  1  1    Section 1.  Section 135.39B, subsection 1, Code 2009, is
  1  2 amended to read as follows:
  1  3    1.  Beginning January 1, 2006, early Early childhood
  1  4 immunizations administered in this state shall not contain
  1  5 more than trace amounts of mercury.
  1  6    Sec. 2.  Section 135.39B, subsection 3, Code 2009, is
  1  7 amended to read as follows:
  1  8    3.  The prohibition under this section shall not apply to
  1  9 early childhood immunizations for influenza or in times of
  1 10 emergency or epidemic as determined by the director of public
  1 11 health.  If an emergency or epidemic is determined to exist by
  1 12 the director of public health under this subsection, the
  1 13 director of public health shall notify the state board of
  1 14 health, the governor, and the legislative council, and shall
  1 15 notify the public upon request.
  1 16                           EXPLANATION
  1 17    This bill relates to early childhood immunizations for
  1 18 influenza containing mercury.
  1 19    Currently, early childhood immunizations administered in
  1 20 Iowa cannot contain more than trace amounts of mercury.  An
  1 21 exception to this prohibition exists for early childhood
  1 22 immunizations for influenza and in times of emergency or
  1 23 epidemic.  The bill eliminates the exception for influenza
  1 24 immunizations.
  1 25    A violation of these provisions is a simple misdemeanor.  A
  1 26 simple misdemeanor is punishable by confinement for no more
  1 27 than 30 days or a fine of at least $65 but not more than $625
  1 28 or by both.
