H.F. 2446 Section 1. Section 455B.306, subsection 9, Code 2009, is 1 amended by adding the following new paragraph: 2 NEW PARAGRAPH . f. If a sanitary disposal project other 3 than a sanitary landfill receives a notification from the 4 department that the financial assurance instrument of the 5 sanitary disposal project is inadequate, the owner or operator 6 of the sanitary disposal project shall, within thirty days of 7 receiving the notice, cease acceptance of additional solid 8 waste at the sanitary disposal project which is the subject of 9 the notice, regardless of whether the permit holder appeals 10 such notification. Authorization to resume acceptance of solid 11 waste shall be granted upon the determination by the department 12 that the permit holder has established sufficient financial 13 assurance. This paragraph shall not apply to transfer 14 stations. 15 EXPLANATION 16 This bill relates to financial assurance for sanitary 17 disposal projects. 18 The bill provides that if a sanitary disposal project other 19 than a sanitary landfill receives a notification from the 20 department of natural resources that the financial assurance 21 instrument of the sanitary disposal project is inadequate, the 22 sanitary disposal project shall, within 30 days of receiving 23 the notice, cease acceptance of additional solid waste. The 24 bill provides that authorization to resume acceptance of solid 25 waste shall be granted upon the determination by the department 26 that the permit holder has established sufficient financial 27 assurance.
