Section
1.
The
following
amendment
to
the
Constitution
of
1
the
State
of
Iowa
is
proposed:

The
Constitution
of
the
State
of
Iowa
is
amended
by
adding
3
the
following
new
sections
to
new
Article
XIII:
4
ARTICLE
XIII

LABOR
UNION
MEMBERSHIP
6
Right
to
join
union.
SECTION
1.
It
is
declared
to
7
be
the
policy
of
the
state
of
Iowa
that
no
person
within
8
its
boundaries
shall
be
deprived
of
the
right
to
work
at
9
the
person’s
chosen
occupation
for
any
public
or
private
10
employer
because
of
membership
in,
affiliation
with,
11
withdrawal
or
expulsion
from,
or
refusal
to
join,
any
labor
12
union,
organization,
or
association,
and
any
contract
which
13
contravenes
this
policy
is
illegal
and
void.
14
Refusal
to
employ
prohibited.
SEC.
2.
It
shall
be
unlawful
15
for
any
person,
firm,
association,
or
corporation
to
refuse
16
or
deny
public
or
private
employment
to
any
person
because
17
of
membership
in,
or
affiliation
with,
or
resignation
or
18
withdrawal
from,
a
labor
union,
organization,
or
association,
19
or
because
of
refusal
to
join
or
affiliate
with
a
labor
union,
20
organization,
or
association.
21
Contracts
to
exclude
unlawful.
SEC.
3.
It
shall
be
unlawful
22
for
any
person,
firm,
association,
corporation,
or
labor
23
organization
to
enter
into
any
understanding,
contract,
or
24
agreement,
whether
written
or
oral,
to
exclude
from
public
or
25
private
employment
members
of
a
labor
union,
organization,
or
26
association,
or
persons
who
do
not
belong
to,
or
who
refuse
to
27
join,
a
labor
union,
organization,
or
association,
or
because
28
of
resignation
or
withdrawal
therefrom.

Union
dues
as
prerequisite
to
employment
——
prohibited.
SEC.
30
4.
It
shall
be
unlawful
for
any
person,
firm,
association,

labor
organization,
corporation,
or
political
subdivision,

either
directly
or
indirectly,
or
in
any
manner
or
by
any
33
means
as
a
prerequisite
to
or
a
condition
of
public
or
private
34
employment,
to
require
any
person
to
pay
dues,
charges,
fees,

contributions,
fines,
or
assessments
to
any
labor
union,
labor
1
association,
or
labor
organization.

Deducting
dues
from
pay
unlawful.
SEC.
5.
It
shall
be
3
unlawful
for
any
person,
firm,
association,
labor
organization,
4
or
corporation
to
deduct
labor
organization
dues,
charges,
5
fees,
contributions,
fines,
or
assessments
from
a
public
or
6
private
employee’s
earnings,
wages,
or
compensation,
unless
the
7
public
or
private
employer
has
first
been
presented
with
an
8
individual
written
order
therefor
signed
by
the
employee,
which
9
written
order
shall
be
terminable
at
any
time
by
the
employee
10
giving
at
least
thirty
days’
written
notice
of
such
termination
11
to
the
employer.

Sec.
2.
REFERRAL
AND
PUBLICATION.
The
foregoing
proposed
13
amendment
to
the
Constitution
of
the
State
of
Iowa
is
referred
14
to
the
General
Assembly
to
be
chosen
at
the
next
general
15
election
for
members
of
the
General
Assembly
and
the
Secretary
16
of
State
is
directed
to
cause
it
to
be
published
for
three
17
consecutive
months
previous
to
the
date
of
that
election
as
18
provided
by
law.

EXPLANATION
20
This
joint
resolution
proposes
an
amendment
to
the
21
Constitution
of
the
State
of
Iowa
relating
to
labor
union
22
membership.
The
joint
resolution
proposes
incorporating
23
current
Code
sections
731.1
through
731.5
into
the
Iowa
24
Constitution.
The
resolution
provides
that
a
person
shall
not
25
be
deprived
of
the
right
to
work
for
any
public
or
private
26
employer
because
of
membership
in,
or
refusal
to
join,
a
labor
27
union.
The
resolution
also
prohibits
requiring
the
payment
of
28
union
dues
or
the
deduction
of
union
dues
from
a
person’s
pay
29
as
a
prerequisite
for
employment.
30
The
resolution,
if
adopted,
would
be
referred
to
the
next
31
general
assembly
for
adoption
a
second
time
before
being
32
submitted
to
the
electorate
for
ratification.
