H.F. _____ Section 1. REPEAL. Sections 73.3 and 73.4, Code 2009, are 1 repealed. 2 Sec. 2. Section 331.341, subsection 2, Code 2009, is amended 3 to read as follows: 4 2. The board shall give preference to Iowa products and 5 labor in accordance with chapter 73 and shall comply with bid 6 and contract requirements in chapter 26. 7 Sec. 3. APPLICABILITY. This Act applies to all public 8 improvements and public improvement contracts entered into on 9 or after July 1, 2010. 10 EXPLANATION 11 This bill repeals Code section 73.3, which directs all 12 governmental entities to give preference to Iowa labor in the 13 constructing or building of public improvements, and requires 14 every contract entered into by a governmental entity for such 15 work to contain a provision requiring that preference be given 16 to Iowa domestic labor in the constructing or building of such 17 public improvement. 18 The bill also repeals Code section 73.4, which defines 19 “domestic laborer”. The definition is only used in Code 20 section 73.3, which is being repealed. 21 The bill makes a conforming change to Code section 331.341, 22 subsection 2. 23 The bill applies to all public improvements and public 24 improvement contracts entered into on or after July 1, 2010. 25 -1- LSB 6200HC (2) 83 ak/nh 1/ 1
