H.F. 2394 Section 1. Section 298.3, subsection 1, paragraphs f and g, 1 Code Supplement 2009, are amended to read as follows: 2 f. Repairing, remodeling, reconstructing, improving, 3 maintaining, or expanding the schoolhouses or buildings and 4 additions to existing schoolhouses. For the purpose of this 5 paragraph: 6 (1) “Repairing” means restoring an existing structure or 7 thing to its original condition, as near as may be, after 8 decay, waste, injury, or partial destruction , but does not 9 include maintenance . 10 (2) “Reconstructing” means rebuilding or restoring as an 11 entity a thing which was lost or destroyed. 12 g. (1) Expenditures for energy conservation, including 13 payments made pursuant to a guarantee furnished by a school 14 district entering into a financing agreement for energy 15 management improvements, limited to agreements pursuant to 16 section 473.19, 473.20, or 473.20A. 17 (2) The costs of utilities. 18 Sec. 2. Section 298.3, subsection 1, Code Supplement 2009, 19 is amended by adding the following new paragraph: 20 NEW PARAGRAPH . n. The salaries or service contract costs 21 for maintenance staff. 22 Sec. 3. Section 298.3, subsection 4, Code Supplement 2009, 23 is amended to read as follows: 24 4. Revenue from the regular and voter-approved physical 25 plant and equipment levies shall not be expended for school 26 district employee salaries or travel expenses, except as 27 provided in subsection 1, paragraph “n” ; supplies , ; printing 28 costs ; or media services , ; or for any other purpose not 29 expressly authorized in this section. 30 Sec. 4. APPLICABILITY. This Act applies to physical plant 31 and equipment levies imposed on or after the effective date of 32 this Act and to expenditures made from the secure an advanced 33 vision for education fund under chapter 423F on or after the 34 effective date of this Act for the purpose of reducing the 1 -1- LSB 5358YH (4) 83 ak/sc 1/ 2

H.F. 2394 physical plant and equipment levy. 2 EXPLANATION 3 This bill relates to the purposes for which physical plant 4 and equipment levy (PPEL) revenue may be utilized. The bill 5 provides that maintenance costs and utilities costs shall now 6 be covered expenses. The bill also allows the salaries or 7 service contract costs of maintenance staff to be paid from 8 PPEL revenues. 9 The bill is applicable to physical plant and equipment 10 levies imposed on or after the bill’s effective date, and 11 because Code chapter 423F includes the “school infrastructure” 12 purposes also authorized for the physical plant and equipment 13 levy, the bill is also applicable to expenditures made from 14 the secure an advanced vision for education fund on or after 15 the effective date of the bill for purposes of reducing the 16 physical plant and equipment levy. 17 -2- LSB 5358YH (4) 83 ak/sc 2/ 2
