A BILL FOR
1 An Act allowing school districts affected by a presidentially
2 declared major disaster or a state of disaster emergency to
3 use the previous year's budget enrollments in certain current
4 budget years after the disaster, and providing an effective
5 date.

1 1 Section 1. NEW SECTION. 257.6A DISASTER RELIEF == BUDGET
1 2 ENROLLMENTS.
1 3 Notwithstanding any provision of the Code to the contrary,
1 4 for any school budget year, a school district determined by
1 5 the department of education to have been in an area
1 6 significantly affected by a governor=declared state of
1 7 disaster emergency or a presidentially declared major
1 8 disaster, with a basic enrollment for the budget year, as
1 9 defined under section 257.6, that is less than the previous
1 10 year's budget enrollment may use the previous year's budget
1 11 enrollment. A school district may use the previous year's
1 12 budget enrollment for the basic enrollment, as authorized
1 13 under this section, for no more than two school budget years
1 14 after the disaster.
1 15 Sec. 2. EFFECTIVE DATE. This Act, being deemed of
1 16 immediate importance, takes effect upon enactment.
1 17 EXPLANATION
1 18 This bill allows a school district that is significantly
1 19 affected by a governor=declared state of disaster emergency or
1 20 a presidentially declared major disaster to use predisaster
1 21 student enrollment counts for no more than two years after the
1 22 disaster in order to offset a budget enrollment decrease. The
1 23 department of education shall determine which school districts
1 24 are significantly affected by such disasters.
1 25 The bill is effective upon enactment.
