NEW SECTION. 455B.262A NATIONAL FLOOD 1 2 INSURANCE PROGRAM == PARTICIPATION REQUIRED. 1 3 1. All counties and cities in this state that have an 1 4 effective flood insurance rate map or flood hazard boundary 1 5 map published by the federal emergency management agency that 1 6 identifies a special flood hazard area within the political 1 7 boundaries of the county or city shall meet the requirements 1 8 for participation in the national flood insurance program 1 9 administered by the federal emergency management agency on or 1 10 before July 30, 2013. 1 11 2. If a county or city does not currently have an 1 12 effective flood insurance rate map or flood hazard boundary 1 13 map published by the federal emergency management agency that 1 14 identifies a special flood hazard area within the political 1 15 boundaries of the county or city, the county or city shall 1 16 have twenty months from the effective date of any future flood 1 17 insurance rate map or flood hazard boundary map published by 1 18 the federal emergency management agency to meet the 1 19 requirements for participation in the national flood insurance 1 20 program. 1 21 3. Each county or city shall agree to manage flood hazard 1 22 areas within its jurisdiction by adopting regulatory standards 1 23 that meet or exceed statewide floodplain management standards 1 24 and the minimum requirements of the national flood insurance 1 25 program. 1 26 4. The department shall assist counties and cities with 1 27 developing and administering local floodplain management 1 28 programs and with otherwise meeting the requirements for 1 29 participation in the national flood insurance program. 1 30 5. State participation in funding financial assistance 1 31 under section 29C.6, subsection 17, paragraph "a", is 1 32 contingent upon the county or city participating in the 1 33 national flood insurance program pursuant to this section. 1 34 Sec. 2. IMPLEMENTATION OF ACT. Section 25B.2, subsection 1 35 3, shall not apply to this Act. 2 1 EXPLANATION 2 2 This bill creates new Code section 455B.262A requiring all 2 3 counties and cities in the state that have an effective flood 2 4 insurance rate map or flood hazard boundary map published by 2 5 the federal emergency management agency that identifies a 2 6 special flood hazard area within their political boundaries to 2 7 meet the requirements for participation in the national flood 2 8 insurance program administered by the federal emergency 2 9 management agency on or before July 30, 2013. 2 10 If a city or county does not currently have an effective 2 11 flood insurance rate map or flood hazard boundary map 2 12 published by the federal emergency management agency that 2 13 identifies a special flood hazard area within its political 2 14 boundaries, the county or city has 20 months from the 2 15 effective date of any future flood insurance rate map or flood 2 16 hazard boundary map to meet the requirements for participation 2 17 in the national flood insurance program. 2 18 Each county or city must agree to manage flood hazard areas 2 19 within its jurisdiction by adopting regulatory standards that 2 20 meet or exceed statewide floodplain management standards and 2 21 the minimum standards of the national flood insurance program. 2 22 The department of natural resources shall assist cities and 2 23 counties with developing and administering local floodplain 2 24 management programs and otherwise meeting the requirements of 2 25 the national flood insurance program. 2 26 State participation in funding financial assistance to a 2 27 county or city pursuant to Code section 29C.6(17)(a) when 2 28 federal financial assistance is available, is contingent upon 2 29 the county or city participating in the national flood 2 30 insurance program as required in new Code section 455B.262A. 2 31 The bill may include a state mandate as defined in Code 2 32 section 25B.3. The bill makes inapplicable Code section 2 33 25B.2, subsection 3, which would relieve a political 2 34 subdivision from complying with a state mandate if funding for 2 35 the cost of the state mandate is not provided or specified. 3 1 Therefore, political subdivisions are required to comply with 3 2 any state mandate included in the bill. 3 3 LSB 1727HV 83 3 4 av/rj/5.1
