Section
1.
Section
262.12,
Code
2009,
is
amended
to
read
as
1
follows:

262.12
Committees
and
administrative
offices
under
board.

1.
The
state
board
of
regents
shall
also
have
and
exercise
4
all
the
powers
necessary
and
convenient
for
the
effective
5
administration
of
its
office
and
of
the
institutions
under
6
its
control,
and
to
this
end
may
create
such
committees,
7
offices
,
and
agencies
from
its
own
members
or
others,
and
8
employ
persons
to
staff
the
same
,
fix
their
staff
compensation
9
and
tenure
and
delegate
thereto,
or
to
the
administrative
10
officers
and
faculty
of
the
institutions
under
its
control,
11
such
part
of
the
authority
and
duties
vested
by
statute
in
the
12
board,
and
shall
formulate
and
establish
such
rules,
outline
13
such
policies
and
prescribe
such
procedures
therefor,
all
as
14
may
be
desired
or
determined
by
the
board
as
recorded
in
their
15
minutes.

2.
Notwithstanding
subsection
1,
the
state
board
of
regents
17
shall
consolidate
into
one
system
all
of
the
operational
18
functions
of
the
institutions
of
higher
education
it
governs,
19
including
but
not
limited
to
communication
and
information
20
technology,
personnel
and
fiscal
management
systems,
and
legal
21
services.
This
single
system
shall
be
administered
by
the
22
state
board
of
regents
and
shall
provide
services
uniformly
23
to
all
of
the
institutions
of
higher
education
governed
24
by
the
state
board.
An
institution
of
higher
education
25
governed
by
the
state
board
of
regents
shall
not
administer
26
any
of
these
operational
services
independently
nor
shall
it
27
procure
operational
services
from
any
entity
unless
the
system
28
administered
by
the
state
board
of
regents
does
not
offer
29
substantially
the
same
service.

EXPLANATION
31
This
bill
directs
the
state
board
of
regents
to
consolidate
32
into
one
system
all
of
the
operational
functions
of
its
33
universities
including
but
not
limited
to
communications
34
and
information
technology,
personnel
and
fiscal
management

systems,
and
legal
services.
The
state
board
shall
administer
1
the
single
system,
which
must
provide
services
uniformly
to

all
of
the
universities.
The
universities
are
prohibited
from
3
administering
any
of
these
services
independently
and
from
4
procuring
operational
services
from
any
entity
unless
the
5
regents’
system
does
not
offer
substantially
the
same
service.
