Section
1.
Section
217.42,
subsection
1,
Code
2009,
is
1
amended
to
read
as
follows:
2
1.
The
organizational
structure
to
deliver
the
department’s
3
field
services
shall
be
based
upon
service
areas
designated
by
4
the
department
.
The
service
areas
shall
serve
as
a
basis
for
5
providing
field
services
to
persons
residing
in
the
counties
6
comprising
the
service
area.
The
service
areas
shall
be
those
7
designated
by
the
department
effective
January
1,
2002.
In
8
determining
the
service
areas,
the
department
shall
consider
9
other
geographic
service
areas
including
but
not
limited
to
10
judicial
districts
and
community
empowerment
areas.
The
11
department
shall
consult
with
the
county
boards
of
supervisors
12
in
a
service
area
with
respect
to
the
selection
of
the
service
13
area
manager
responsible
for
the
service
area
who
is
initially
14
selected
for
the
service
area
designated
effective
January
1,
15
2002,
and
any
service
area
manager
selected
for
the
service
16
area
thereafter.
Following
establishment
of
the
service
areas
17
effective
January
1,
2002,
if
a
county
seeks
to
change
the
18
boundaries
of
a
service
area,
the
change
shall
only
take
place
19
if
the
change
is
mutually
agreeable
to
the
department
and
all
20
affected
counties.
If
it
is
necessary
for
the
department
to
21
significantly
modify
its
field
operations
or
the
composition
22
of
a
designated
service
area,
or
if
it
is
necessary
for
the
23
department
to
change
the
number
of
offices
operating
less
than
24
full-time,
the
department
shall
consult
with
the
affected
25
counties
prior
to
implementing
such
action.

Sec.
2.
EFFECTIVE
UPON
ENACTMENT.
This
Act,
being
deemed
of
27
immediate
importance,
takes
effect
upon
enactment.

EXPLANATION
29
This
bill
relates
to
the
field
services
organization
for
30
the
department
of
human
services
under
Code
section
217.42,
31
providing
for
service
areas
to
be
designated
by
the
department.

The
bill
eliminates
other
language
limiting
the
field
33
services
organization
to
the
service
areas
designated
as
of
34
January
1,
2002,
requiring
consideration
of
other
geographic

service
areas,
requiring
consultation
with
county
boards
of

supervisors
regarding
selection
of
service
area
managers,

providing
a
procedure
for
counties
seeking

consultation

affected
counties
if
it
is
necessary
for
the
department
to
5
significantly
modify
service
areas
or
related
operations.

takes
effect
upon
enactment.
