authority.

1.
The
rulemaking
authority
of
the
division
shall
apply
to
4
all
deliverable
fuel
vendors
regarding
the
provision
of
service
5
to
low-income
home
energy
assistance
program
customers.

2.
The
division
shall
adopt
rules
governing
contracts
and
7
agreements
with
deliverable
fuel
vendors
in
order
to
protect
8
the
rights
of
persons
who
heat
their
homes
with
deliverable
9
fuels
and
who
are
eligible
for
the
federal
low-income
home
10
energy
assistance
program.
This
section
shall
be
narrowly
11
construed
to
confer
rulemaking
authority
strictly
with
respect
12
to
customer
access
to
deliverable
fuels
from
November
1
to
13
April
1
annually.

For
the
purposes
of
this
section,
unless
the
context
15
otherwise
requires:
16
a.
“Deliverable
fuel”
means
propane
or
any
other
heating
17
fuel
sold
or
delivered
within
this
state
for
home
heating
18
purposes.

b.
“Deliverable
fuel
vendor”
means
a
retail
propane
20
dispenser,
retail
propane
marketer,
or
a
retail
dispenser
or
21
marketer
of
a
deliverable
fuel
other
than
propane.

c.
“Propane”
,
“retail
propane
dispenser”
,
and
“retail
propane
23
marketer”
mean
the
same
as
defined
in
section
101C.2.

Sec.
2.
EFFECTIVE
UPON
ENACTMENT.
This
Act,
being
deemed
of
25
immediate
importance,
takes
effect
upon
enactment.

EXPLANATION
27
This
bill
confers
rulemaking
authority
upon
the
division
28
of
community
action
agencies
of
the
department
of
human
29
rights
with
respect
to
ensuring
access
by
customers
eligible
30
for
the
federal
low-income
home
energy
assistance
program
to
31
deliverable
fuels
for
home
heating
purposes.
The
bill
provides
32
that
the
division
shall
adopt
rules
governing
contracts
and
33
agreements
with
deliverable
fuel
vendors
in
order
to
protect
34
the
rights
of
eligible
persons
who
heat
their
homes
with
