H.F. _____ Section 1. Section 322.3, Code Supplement 2009, is amended 1 by adding the following new subsection: 2 NEW SUBSECTION . 15. A manufacturer, distributor, or 3 importer of motor vehicles or an agent or representative of a 4 manufacturer, distributor, or importer shall not reduce the 5 amount of compensation for, or disallow a claim for, warranty 6 parts, repairs, or service supplied by a motor vehicle dealer 7 on the grounds that the dealer failed to submit a claim fewer 8 than sixty days after the motor vehicle dealer completed the 9 work underlying the claim for warranty parts, repairs, or 10 service. 11 EXPLANATION 12 This bill prohibits a motor vehicle manufacturer, 13 distributor, or importer from reducing the amount of 14 compensation for, or disallowing a claim for, warranty parts, 15 repairs, or service performed by a motor vehicle dealer on the 16 grounds that the claim was not filed fewer than 60 days after 17 the work underlying the claim was completed. 18 -1- LSB 5702YC (3) 83 dea/nh 1/ 1
