H.F. _____ Section 1. Section 411.15, Code 2009, is amended to read as 1 follows: 2 411.15 Hospitalization and medical attention. 3 Cities shall provide hospital, nursing, and medical 4 attention for the members of the police and fire departments 5 of the cities, when injured while in the performance of their 6 duties as members of such department, and shall continue to 7 provide hospital, nursing, and medical attention for injuries 8 or diseases incurred while in the performance of their duties 9 for members receiving a retirement allowance under section 10 411.6, subsection 6. Members receiving hospital, nursing, and 11 medical attention pursuant to this section shall have the right 12 to choose the care. Cities may fund the cost of the hospital, 13 nursing, and medical attention required by this section through 14 the purchase of insurance, by self-insuring the obligation, or 15 through payment of moneys into a local government risk pool 16 established for the purpose of covering the costs associated 17 with the requirements of this section. However, the cost of 18 the hospital, nursing, and medical attention required by this 19 section shall not be funded through an employee-paid health 20 insurance policy. The cost of the hospital, nursing, and 21 medical attention required by this section shall be paid from 22 moneys held in a trust and agency fund established pursuant to 23 section 384.6, or out of the appropriation for the department 24 to which the injured person belongs or belonged; provided that 25 any amounts received by the injured person from any other 26 source for such specific purposes, shall be deducted from the 27 amount paid by the city under the provisions of this section. 28 EXPLANATION 29 This bill amends Code section 411.15 to specify that members 30 of the municipal police and fire retirement system who are 31 injured while in the performance of their duties and need 32 medical attention have the right to choose the care provided. 33 -1- LSB 5128YC (4) 83 av/rj 1/ 1
