H.F. 2306 Section 1. NEW SECTION . 22.15 Judicial branch —— rules. 1 This chapter does not apply to government records owned, 2 created, possessed, or under the control of the judicial 3 branch. The supreme court shall prescribe rules governing 4 access to such records consistent with the provisions of this 5 chapter. 6 Sec. 2. Section 252B.24, subsection 2, paragraph b, Code 7 2009, is amended to read as follows: 8 b. Provision to the unit of information filed with the 9 clerk of the district court by a party under section 598.22B , 10 and the social security number of a child filed with the clerk 11 of the district court under section 602.6111 . 12 Sec. 3. Section 602.6111, Code 2009, is repealed. 13 EXPLANATION 14 This bill relates to judicial branch records. 15 The bill provides that the provisions of Code chapter 22 16 (Iowa’s open records law, relating to the regulation of records 17 of a government body as defined in that chapter) do not apply 18 to government records owned, created, possessed, or under the 19 control of the judicial branch. However, the supreme court is 20 required to prescribe rules governing access to such records 21 consistent with the purposes of Code chapter 22. 22 The bill repeals a Code section requiring that certain 23 identification information be filed with the clerk of the 24 district court including social security numbers and makes a 25 conforming Code change to Code section 252B.24 relating to 26 social security numbers of children in child support recovery 27 cases. 28 -1- LSB 1404HZ (3) 83 rh/rj 1/ 1
