H.F. _____ Section 1. Section 123.30, subsection 3, paragraph e, 1 subparagraph (1), Code Supplement 2009, is amended to read as 2 follows: 3 (1) A class “E” liquor control license may be issued and 4 shall authorize the holder to purchase alcoholic liquor from 5 the division only and to sell the alcoholic liquor to patrons 6 for consumption off the licensed premises and to other liquor 7 control licensees. A class “E” license shall not be issued to 8 premises at which gasoline is sold. A holder of a class “E” 9 liquor control license may hold other retail liquor control 10 licenses or retail wine or beer permits, but the premises 11 licensed under a class “E” liquor control license shall be 12 separate from other licensed premises, though the separate 13 premises may have a common entrance. However, the holder of 14 a class “E” liquor control license may also hold a class “B” 15 wine or class “C” beer permit or both for the premises licensed 16 under a class “E” liquor control license. 17 EXPLANATION 18 This bill allows a class “E” liquor control license to be 19 issued to a premises at which gasoline is sold.
