H.F. _____ Section 1. GREEN CERTIFICATION PROGRAM AND GREEN ADVISORY 1 COMMITTEE —— PURPOSE. 2 1. The purpose for the creation of the green advisory 3 committee and the green certification program pursuant to this 4 Act is to enhance efforts to promote environmental stewardship 5 by encouraging responsible environmental management and 6 recycling. 7 2. The general assembly finds and declares all of the 8 following: 9 a. The green advisory committee is urged to further 10 the policy of responsible environmental management by 11 encouraging recycling projects that operate in an innovative, 12 cost-effective, technologically advanced, and environmentally 13 sensitive manner. 14 b. The concept of environmental stewardship embraces every 15 aspect of the environmental footprint left by the creation and 16 use of disposable goods and every effort should be made to 17 recycle and reuse such goods in an environmentally responsible 18 way. 19 c. Managing recycling can help to mitigate the climate 20 change impacts by reducing the amount of greenhouse gases 21 released into the atmosphere and improving water quality. 22 d. The goal of managing resources in a sustainable manner 23 is to increase the benefits to communities and society for the 24 present and for the future. 25 Sec. 2. NEW SECTION . 455D.51 Green certification program —— 26 green advisory committee. 27 1. a. A green advisory committee is established. The 28 department shall provide staffing for the advisory committee. 29 The advisory committee shall do all of the following: 30 (1) By January 1, 2011, provide written recommendations to 31 the commission for purposes of creating a green certification 32 program as provided in subsection 2. 33 (2) By January 1, 2011, provide written recommendations to 34 the department regarding criteria for creating the recycling 35 -1- LSB 5871HC (5) 83 tm/nh 1/ 5
H.F. _____ vendor and resource green list as provided in subsection 3. 1 (3) By January 1, 2011, provide written recommendations to 2 the department regarding possible funding options to support 3 the activities in subsection 4. 4 (4) Beginning January 1, 2011, meet at least once a year for 5 purposes of reviewing the green certification program and the 6 criteria for the recycling vendor and resource green list. 7 b. The advisory committee shall consist of the following 8 voting members: 9 (1) Three members nominated by the Iowa recycling 10 association. One member shall have expertise in the recycling 11 of paper and cardboard, one member shall have expertise in 12 the recycling of plastic and glass, and one member shall have 13 expertise in the recycling of metals that are not located in or 14 that are not from a scrapyard. 15 (2) One member nominated by the Iowa society of solid waste 16 operations. 17 (3) Three members nominated by the Iowa society of solid 18 waste operations representing solid waste planning areas of 19 various sizes and from various locations across the state. 20 (4) One member nominated by the Iowa league of cities. 21 (5) One member nominated by the solid waste association 22 of north America representing private solid waste disposal 23 entities. The member shall have expertise in the hauling of 24 solid waste. 25 (6) The director of the department of natural resources, or 26 the director’s designee. 27 (7) One member nominated by the Iowa environmental council. 28 (8) One member nominated by the league of women voters of 29 Iowa. 30 (9) One member nominated by the Iowa wholesale beer 31 distributors association. 32 (10) One member nominated by the Iowa beverage association 33 representing juice and soft drink distributors. 34 (11) One member nominated by the Iowa bottle bill coalition 35 -2- LSB 5871HC (5) 83 tm/nh 2/ 5
H.F. _____ representing independent redemption centers. 1 (12) One member nominated by the Iowa state association of 2 counties. 3 (13) One member nominated by the Iowa farm bureau 4 federation. 5 (14) One member nominated by the Iowa association of 6 business and industry. 7 (15) One member nominated by the home builders association 8 of Iowa. 9 (16) The director of the alcoholic beverages division of the 10 department of commerce, or the director’s designee. 11 (17) One member nominated by keep Iowa beautiful. 12 (18) One member nominated by the Iowa grocery industry 13 association. 14 (19) One member nominated by the Iowa dairy foods 15 association. 16 (20) One member nominated by the petroleum marketers and 17 convenience stores of Iowa. 18 (21) One member nominated by the Iowa retail federation. 19 (22) One member nominated by the Iowa wine growers 20 association. 21 (23) The director of transportation, or the director’s 22 designee. 23 (24) One member nominated by the Iowa division of the Izaak 24 Walton league. 25 (25) One member nominated by the American chemistry 26 council. 27 (26) One member nominated by the Iowa chapter of the sierra 28 club. 29 (27) One member representing the brewer industry who is a 30 member of the beer institute and who sells beer in Iowa and 31 surrounding states. 32 c. The voting members shall be appointed by the governor 33 in compliance with the requirements of sections 69.16, 69.16A, 34 and 69.19. H.F. _____ shall be staggered at the discretion of the governor. 1 d. The advisory committee shall annually elect a 2 chairperson. A majority of the members of the advisory 3 committee shall constitute a quorum. 4 e. The members of the advisory committee shall be reimbursed 5 for actual and necessary expenses incurred by them in the 6 discharge of their official duties. 7 2. The commission shall adopt rules to establish a green 8 certification program to be administered by the department. As 9 used in this section, “green certification” means certification 10 granted by the department to a business that meets certain 11 minimum requirements or standards in waste reduction, reuse, 12 and recycling. The commission shall collaborate with the green 13 advisory committee in creating the program. 14 3. The department shall develop, publish, and make 15 electronically available a recycling vendor and resource green 16 list. The list shall identify vendors, contacts, and resources 17 who meet certain criteria for providing recycling services. 18 The department shall collaborate with the green advisory 19 committee in determining the criteria for the list. 20 4. The department shall develop and implement an ongoing, 21 statewide communication and outreach educational resource 22 program regarding recycling. 23 EXPLANATION 24 This bill relates to recycling initiatives. 25 The bill establishes a green advisory committee appointed 26 by the governor to provide written recommendations to the 27 environmental protection commission for purposes of creating a 28 green certification program, to provide written recommendations 29 to the department of natural resources regarding criteria 30 for creating a recycling vendor and resource green list, to 31 provide written recommendations to the department regarding 32 possible funding options to support the educational activities 33 of the department in the area of recycling, and periodically 34 review the green certification program and the criteria for the 35 -4- LSB 5871HC (5) 83 tm/nh 4/ 5
