NEW
SECTION
.

Contracts
——
minority
impact
1
statements.

1.
Each
contract
bid
submitted
to
a
state
agency
for
3
contracts
with
private
providers
of
program
services,
the
costs
4
of
which
are
totally
or
partially
paid
for
or
reimbursed
with
5
state
funds,
shall
include
a
minority
impact
statement
that
6
contains
the
following
information:
7
a.
Any
disproportionate
or
unique
impact
of
proposed
8
policies
or
programs
on
minority
persons
in
this
state.
9
b.
A
rationale
for
the
existence
of
programs
or
policies
10
having
an
impact
on
minority
persons
in
this
state.
11
c.
Evidence
of
consultation
of
representatives
of
minority
12
persons
in
cases
where
a
policy
or
program
has
an
identifiable
13
impact
on
minority
persons
in
this
state.

2.
For
the
purposes
of
this
section,
the
following
15
definitions
shall
apply:
16
a.
“Disability”
means
the
same
as
provided
in
section
17
15.102,
subsection
7,
paragraph
“b”
,
subparagraph
(1).
18
b.
“Minority
persons”
includes
individuals
who
are
women,
19
persons
with
a
disability,
African
Americans,
Latinos,
Asians
20
or
Pacific
Islanders,
American
Indians,
and
Alaskan
Native
21
Americans.
22
c.
“State
agency”
means
a
department,
board,
bureau,
23
commission,
or
other
agency
or
authority
of
the
state
of
Iowa.

3.
The
department
of
management
shall
prescribe
the
form
25
of
the
minority
impact
statement
for
distribution
by
state
26
agencies
and
shall
ensure
its
inclusion
with
contract
bid
27
applications.
28
4.
The
directives
of
this
section
shall
be
carried
out
to
29
the
extent
consistent
with
federal
law.
30
5.
The
minority
impact
statement
shall
be
used
for
31
informational
purposes
only.
32
Sec.
2.
APPLICABILITY.
This
Act
applies
to
contracts
let
33
for
bid
on
or
after
July
1,
2010.

that
all
contract
bid
applications

state
agencies
for
contracts
with

impact

The
bill
lists
the
information
the
minority
impact
statement

must
include.
The
bill
defines
“minority
persons”.
7
The
department
of
management
is
tasked
with
prescribing
the
8
form
of
the
minority
impact
statement
and
ensuring
that
it
9
is
distributed
to
all
state
agencies
for
inclusion
with
all
10
contract
bid
applications.
11
The
directives
of
the
bill
are
to
be
carried
out
to
the
12
extent
that
they
do
not
conflict
with
federal
law,
and
the
13
minority
impact
statement
is
to
be
used
for
informational
14
purposes
only.
15
The
bill
applies
to
contracts
let
for
bid
on
or
after
July
16
1,
2010.
