H.F. 2326 Section 1. Section 257.6, subsection 1, paragraph a, 1 subparagraph (5), Code Supplement 2009, is amended to read as 2 follows: 3 (5) Resident pupils receiving competent private instruction 4 from a licensed practitioner provided through a public 5 school district pursuant to chapter 299A shall be counted as 6 three-tenths of one pupil. Revenues received by a school 7 district attributed to a school district’s weighted enrollment 8 pursuant to this paragraph shall be expended for the purpose 9 for which the weighting was assigned under this paragraph. If 10 the school district determines that the expenditures associated 11 with providing competent private instruction pursuant to 12 chapter 299A are in excess of the revenue attributed to the 13 school district’s weighted enrollment for such instruction in 14 accordance with this subparagraph, the school district may 15 submit a request to the school budget review committee for 16 modified allowable growth in accordance with section 257.31, 17 subsection 5, paragraph “n” . A home school assistance program 18 shall not provide moneys Moneys received pursuant to this 19 subparagraph , nor resources paid for with moneys received 20 pursuant to this subparagraph, to parents or students utilizing 21 the program shall be used as provided in section 299A.12 . 22 Sec. 2. NEW SECTION . 299A.12 Home school assistance 23 program. 24 1. The board of directors of a school district may expend 25 moneys received pursuant to section 257.6, subsection 1, 26 paragraph “a” , subparagraph (5), for purposes of providing a 27 home school assistance program to provide instruction outside 28 the basic educational program provided to regularly enrolled 29 students by the school district. 30 2. Purposes for which a school district may expend funds 31 received pursuant to section 257.6, subsection 1, paragraph 32 “a” , subparagraph (5), shall include but not be limited to the 33 following: 34 a. H.F. 2326 b. Student and teaching-parent support services and staff 1 support services. 2 c. Salary and benefits for the supervising teacher of 3 the home school assistance program students. If the teacher 4 is a part-time home school assistance program teacher and a 5 part-time regular classroom teacher, funds received pursuant to 6 section 257.6, subsection 1, paragraph “a” , subparagraph (5), 7 may be used only for the portion of time in which the teacher is 8 a home school assistance program teacher. 9 d. Salary and benefits for clerical, office, and 10 administrative staff of the home school assistance program. If 11 the staff members are shared with other programs or functions 12 within the district, funds received pursuant to section 257.6, 13 subsection 1, paragraph “a” , subparagraph (5), shall only 14 be expended for the portion of time spent providing the home 15 school assistance program services. 16 e. Staff development for the home school assistance program 17 teacher. 18 f. Travel for the home school assistance program teacher. 19 g. Resources, materials, software, and supplies, and 20 purchased services that meet the following criteria: 21 (1) Are necessary to provide the services of home school 22 assistance. 23 (2) Are retained as the possessions of the school district 24 for its prekindergarten through grade twelve home school 25 assistance program. 26 3. Purposes for which a school district shall not expend 27 funds received pursuant to section 257.6, subsection 1, 28 paragraph “a” , subparagraph (5) include but are not limited to 29 the following: 30 a. Indirect costs or use charges. 31 b. Operational or maintenance costs in addition to the cost 32 of maintaining school district facilities. 33 c. Capital expenditures other than equipment or facility 34 acquisition or lease expenditures. 35 -2- LSB 5989YH (4) 83 kh/sc 2/ 4
H.F. 2326 d. Student transportation except in cases of home school 1 assistance program-approved field trips or other educational 2 activities. 3 e. Administrative costs other than the cost of employing an 4 administrator for the home school assistance program. 5 f. Dual enrollment program costs and postsecondary 6 enrollment options program costs. 7 g. Any other expenditures not directly related to providing 8 the home school assistance program. A home school assistance 9 program shall not provide moneys to parents or students 10 utilizing the program. 11 EXPLANATION 12 This bill codifies language adopted by rule by the state 13 board of education relating to home school assistance programs, 14 but the bill makes changes relating to the purposes for which 15 state school aid can and cannot be expended. 16 The bill permits school districts to establish a home school 17 assistance program for a specific category of students that 18 is provided outside the basic educational program provided to 19 students who are regularly enrolled in the school district. 20 School districts currently may count a student utilizing a 21 home school assistance program as three-tenths of one pupil. 22 The bill specifies the purposes for which school districts may 23 expend from the funds received from that weighting, and the 24 purposes for which school districts cannot use the funds. 25 Under the bill, funds may be used for assisting parents 26 with instruction; teaching-parent support services; salary 27 and benefits for a supervising teacher; salary and benefits 28 for clerical, office, and administrative staff of the 29 home school assistance program; and necessary resources, 30 materials, software, and supplies, and purchased services 31 for prekindergarten home school assistance programs if the 32 resources are retained by the school district. 33 Under the bill, funds cannot be expended for certain 34 capital expenditures, student transportation for other than 35 -3- LSB 5989YH (4) 83 kh/sc 3/ 4
H.F. 2326 educational enrichment, and administrative costs other than an 1 administrator employed by the school district to administer 2 the program.
