subsection
2,
Code

2009,
is
amended
to
read
as
follows:

Have
authority
to
determine
tuition
rates
for

instruction.

a.
Tuition
for
residents
of
Iowa
shall
not
exceed
the
5
lowest
tuition
rate
per
semester,
or
the
equivalent,
charged
6
by
an
institution
of
higher
education
under
the
state
board
7
of
regents
for
a
full-time
resident
student.
However,
except
8
for
students
enrolled
under
section
261E.6,
if
a
local
school
9
district
pays
tuition
for
a
resident
pupil
of
high
school
age,
10
the
limitation
on
tuition
for
residents
of
Iowa
shall
not
11
apply,
the
amount
of
tuition
shall
be
determined
by
the
board
12
of
directors
of
the
community
college
with
the
consent
of
the
13
local
school
board,
and
the
pupil
shall
not
be
included
in
the
14
full-time
equivalent
enrollment
of
the
community
college
for
15
the
purpose
of
computing
general
aid
to
the
community
college.

b.
Tuition
for
nonresidents
of
Iowa
shall
not
be
less
than
17
the
marginal
cost
of
instruction
of
a
student
attending
the
18
college.
A
lower
tuition
for
nonresidents
may
be
permitted
19
under
a
reciprocal
tuition
agreement
between
a
merged
area
and
20
an
educational
institution
in
another
state,
if
the
agreement
21
is
approved
by
the
director.

c.
The
board
may
designate
that
a
portion
of
the
tuition
23
moneys
collected
from
students
be
used
for
student
aid
24
purposes.

d.
The
board
shall
waive
tuition
and
mandatory
fees
for
26
persons
who
served
on
active
duty
in
the
military
service
of

the
United
States
in
a
designated
combat
zone
or
hazardous
duty

area
on
or
after
September
11,

Section
25B.2,
subsection
2
3,
shall
not
apply
to
this
Act.

EXPLANATION
4
This
bill
directs
the
boards
of
directors
of
the
community
5
colleges
and
the
state
board
of
regents
to
waive
undergraduate
6
tuition
and
mandatory
fees
for
persons
who
served
on
active
7
duty
in
the
military
service
of
the
United
States
in
a
8
designated
combat
zone
or
hazardous
duty
area
and
who
are
9
enrolled
as
undergraduate
students.
10
The
bill
may
include
a
state
mandate
as
defined
in
Code
11
section
25B.3.
The
bill
makes
inapplicable
Code
section
25B.2,
12
subsection
3,
which
would
relieve
a
political
subdivision
from
13
complying
with
a
state
mandate
if
funding
for
the
cost
of
14
the
state
mandate
is
not
provided
or
specified.
Therefore,
15
political
subdivisions
are
required
to
comply
with
any
state
16
mandate
included
in
the
bill.
