H.F. 2425 Section 1. Section 476.1A, subsection 1, unnumbered 1 paragraph 1, Code 2009, is amended to read as follows: 2 Electric public utilities having fewer than ten thousand 3 customers and electric cooperative corporations and 4 associations are not subject to the rate regulation authority 5 of the board. Such utilities are subject to all other 6 regulation and enforcement activities of the board, including: 7 Sec. 2. Section 476.1A, subsection 1, paragraph g, Code 8 2009, is amended to read as follows: 9 g. Filing energy efficiency plans and energy efficiency 10 results with the board. The energy efficiency plans as a 11 whole shall be cost-effective. The board may permit these 12 utilities to file joint plans. The board shall periodically 13 report the energy efficiency results including energy savings 14 of each of these utilities to the general assembly. The board 15 may waive all or part of the energy efficiency filing and 16 review requirements for electric cooperative corporations and 17 associations and electric public utilities which demonstrate 18 superior results with existing energy efficiency efforts. 19 Sec. 3. Section 476.1A, subsection 3, Code 2009, is amended 20 to read as follows: 21 3. Electric cooperative corporations and associations 22 and electric public utilities exempt from rate regulation 23 under this section shall not make or grant any unreasonable 24 preferences or advantages as to rates or services to any 25 person or subject any person to any unreasonable prejudice or 26 disadvantage. 27 EXPLANATION 28 This bill removes an exemption for electric public utilities 29 having fewer than 10,000 customers from the rate regulation 30 authority of the Iowa utilities board. Currently, such 31 utilities are exempt from such authority, along with electric 32 cooperative corporations and associations, pursuant to the 33 provisions of Code section 476.1A. 34 Removing this exemption makes electric public utilities 35 -1- LSB 5275YH (2) 83 rn/rj 1/ 2
