H.F. _____ Section 1. Section 155A.32, Code 2009, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 2A. The pharmacist shall not exercise 3 the drug product selection described in this section for 4 an antiepileptic drug or formulation of an antiepileptic 5 drug, whether brand name or generic name, prescribed for 6 the treatment of seizures including epilepsy, without prior 7 notification of and receipt of the signed informed consent for 8 that selection from both the authorized prescriber and the 9 patient or the patient’s representative. 10 EXPLANATION 11 This bill provides an exception to authorization of drug 12 product selection by pharmacists by prohibiting such drug 13 product selection for an antiepileptic drug or formulation of 14 an antiepileptic drug, whether brand name or generic name, 15 prescribed for the treatment of seizures including epilepsy, 16 unless the pharmacist first provides notification of and 17 receives signed informed consent for that selection from both 18 the authorized prescriber and the patient or the patient’s 19 representative. 20 -1- LSB 5240HC (3) 83 pf/nh 1/ 1
