H.F. 2451 Section 1. Section 235A.12, Code 2009, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 3. It is the intent of the general assembly 3 that Iowans’ rights to due process shall be recognized when a 4 state agency is determining if a person is to be placed on the 5 child abuse registry or the dependent adult abuse registry. 6 It is the intent of the general assembly that no Iowan shall 7 be placed on the child abuse registry or the dependent adult 8 abuse registry prior to being notified that they are being 9 investigated for an allegation of abuse. It is the intent of 10 the general assembly that Iowans placed on the child abuse 11 registry and dependent adult abuse registry shall be entitled 12 to a timely administrative hearing and a timely appeal. 13 EXPLANATION 14 This bill establishes legislative intent that no Iowan shall 15 be placed on the child abuse registry or the dependent adult 16 abuse registry prior to being notified that they are being 17 investigated for an allegation of abuse and be accorded a 18 timely administrative hearing and appeal. 19 -1- LSB 6077HV (1) 83 jr/nh 1/ 1
