1.
Section
304A.10,
Code
2009,
is
amended
to
read

as
follows:

304A.10
Cost
of
fine
arts
——
percentage.

The
total
estimated
cost
of
the
fine
arts
elements
included
4
in
a
plan
and
specifications
for
a
state
building
or
group
5
of
state
buildings
in
accordance
with
the
purposes
of
this
6
division
shall
in
no
case
be
less
than
one-half
of
one
percent
7
of
the
total
estimated
cost
of
such
building
or
group
of
8
buildings.
This
percentage
allocation
shall
not
be
diminished
9
by
professional
fees.
By
September
1
annually,
the
contracting
10
officer
or
principal
user
shall
submit
to
the
department
of
11
cultural
affairs
the
total
amount
of
state
financial
assistance
12
expended
in
accordance
with
this
section
during
the
previous
13
fiscal
year.
If
deemed
in
the
best
interests
of
the
citizens,
14
funds
allocated
for
the
acquisition
of
fine
arts
may
be
15
accumulated
over
more
than
one
appropriation
or
fiscal
period
16
or
combined
to
complete
significant
projects
,
however,
this
17
sentence
does
not
authorize
interproject
transfers
.
The
18
total
estimated
cost
of
the
fine
arts
elements
included
in
19
a
plan
and
specifications
for
a
state
building
or
group
of
20
state
buildings
in
accordance
with
this
section
shall
be
21
included
by
the
department
of
cultural
affairs
in
calculating
22
the
amount
of
state
financial
assistance
for
the
arts
for
23
purposes
of
national
ranking
surveys.
By
January
1
annually,
24
the
department
of
cultural
affairs
shall
submit
a
summary
of
25
the
total
amount
of
state
financial
assistance
expended
in
26
accordance
with
this
section
and
for
which
state
buildings
the
27
assistance
was
expended.

2.
Section
304A.12,
Code
2009,
is
amended
to
read
as

follows:

Separate
contract.

Contracts
for
the
fine
arts
elements
shall
be
executed

within
the
limits
of
the
actual
costs
as
determined
by
section

304A.10.
Funds
shall
be
transferred
to
the
arts
division
for

administration
of
the
program.

shall
be
contracted
for

by
the
arts
division

agency

these

EXPLANATION

This
bill
concerns
fine
arts
projects
in
state
buildings.

Code
section
304A.10,
concerning
fine
arts
costs,
is
amended

to
allow
interproject
transfers
of
moneys
allocated
for
fine
7
arts
projects
and
to
eliminate
the
requirement
that
the
arts
8
division
of
the
department
of
cultural
affairs
use
a
certain
9
method
of
calculating
the
amount
of
state
financial
assistance
10
for
the
arts
for
purposes
of
national
ranking
surveys.
11
Code
section
304A.12
is
amended
to
provide
that
the
12
contracting
agency
or
principal
user,
and
not
the
arts
13
division,
is
required
to
separately
contract
for
expenses
14
related
to
the
acquisition
of
fine
arts
elements.
