H.F. 2408 Section 1. Section 400.2, subsection 2, paragraphs a and b, 1 Code Supplement 2009, are amended to read as follows: 2 a. Sell to, or in any manner become parties, directly or 3 indirectly, to any contract to furnish supplies, material, or 4 labor to the city unless the sale is made or the contract is 5 awarded pursuant to a competitive bidding process . In no case, 6 however, shall a civil service commissioner sell to, or in any 7 manner become a party, directly or indirectly, to any contract 8 to furnish supplies, material, or labor to the civil service 9 commission. 10 b. Have an interest, direct or indirect, in any contract or 11 job of work or material or the profits thereof or services to 12 be furnished or performed for the city unless the contract or 13 job is awarded pursuant to a competitive bidding process . In 14 no case, however, shall a civil service commissioner have an 15 interest, direct or indirect, in any contract or job of work or 16 material or the profits thereof or services to be furnished or 17 performed for the civil service commission. 18 EXPLANATION 19 Current Code section 400.2 restricts civil service 20 commissioners from entering into certain contracts and 21 providing services or materials to the city for which they are 22 a commissioner. This bill would allow a commissioner to engage 23 in such contracts or activities if the contract, sale, or job 24 is awarded pursuant to a competitive bidding process.
