1 An Act prohibiting transfers of appropriations made for preschool
2 foundation aid and including effective and retroactive
3 applicability date provisions.
4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. Section 256C.6, subsection 2, paragraph b, Code
1 2 2009, is amended to read as follows:
1 3 b. Notwithstanding section 8.33, moneys appropriated in
1 4 this subsection that remain unencumbered or unobligated at the
1 5 close of the fiscal year shall not revert but shall remain
1 6 available for expenditure for the purposes designated until
1 7 the close of the succeeding fiscal year. Notwithstanding
1 8 section 8.39, moneys appropriated in this subsection are not
1 9 subject to transfer.
1 10 Sec. 2. EFFECTIVE DATE == RETROACTIVE APPLICABILITY. This
1 11 Act, being deemed of immediate importance, takes effect upon
1 12 enactment and is retroactively applicable to July 1, 2008.
1 13 EXPLANATION
1 14 This bill prohibits transfers within or between departments
1 15 of the standing limited appropriations made to the department
1 16 of education for preschool foundation aid payments in Code
1 17 section 256C.6 for fiscal years 2008=2009, 2009=2010, and
1 18 2010=2011.
1 19 The bill takes effect upon enactment and is retroactively
1 20 applicable to July 1, 2008.
