H.F. 2426 Section 1. Section 728.2, Code 2009, is amended to read as 1 follows: 2 728.2 Dissemination and exhibition of obscene material to 3 minors. 4 Any person , other than the parent or guardian of the 5 minor, who knowingly disseminates or exhibits obscene material 6 to a minor, including the exhibition of obscene material so 7 that it can be observed by a minor on or off the premises where 8 it is displayed, is guilty of a public offense and shall upon 9 conviction be guilty of a serious misdemeanor. 10 EXPLANATION 11 This bill relates to dissemination or exhibition of obscene 12 material to a minor. 13 The bill strikes a provision exempting a parent or 14 guardian from prosecution if the parent or guardian knowingly 15 disseminates or exhibits obscene material to a minor who is the 16 child or ward of the parent or guardian. 17 A person who commits dissemination or exhibition of obscene 18 material to a minor is guilty of a serious misdemeanor and must 19 register as a sex offender under Code chapter 692A. 20 A person who commits a violation of Code section 728.2 is 21 also subject to license suspension or revocation provisions 22 under Code sections 728.8 (business) and 272.2(14)(education). 23 -1- LSB 5961YH (2) 83 jm/rj 1/ 1
