Section
331.304,
subsection
3,
Code
2009,
is

amended
by
adding
the
following
new
paragraph:

county
adopts
a
building
code
by

amends

ordinance
that
adopts
a
building
code

by
reference,
the
board
shall
vote
separately
on
any
provision

of
that
code
requiring
the
installation
of
fire
sprinklers
or

a
related
fire
suppression
system
in
a
one-family
dwelling,
a
7
two-family
dwelling,
or
a
residential
building
containing
less
8
than
five
dwelling
units.

2.
Section
364.17,
Code
Supplement
2009,
is
amended
by

adding
the
following
new
subsection:

.
2A.
If
a
city
adopts
a
building
code
by

reference
or
amends
an
ordinance
that
adopts
a
building
code
by
13
reference,
the
council
shall
vote
separately
on
any
provision

of
that
code
requiring
the
installation
of
fire
sprinklers
or
15
a
related
fire
suppression
system
in
a
one-family
dwelling,
a
16
two-family
dwelling,
or
a
residential
building
containing
less
17
than
five
dwelling
units.

Sec.
3.
EFFECTIVE
UPON
ENACTMENT.
This
Act,
being
deemed
of
19
immediate
importance,
takes
effect
upon
enactment.

EXPLANATION
21
This
bill
provides
that
if
a
county
or
a
city
adopts
a
22
building
code
by
reference
or
amends
an
ordinance
that
adopts
a
23
building
code
by
reference,
the
board
of
supervisors
or
city
24
council,
as
applicable,
shall
vote
separately
on
any
provision
25
of
that
code
requiring
the
installation
of
fire
sprinklers
or
26
a
related
fire
suppression
system
in
a
one-family
dwelling,
a
27
two-family
dwelling,
or
a
residential
building
containing
less
28
than
five
dwelling
units.
29
The
bill
takes
effect
upon
enactment.
