Section
1.
Section
123.30,
subsection
3,
paragraph
e,
1
subparagraph
(1),
Code
Supplement
2009,
is
amended
to
read
as
2
follows:

(1)
A
class
“E”
liquor
control
license
may
be
issued
and
4
shall
authorize
the
holder
to
purchase
alcoholic
liquor
from
5
the
division
only
and
to
sell
the
alcoholic
liquor
to
patrons
6
for
consumption
off
the
licensed
premises
and
to
other
liquor
7
control
licensees.
A
class
“E”
license
shall
not
be
issued
to
8
premises
at
which
gasoline
is
sold.
A
holder
of
a
class
“E”
9
liquor
control
license
may
hold
other
retail
liquor
control
10
licenses
or
retail
wine
or
beer
permits,
but
the
premises
11
licensed
under
a
class
“E”
liquor
control
license
shall
be
12
separate
from
other
licensed
premises,
though
the
separate
13
premises
may
have
a
common
entrance.
However,
the
holder
of
14
a
class
“E”
liquor
control
license
may
also
hold
a
class
“B”
15
wine
or
class
“C”
beer
permit
or
both
for
the
premises
licensed
16
under
a
class
“E”
liquor
control
license.

Sec.
2.
Section
123.49,
subsection
2,
Code
2009,
is
amended
18
by
adding
the
following
new
paragraph:

NEW
PARAGRAPH
.
m.
For
a
class
“E”
liquor
control
licensee
20
for
a
premises
at
which
gasoline
is
sold,
allow
an
employee
of
21
the
licensee
under
the
age
of
eighteen
to
sell
alcoholic
liquor
22
on
the
premises.

EXPLANATION
24
This
bill
allows
a
class
“E”
liquor
control
license
to
be
25
issued
to
a
premises
at
which
gasoline
is
sold.
Current
law
26
does
not
allow
a
license
to
be
issued
for
a
location
that
sells
27
gasoline.
28
The
bill
also
provides
that
a
class
“E”
liquor
control
29
licensee
that
sells
gasoline
shall
not
allow
employees
under
30
the
age
of
18
to
sell
alcoholic
liquor
on
the
premises.
A
31
violation
of
this
new
provision
would
subject
the
licensee
to
32
criminal
and
civil
penalties
pursuant
to
Code
section
123.50.
