H.F. _____ Section 1. NEW SECTION . 455B.174A Watershed quality 1 planning advisory council. 2 1. The department of natural resources, in cooperation 3 with the department of agriculture and land stewardship, shall 4 establish a watershed quality planning advisory council. The 5 advisory council shall consist of all of the following members: 6 a. The voting members of the advisory council shall include 7 all of the following: 8 (1) One member selected by the Iowa association of municipal 9 utilities. 10 (2) One member selected by the Iowa league of cities. 11 (3) One member selected by the Iowa association of business 12 and industry. 13 (4) One member selected by the Iowa water pollution control 14 association. 15 (5) One member selected by the Iowa rural water association. 16 (6) One member selected by growing green communities. 17 (7) One member selected by the Iowa environmental council. 18 (8) One member selected by the Iowa farm bureau federation. 19 (9) One member selected by the Iowa corn growers 20 association. 21 (10) One member selected by the Iowa soybean association. 22 (11) One member selected by the Iowa pork producers council. 23 (12) One member selected by the soil and water conservation 24 districts of Iowa. 25 (13) One person representing the department of agriculture 26 and land stewardship selected by the secretary of agriculture. 27 (14) One person representing the department of natural 28 resources selected by the director. 29 (15) Two members selected by the Iowa conservation 30 alliance. 31 b. The nonvoting members of the advisory council shall 32 include all of the following: 33 (1) Two members of the senate. One senator shall be 34 appointed by the majority leader of the senate and one senator 35 -1- LSB 6179HC (5) 83 tm/rj 1/ 3
H.F. _____ shall be appointed by the minority leader of the senate. 1 (2) Two members of the house of representatives. One 2 member shall be appointed by the speaker of the house of 3 representatives and one member shall be appointed by the 4 minority leader of the house of representatives. 5 2. By December 1 of each year, the advisory council 6 shall report to the governor and the general assembly its 7 recommendations regarding all of the following: 8 a. Improving water quality and optimizing the costs of 9 voluntarily achieving and maintaining water quality standards. 10 b. Creating economic incentives for voluntary nonpoint 11 source load reductions, point source discharge reductions 12 beyond those required by the federal Water Pollution Control 13 Act, implementation of pollution prevention programs, wetland 14 restoration and creation, and the development of emerging 15 pollution control technologies. 16 c. Facilitating the implementation of total maximum daily 17 loads, urban storm water control programs, and nonpoint source 18 management practices required or authorized under the federal 19 Water Pollution Control Act. This paragraph shall not be 20 construed to obviate the requirement to develop a total maximum 21 daily load for waters that do not meet water quality standards 22 as required by section 303(d) of the federal Water Pollution 23 Control Act or to delay implementation of a total maximum daily 24 load that has been approved by the department and the director. 25 d. Providing incentives for the development of new and 26 more accurate and reliable pollution control quantification 27 protocols and procedures. 28 e. Providing greater flexibility through community-based, 29 nonregulatory, and performance-driven watershed management 30 planning. 31 3. The department of natural resources shall provide 32 necessary staff assistance to the advisory council. 33 4. Members of the advisory council shall be reimbursed for 1 actual and necessary expenses incurred by them in the discharge 2 of their official duties. 3 EXPLANATION 4 This bill relates to a watershed quality planning advisory 5 council. 6 The bill requires the department of natural resources, 7 in cooperation with the department of agriculture and land 8 stewardship, to establish a watershed quality planning advisory 9 council. 10 The bill requires, by December 1 of each year, the advisory 11 council to report to the governor and the general assembly 12 its recommendations regarding improving water quality and 13 optimizing the costs of voluntarily achieving and maintaining 14 water quality standards; creating economic incentives for 15 voluntary nonpoint source load reductions, point source 16 discharge reductions beyond those required by the federal Water 17 Pollution Control Act, implementation of pollution prevention 18 programs, wetland restoration and creation, and the development 19 of emerging pollution control technologies; facilitating the 20 implementation of total maximum daily loads, urban storm water 21 control programs, and nonpoint source management practices 22 required or authorized under the federal Water Pollution 23 Control Act; providing incentives for the development of new 24 and more accurate and reliable pollution control quantification 25 protocols and procedures; and providing greater flexibility 26 through community-based, nonregulatory, and performance-driven 27 watershed management planning. 28 -3- LSB 6179HC (5) 83 tm/rj 3/ 3
