collected 19 from storm water discharge permit fees as provided in section 20 455B.103A or 455B.197 for the staffing of the following 21 additional full-time equivalent positions for the purposes 22 designated: 23 1. INTERIM STUDY OF PUBLIC LAND UNDER THE CONTROL 30 OF THE DEPARTMENT OF NATURAL RESOURCES WHICH MAY BE USED FOR 31 PUBLIC HUNTING. The department of natural resources shall 32 conduct an interim study of public land under its control which 33 may be used for public hunting. The department shall authorize 34 public hunting on public land for which the department 35 -5- LSB 5088JB (4) 83 da/jp 5/ 16
S.F. _____ H.F. _____ determines such activity is beneficial. The department shall 1 report the results of the interim study to the governor and 2 general assembly by January 10, 2011. 3 Sec. 13. ELIMINATION OF CHIEF AND ASSISTANT CHIEF OF THE LAW 4 ENFORCEMENT BUREAU OF THE DEPARTMENT OF NATURAL RESOURCES. The 5 positions of chief and assistant chief of the law enforcement 6 bureau of the department of natural resources are eliminated. 7 Sec. 14. EFFECTIVE UPON ENACTMENT. The section of this 8 division of this Act relating to the elimination of the 9 positions of chief and assistant chief of the law enforcement 10 bureau of the department of natural resources, being deemed of 11 immediate importance, takes effect upon enactment. 12 DIVISION III 13 IOWA STATE UNIVERSITY 14 Sec. 15. GENERAL FUND —— VETERINARY DIAGNOSTIC LABORATORY. 15 1. If by the end of the fiscal year, Iowa state university 1 of science and technology fails to allocate the moneys 2 appropriated in this section to the college of veterinary 3 medicine in accordance with this section, the moneys 4 appropriated in this section for that fiscal year shall revert 5 to the general fund of the state. 6 Sec. 16. VETERINARY DIAGNOSTIC LABORATORY —— FUTURE 7 YEAR. This section applies if appropriations made in this Act 8 and all other Acts enacted by the Eighty-third General Assembly 9 during the 2010 regular session and all extraordinary sessions, 10 for the fiscal year beginning July 1, 2010, and ending June 11 30, 2011, for purposes of supporting the operation of the 12 veterinary diagnostic laboratory associated with the college 13 of veterinary medicine at Iowa state university, total less 14 than $4,000,000. It is the intent of the general assembly 15 that the amount of any deficit will be appropriated by the 16 general assembly during its 2011 regular session for purposes 17 of supporting the operation of the veterinary diagnostic 18 laboratory for the fiscal year beginning July 1, 2011, and 19 ending June 30, 2012. 20 DIVISION IV 21 ENVIRONMENT FIRST FUND —— GENERAL APPROPRIATIONS 22 Sec. 17. DEPARTMENT OF AGRICULTURE AND LAND 23 STEWARDSHIP. Notwithstanding section 8.33, moneys 3 appropriated for the fiscal year beginning July 1, 2010, 4 in this division of this Act that remain unencumbered or 5 unobligated at the close of the fiscal year shall not revert 6 but shall remain available for the purposes designated until 7 the close of the fiscal year beginning July 1, 2011, or until 8 the project for which the appropriation was made is completed, 9 whichever is earlier. 10 DIVISION V 11 ENVIRONMENT FIRST FUND —— RESOURCES ENHANCEMENT 12 AND PROTECTION (REAP) 13 Sec. 20. IOWA RESOURCES ENHANCEMENT AND PROTECTION 14 FUND. Notwithstanding the amount of the standing appropriation 15 from the general fund of the state to the Iowa resources 16 enhancement and protection fund as provided in section 17 455A.18, there is appropriated from the environment first fund 18 created in section 8.57A to the Iowa resources enhancement 19 and protection fund, in lieu of the appropriation made in 20 section 455A.18, for the fiscal year beginning July 1, 2010, 21 and ending June 30, 2011, the following amount, to be allocated 22 as provided in section 455A.19: 23 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 15,000,000 24 Sec. 21. FUTURE USE OF MONEYS IN THE IOWA RESOURCES 25 ENHANCEMENT FUND. It is the intent of the general assembly 26 that on and after July 1, 2011, moneys deposited in the Iowa 27 resources enhancement and protection fund as provided in 28 section 455A.18 shall not be used to pay for Honey creek park 29 bond obligations. 30 DIVISION VI 31 MISSISSIPPI RIVER BASIN HEALTHY 32 WATERSHEDS INITIATIVE 33 Sec. 22. S.F. _____ H.F. _____ stewardship. 1 2. “Fund” means the Mississippi river basin healthy 2 watersheds initiative fund created pursuant to section 161G.2. 3 Sec. 23. NEW SECTION . 161G.2 Mississippi river basin 4 healthy watersheds initiative fund. 5 1. A Mississippi river basin healthy watersheds initiative 6 fund is created within the department. 7 2. The fund is composed of money appropriated by the general 8 assembly to the fund, and moneys available to and obtained or 9 accepted by the department from the United States, the state, 10 or a private source for placement in the fund. 11 3. The fund shall be used by the department to support 12 the Mississippi river basin healthy watersheds initiative as 13 provided in section 161G.3. 