an

disallowed

the
employee
was
contributing

investment
option
at
the
time
the
department
discontinued

the
investment
option
within
the
eligible
retirement
plan

an
eligible
retirement
plan

an

option

the
employee

contributing
to
that
investment
option
at
the
time
the

employer
discontinued
the
investment
option
within
the
eligible

retirement
plan
offered
by
the
employer.

EXPLANATION

This
bill
concerns
investment
options
provided
employees

within
an
eligible
retirement
plan
offered
by
the
department
of

administrative
services
or
by
a
private
employer.

The
bill
defines
an
eligible
retirement
plan
as
a
retirement
1
plan
that
is
qualified
under
sections
401,
403,
408,
and
457
of

the
Internal
Revenue
Code.
The
bill
also
defines
an
authorized

investment
option
as
an
option
that
can
be
offered
to
employees
4
through
an
eligible
retirement
plan.

The
bill
provides
that
an
employer
offering
an
eligible
6
retirement
plan
to
employees
shall
not
discontinue
or
disallow
7
contributions
by
an
employee
to
an
authorized
investment
option
8
if
the
employee
was
contributing
to
that
investment
option
at

the
time
the
employer
discontinued
the
investment
option
within

the
plan
offered
by
the
employer.
This
provision
relative

to
employers
is
also
made
applicable
to
plans
offered
by
the
12
state.
