  1  1    Section 1.  Section 256.7, subsection 29, Code 2009, is
  1  2 amended by striking the subsection.
  1  3    Sec. 2.  Section 256.9, subsections 59 and 60, Code 2009,
  1  4 are amended by striking the subsections.
  1  5    Sec. 3.  2008 Iowa Acts, chapter 1187, section 145, is
  1  6 amended to read as follows:
  1  7    SEC. 145.  EFFECTIVE DATE.  The section of this division of
  1  8 this Act that amends section 256.11, subsection 6, takes
  1  9 effect July 1, 2009 2010.
  1 10    Sec. 4.  EFFECTIVE DATE.  This Act, being deemed of
  1 11 immediate importance, takes effect upon enactment.
  1 12                           EXPLANATION
  1 13    This bill eliminates provisions that direct the state board
  1 14 of education and the director of the department of education
  1 15 to take actions to establish, monitor, and ensure compliance
  1 16 with nutritional content standards for foods and beverages
  1 17 sold or provided on the school grounds during the school day
  1 18 in school districts and accredited nonpublic schools; and
  1 19 delays until July 1, 2010, provisions requiring certain
  1 20 amounts of physical activity by students in kindergarten
  1 21 through grade 12, and completion of a certification course for
  1 22 cardiopulmonary resuscitation by the end of grade 12.
  1 23    As enacted in 2008, the provisions relating to physical
  1 24 activity and cardiopulmonary certification courses take effect
  1 25 July 1, 2009, and amend the educational standards to require
  1 26 all students in kindergarten through grade five who are
  1 27 physically able, unless a student's parent or guardian files
  1 28 for a religious exemption, to engage in physical activity for
  1 29 a minimum of 30 minutes per school day; and every student in
  1 30 grades six through 12 who is physically able, to engage in
  1 31 physical activity for a minimum of 120 minutes per week.  The
  1 32 department is directed to collaborate with stakeholders when
  1 33 developing models that describe ways schools may incorporate
  1 34 the physical activity requirement into the educational
  1 35 program.
  2  1    The bill also strikes a provision requiring the director to
  2  2 convene, every five years, a nutrition advisory panel to
  2  3 review research in pediatric nutrition and recommend
  2  4 nutritional standards to the state board of education.
  2  5    The bill takes effect upon enactment.