14 4. The moneys in the fund are not subject to section 8.33 15 and shall not be transferred, used, obligated, appropriated, 16 or otherwise encumbered except as provided in this section. 17 Notwithstanding section 12C.7, subsection 2, interest or 18 earnings on moneys in the fund shall be credited to the fund. 19 Sec. 24. NEW SECTION . 161G.3 Mississippi river basin 20 healthy watersheds initiative. 21 1. The department shall implement a voluntary program to 22 assist in improving the health of the Mississippi river basin, 23 including water quality and wildlife habitat. 24 2. The department shall implement the program consistent 25 with requirements of the United States department of 26 agriculture in its administration of the Mississippi river 27 basin healthy watersheds initiative. 28 3. To the extent allowed by the United States department of 29 agriculture, the department of agriculture and land stewardship 30 may do all of the following: 31 a. Provide for conservation systems that manage and optimize 32 nitrogen and phosphorous within fields to minimize runoff and 33 reduce downstream nutrient loading. 34 b. Assist agricultural producers with a system of practices 35 -13- LSB 5088JB (4) 83 da/jp 13/ 16
S.F. _____ H.F. _____ that will control soil erosion, improve soil quality, restore 1 and enhance wildlife habitat, and manage runoff and drainage 2 water for improved water quality. 3 c. Avoid, control, and trap nutrient runoff and maintain 4 agricultural productivity. 5 d. Partner with landowners to implement a range of 6 land stewardship practices, including but not limited to 7 conservation tillage, nutrient management, and other innovative 8 practices. 9 EXPLANATION 10 GENERAL. This bill relates to agriculture and natural 11 resources by making appropriations for the 2010-2011 fiscal 12 year to support related entities, including the department of 13 agriculture and land stewardship, the department of natural 14 resources, and Iowa state university. 15 The bill appropriates moneys to the department of 16 agriculture and land stewardship and the department of natural 17 resources. The appropriations are made to support those 18 departments for administration, regulation, and programs. The 19 bill requires the departments to submit quarterly reports to 20 the general assembly and department of management regarding the 21 expenditure of appropriated moneys. The bill also provides 22 moneys to support specific programs or projects administered by 23 those departments. The bill appropriates moneys from a number 24 of sources, including the general fund of the state, the state 25 fish and game protection fund, and the groundwater protection 26 fund. The bill is organized into divisions. 27 DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP. For the 28 department of agriculture and land stewardship, moneys are 29 appropriated in order to support its divisions. 30 The bill appropriates moneys from the general fund to 31 support designated programs, including horse and dog racing, 32 and motor fuel inspection. 33 DEPARTMENT OF NATURAL RESOURCES. For the department of 34 natural resources, moneys are appropriated from the general 35 -14- LSB 5088JB (4) 83 da/jp 14/ 16
S.F. _____ H.F. _____ fund in order to support its divisions. 1 The bill makes appropriations from other funds. The bill 2 appropriates moneys to the department of natural resources from 3 the state fish and game protection fund to support programs 4 related to fish and wildlife. The bill appropriates moneys 5 from the groundwater protection fund to support groundwater 6 quality. The bill appropriates moneys from the snowmobile fund 7 to the department for snowmobile programs. 8 The bill includes miscellaneous provisions. An 9 appropriation is made from the unassigned revenue fund 10 administered by the Iowa comprehensive underground storage 11 tank fund board to the department of natural resources for 12 administration and expenses of the underground storage tank 13 section. 14 The bill provides that the department of natural 15 resources may use additional funds for staffing to reduce the 16 department’s floodplain permit backlog and implementing the 17 federal maximum daily load program. 18 The bill requires the department of natural resources 19 to realize cost savings by relinquishing space at private 20 buildings and increasing the number of volunteer and interim 21 programs. 22 The bill requires the department of natural resources to 23 conduct an interim study of public land under its control which 24 may be used for public hunting. 25 The bill eliminates the positions of chief and assistant 26 chief of the law enforcement bureau of the department of 27 natural resources. 28 IOWA STATE UNIVERSITY. The bill appropriates moneys from 29 the general fund of the state for the operation of the Iowa 30 state university’s veterinary diagnostic laboratory. It 31 includes provisions expressing legislative intent for a future 32 appropriation for the diagnostic laboratory. 33 ENVIRONMENT FIRST FUND —— GENERAL APPROPRIATIONS. A nonreversion clause authorizes the 3 appropriations made in this division to be carried forward into 4 the succeeding fiscal year. 5 ENVIRONMENT FIRST FUND —— RESOURCE ENHANCEMENT AND 6 PROTECTION.
