  1  1    Section 1.  Section 135.17, subsection 1, paragraph b, Code
  1  2 2009, is amended to read as follows:
  1  3    b.  A person performing a dental screening required by this
  1  4 section shall record the fact of having conducted the
  1  5 screening, and only such additional information required by
  1  6 the department, necessary to identify the student, the
  1  7 student's parent or guardian, the dental screening provider,
  1  8 and the student's school.  The information shall be reported
  1  9 on uniform forms developed by the department in cooperation
  1 10 with the department of education.  The form shall include a
  1 11 space for the person performing the screening to summarize any
  1 12 condition that may indicate a need for special services.
  1 13    Sec. 2.  Section 135.17, Code 2009, is amended by adding
  1 14 the following new subsection:
  1 15    NEW SUBSECTION.  3A.  Nothing in this section shall be
  1 16 construed to establish a duty on the part of a public or
  1 17 nonpublic school to provide or ensure provision of proper
  1 18 dental care to any student.
  1 19                           EXPLANATION
  1 20    This bill amends provisions relating to the dental
  1 21 screening of children program.  The bill eliminates language
  1 22 that would require a person performing a dental screening to
  1 23 provide a summary of any condition that may indicate a need
  1 24 for special services.  Instead, the person would only report
  1 25 that the screening had been completed and information required
  1 26 by the department necessary to identify the student, the
  1 27 student's parent or guardian, the dental screening provider,
  1 28 and the student's school.
  1 29    The bill also includes language regarding liability of a
  1 30 school relative to the dental screening by providing that the
  1 31 provisions of the law are not to be construed to establish a
  1 32 duty on the part of a public or nonpublic school to provide or
  1 33 ensure provision of proper dental care to any student.
